I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit (NWP) 29 (http://saw-reg.usace.army.mil/NWP2017/2017NWP29.pdf). Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file: 1) There is a length of daylighted stream between the end of the existing 24" pipe and the existing 36"pipe near the property line. This length of stream is proposed to be piped and must be included in the permanent stream impact amount on section C.3 of the PCN; 2) Given that the proposed action proposes to place Stream SA into a larger stormwater drainage pipe network where aquatic life passage is not possible, and in order to prevent headcutting upstream of the proposed crossing, please re -design the proposed culvert pipe to be placed at -grade rather than buried —1 ft. Update the PCN and plan and profile drawings accordingly; 3) Given recent USFWS concerns regarding suitable Schweinitz's sunflower and small whorled pogonia habitat, please have a qualified environmental professional complete a pedestrian survey for these species within the Corps ESA action area. In this case, the Corps ESA action area would be contained within a 100 foot radius of the footprint of proposed impacts to waters of the US, including the currently proposed footprint and any revised footprint if project plans are changed per item # 2 in my earlier email. Following the survey, please provide the survey report to the Corps (copy also the USFWS) for review. Of course, if you do not believe that any suitable habitat exists in the Action area for these species, please provide a justification so that the Corps could evaluate the potential for a No Effect determination.
