PROJECT SUMMARY: The applicant proposes to construct a dry-stack storage facility with associated marina clubhouse, driveways, parking lots, septic system, storm water treatment system, pedestrian access pier, and a travel lift pier with fixed platforms and floating docks. PRO.IECT DESCRIPTION: The project site is located at 1512 Burnett Road, adjacent to the Atlantic Intracoastal Waterway/Myrtle Grove Sound, just south of Carolina Beach Inlet, in New Hanover County. To locate the property from Carolina Beach Road (NC Highway 421), turn left onto Burnett Road and travel east approximately 0.5 miles. Continue around the bend and the subject property will be located on the right. The property encompasses approximately 2.87 acres and averages 7 feet above mean sea level. The project site is bordered by Burnett Road to the west, a single family residence to the south, community water access area to the north and the Myrtle Grove Sound to the east. The property has approximately 390 linear feet of shoreline adjacent to Myrtle Grove Sound, that has been stabilized by a bulkhead. Existing highground structures include a garage/workshop building with an associated driveway and a gazebo located next to the boatramp. A chain linked fence and concrete/cinder-block wall surround the perimeter of the property. Water dependent structures that exist at the property include a private boat ramp, a fixed pier with an L-head platform, and one boatlift. Existing water depths adjacent to these water dependent structures average approximately -1.5'to -2.5' @ Mean Low Water (MLW). Upland vegetation consists of Oak, ornamental landscaping and lawn grasses. Water-ward of the existing bulkhead on the southern side of the property is an area of low marsh consisting primarily of Smooth Cordgrass (Spartina altern flora), which extends approximately 60 feet towards the AIWW/Myrtle Grove Sound. U.S. Army Corps of Engineers file records indicate that in 1969 Mr. Homer Ward received a federal permit authorizing the construction of a private bulkhead, boat ramp, fixed pier and platform. On January 14, 1971, a memorandum by Mr. Thomas L. Linton from the N.C. Department of Conservation and Development states that Mr. Homer Ward submitted a State Dredge and Fill Permit application on January 11, 1971. However, there is no record that a State Dredge and Fill Permit was ever issued. New Hanover County issued Mr. Homer Ward a Special Use Permit in 1971 for a commercial marina at this location. The permit application indicates that the commercial sale of fuel from the terminal end of the dock occurred during the late 1960's and early 1970's. The application also indicates that the boat slips were utilized until approximately 1990 and that the boat ramp has continued to be used, although has not been used commercially in several years. On October 20, 1992, Mr. Homer Ward received a CAMA General Permit No. 10616-D authorizing a boathouse, catwalk and installation of a boatlift. On September 9, 2004, the applicant, Mr. Tim Ward received a CAMA General Permit, No. 36899-D authorizing the construction a new bulkhead two (2) feet waterward of the existing bulkhead at this location. On January 22, 2007, CAMA Major Permit 902-07 was issued to Carolina Marina and Yacht Club, LLC c/o of Tim Ward for modifications to the existing pier structure including a boatlift, covered platform and "T-head" floating dock with fuel services and the construction of a bulkhead, upland facilities including parking lot, clubhouse and storm water features. The New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground of the project area as Resource Protection. The waters of the AIWW/Myrtle Grove Sound are classified SA by the N.C. Division of Water Quality and are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and are OPEN to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to construct a 200-slip dry-stack storage facility with associated marina clubhouse, driveways, parking lots, septic system, storm water treatment system, pedestrian access pier, and a travel lift pier with associated fixed platforms and floating docks. The applicant is also proposing to construct a bulkhead in the location of the existing boat ramp. Major Modification to CAMA Major Permit 402-07 Carolina Marina, Inc. c/o Tim Ward Page 3 Upland development would consist of a 200-slip dry stack storage facility, marina clubhouse/office with an associated parking lot, septic system and a stormwater treatment system. The proposed dry-stack storage building would be located on the highground adjacent to the northern property boundary and would measure approximately 290 feet long by 115 feet wide and would be 40 feet tall. The marina clubhouse/office would be located adjacent to the storage facility and would consist of a 30 feet wide by 50 feet long building with a 10 feet wide by 50 feet long deck. This building would also have two bathrooms constructed to service the facility. The applicant states the waste treatment for the clubhouse is authorized by CAMA Major PermiO 02-07 and is proposed to be relocated landward with this modification. Drawings have not been provided showing the proposed relocation and the applicant states that the treatment of wastewater would be provided by the private utility company, Aqua North Carolina. The system currently authorized would be located on the northern side of the clubhouse/office. Located south of the dry-stack storage building would be an associated parking area consisting of concrete and pervious pavers, measuring approximately 50 feet wide by 350 feet long. The proposed parking area would provide 66 parking spaces (three handicapped and sixty-three individual parking spaces). A pervious walkway and fire access measuring 20 feet wide would connect the parking area to the proposed pier and would be located outside of the 30' Buffer (see Sheet 5 of 11). Extending from the east side of the proposed dry storage building to the bulkhead, would be a 24 feet wide by approximately 210 feet long concrete driveway to provide fork lift service from the building to the waterway. A wooden pedestrian walkway, approximately 8 feet wide and 130 feet long, is proposed from the walkway and fire access drive to the bulkhead. The applicant is proposing changes to the stormwater system including infiltration trenches, a rain garden, level spreader, and a vegetative filter (see Sheet 6 of 10). A modification request to the existing stormwater permit was submitted to the Division of Water Quality in December 2009 by Stroud Engineering. A bulkhead, approximately 50 feet in length, is proposed in the location of the existing concrete ramp. The proposed bulkhead would be aligned along the Normal High Water line of the boat ramp, the concrete ramp would be removed, and the bulkhead would tie into the existing bulkhead to the north. Additional bulkhead, approximately 124 linear feet, is proposed approximately 2 feet waterward of the existing bulkhead. The proposed bulkhead located waterward of the existing wall would extend from the existing boat ramp location, thru Coastal Wetlands, to the southern property line. As proposed the fork lift pier and associated floating docks would extend into the waterbody approximately 180 feet and would be aligned along the established pier head line (see Sheet 11 of 11). The applicant is proposing changes to the water dependant structures by removing the existing fixed pier and boat ramp, eliminating the authorized fuel dock, and constructing an elevated, wooden forklift pier with adjacent pedestrian pier and associated platforms. The proposed forklift pier would extend southeast of the existing bulkhead toward the waterway. The proposed forklift pier would be 24 feet in width and would extend into the waterbody, approximately 84 feet, where the pier would flare at a 45 degree angle to a platform measuring approximately 50 -70 feet in length and 71 feet in width. The applicant has proposed the platform to accomodate a turn-around area for a forklift that would be used to transport vessels from the dry-storage facility to the drop zone. The drop zone would be located at the terminal end of the forklift platform and would be equipped with two finger piers and a dockside lift. The proposed dock side lift would be affixed to the terminal end of the forklift platform and would be utilized in combination with the forklift to lower vessels into the drop zone (see Sheet 7 of 11). A descripton of the proposed dockside lift can be found at the following website: http://www.mmbhe.com The applicant states that water depths in the location of the drop zone range from -3.3 feet to -4.3 feet at Mean Low Water, however site visits conducted by DCM field staff on April 9, 2010, April 15, 2010 and June 28, 2010 observed water depths, in the location of the existing pier, proposed drop zone, and floating docks to be approximately -2.2 feet to -3.5 feet at Normal Low Water. The applicant is also proposing to install a wave wall at the eastern end of the forklift pier (see Sheet 11A). The proposed wave wall would consist of horizontal boards with a minimum of 1 inch spacing between boards. The applicant is proposing a pedestrian pier, extending from the bulkhead, on the south side of the proposed wooden forklift pier. The proposed pedestrian pier would be constructed independently, designed with a 2-foot separation for safety and would parallel the proposed wooden forklift pier and platform. The pedestrian pier would be 8 feet in width and approximately 67 feet in length. The pedestrian pier would extend toward the platform, would combine with and cross over the forklift pier to create pedestrian access piers on both the northern and southern sides of the forklift platform. The pedestrian access pier on the southern side would connect to a triangular shaped covered attendant station and continue to parallel the forklift platform for approximately 25 feet. The pedestrian access pier on the south side of the wooden forklift platform would connect via ramp to a proposed "L-head" floating dock that would extend to the east approximately 28 feet and to the south approximately 80 feet and would measure 8 feet in width. The pedestrian access pier on the northern side of the wooden forklift platform would connect via ramp to a proposed "L-head" floating dock that would extend to the east approximately 18 feet and to the north approximately 18 feet and would measure 8 feet in width. The proposed floating docks would be used for temporary tie up for boats awaiting transport to and from the dry storage facility. The proposed floating docks have been designed with standard foam filled floats beneath the dock and with additional hollow wave attenuating floatation. As proposed, the floating docks have been designed to provide spacing beneath the floatation and the bottom substrate. Due to the variation in water depths along the alignment of the floating docks, a minimum clearance of 9.25 inches between the wave attenuating floatation of the floating dock and the bottom substrate can be expected atNonnal Low Water (see Sheet 9 of 11). The proposed pier would extend into a waterbody that measures approximately 728 feet wide, as measured from the Normal High Water line on the opposite shoreline and the waterward extent of the existing bulkhead. The proposed fork lift pier and associated floating docks would extend approximately 178 feet. The width of waterbody was determined in the field by the applicant, consultant and DCM field staff on May 14, 2010. The opposite shoreline is located on the west side of the North End of Carolina Beach and the south side of Carolina Beach Inlet. The opposite shoreline has accreted over the last several years and is located within the proposed expansion of the Inlet Hazard Area of Environmental Concern. 10. ANTICIPATED IMPACTS Approximately 117,612 square feet of highground area would be disturbed from the construction of the dry storage facility, clubhouse/office, parking lot, and driveways. The applicant states the proposed highground structures would create approximately 55,007 square feet of impervious area (approximately 44% coverage). Of this, approximately 8,200 square feet would be located within the 75 feet Estuarine Shoreline AEC. The application indicates that this represents approximately 25.5% of the total Estuarine Shoreline AEC. The proposed bulkhead would result in the filling of approximately 324 square feet of Estuarine Waters and the filling of approximately 170 square feet of Coastal Wetlands. The proposed fork lift pier, pedestrian pier, associated platforms and floating docks would incorporate 10,100 sq. ft. of Estuarine Waters and Pubic Trust Area. Minor increases in turbidity should be expected during construction. The proposed pier would extend approximately 178 feet into a waterbody, which measures approximately 728 feet across. This distance would conform with the 1/4 width rule and the established pier lengths. As proposed, the applicant's proposal would not encroach into the U.S. Army Corps of Engineers 120-foot setback from the AIWW. The floating docks would potentially provide docking space for up to 10 vessels, however, the application indicates that only seven (7) temporary tie ups are proposed as indicated by numbering on the submitted plans. Snider Date: 07/21/2010 Office: Wilmington Request for Major Modification CAMA Permit #02-07, Carolina Marina AIWW/Myrtle Grove Sound, New Hanover County Revised 6/2010 Site Overview: The project site is located at 1512 Burnett Road in southern New Hanover County. The property is 2.87-acres in size with the front property line abutting Burnett Road and the rear property line abutting the Atlantic Intracoastal Waterway/ Myrtle Grove Sound. In this area, waters of Myrtle Grove Sound are classified by the NC Environmental Management Commission as SA, and are open to the harvest of shellfish. Waters are classified by the NC Marine Fisheries Commission as Primary Nursery Area (PNA). Existing Conditions: The site was developed as a commercial marina in the late 1960's and early 1970's. Development included construction of: a fixed pier and dock, twenty wet slips, a concrete ramp, dredge and fill, shoreline stabilization, and commercial sale of fuel from the terminal dock. A 1971 New Hanover County Special Use Permit allowed for the commercial marina. Various other federal and state permits for improvements to the property were issued and copies were provided in the original permit application package. Excepting the twenty boat slips, all water-dependent structures remain on site including the ramp which remains in use at high tide. The original fuel dispensers have been removed from the terminal dock. Since the entire shoreline has been historically stabilized, no coastal marsh exists above mean high water. A single stand of Spartina altern/flora exists waterward of the bulkhead along the southern half of the shoreline. Currently Authorized Development (under CAMA Permit # 02-07): Currently authorized water dependent structures, some of which are not yet constructed on site, include: (1) the addition of a floating fuel dock (2) a covered, un-enclosed platform for a fuel attendant at the terminal end of the existing fixed pier (3) four transient slips at the fuel dock and one permanent wet slip (4) launch and retrieval at the existing ramp. Currently authorized upland development, some of which is not yet constructed, includes: (1) improved parking (2) one clubhouse containing two bathrooms and (3) a one-story office building adjacent to the clubhouse. Installation of state-approved stormwater management features are approved under SW8 040103. Currently Requested Changes: The permittee requests to remove the fixed pier, fuel dock, and existing ramp and to construct an elevated, wooden forklift pier with adjacent pedestrian pier. Both piers would be slatted wood decking to allow sunlight and rain to flow through the structure. The bottom of the piers will be approximately 4.5' above mean high water (final top of bulkhead at forklift drive is +6' MSL, MHW = 1.45' MSL). The forklift pier would be 24'-wide at the bulkhead and would extend to 71'-wide,at the terminal end where two drop zones and one dockside lift are located. The width of the forklift pier is minimized at 24'-wide at the landward end, but additional width is needed at the terminal end to create safe launch/retrieval and turn-around areas. The design reflects several modifications since the initial submittal of this modification request in January 2010 and places the structure landward of the'/-width of the waterbody limit as required by CAMA use standards. The waterbody width is defined as normal high water at the bulkhead on the subject property and by elevation on the eastern side of the AIWW (determined by registered land surveyors at Stroud Engineering, Wilmington, NC). Total square footage of the structure has not increased above that originally submitted in January 2010 and has actually decreased slightly. The angle of the concrete access drive to the forklift pier is placed at as much of a ninety-degree angle to the bulkhead as possible to reduce water-dependent impervious cover in the coastal shoreline buffer. The waterward end of the pier is dictated by the alignment of the % width of the,_-, waterbody limit. Given these two angles at either end of the pie, and the necessary width at the drop zone, the flared portion of the pier has been reduced as much as possible and still provide safe use. The pedestrian pier would be 8'-wide and is separated from the forklift pier for safety. Two floating transient docks would be aligned at the'/-width of the waterbody limit and would provide seven transient slips (excluding the two drop zones). No permanent wet slips are requested. Water depths within the drop zone range between -3.3' MLW and -4.3' MLW. No dredging is proposed. The transient docks would be constructed with wave attenuating baffles for more safe and stable use. The depth of the wave attenuating baffles can be constructed to ensure the baffles will not sit on the bottom at MLW, and a typical cross section of flotation showing the planned 18" draft is provided. Placement of horizontal boards on the structural pilings of the terminal end of the forklift pier is also proposed. The boards would be spaced 1" apart to allow for water movement through the boards and would stop 1' above the bottom. With this modification, the currently authorized fuel service would be removed completely. The existing and historically utilized boat ramp would also be removed. Bulkheading exists along the shoreline, and replacement bulkheading is currently authorized. New bulkheading would be needed to tie into the existing bulkhead where the existing ramp is now located. A new alignment for replacement bulkheading on the southern end of the shoreline and also included in this request. Changes in upland development would include the construction of a dry stack storage building. The building would be an average of 40' high and would contain a maximum of 200 boats. Previously approved parking and stormwater management features have been revised to accommodate the upland changes. The previously approved clubhouse and office building has been re-located completely outside the AEC although its dimensions remain the same. No maintenance services would be provided at the facility and the wash down of boats with non- pressure hoses will be limited to areas where appropriate collection and filtering of the washwater is provided (see application forms). County approval of the currently requested site plan revisions provides additional specifications on allowed uses at the facility (hours of operation, etc). The only requested impervious cover in the CAMA's 30' Coastal Shoreline Buffer is the water- dependent access to forklift pier which is a 24'-wide concrete drive. Drop inlets and infiltration piping have been planned down the center of this drive to reduce the amount of structure in the buffer, and will serve the purpose and intent of the buffer by capturing stormwater run-off and moving it away from the waterbody. Other than the concrete drive to the forklift pier, impervious cover in the 75' Coastal Shoreline AEC is limited to a fire-access lane which is required by the County to ensure adequate emergency response. The required fire access through the AEC will largely be pervious pavers although it is calculated as impervious cover. Impervious cover in the AEC will total 25%. Parking areas are located outside the AEC, and pervious pavers will be utilized for parking spaces outside of the drive aisles. Associated Permit Modifications: Stroud Engineering has submitted a modification of SW8 040103 to be reviewed concurrent with this application. A sedimentation and erosion control plan will be submitted to the NC Division of Land Quality before any site work begins. New Hanover County Special Use Permit # 13 has been amended for the requested changes.
