The 401 Certification cannot be processed until five (5) complete sets of the application and associated maps are received at the DWQ Central Office in Raleigh along with the appropriate fee. Please submit two (2) more complete application sets. Any large scale maps that are provided please include a copy of the site plans on CD. One (1) data CD of full sized plans in TIFF Group 4 format (black and white, not grayscale or color). If the plans are too large to store in TIFF format, they can be stored in PDF. The proposed sewer crossing has been revised to reduce the proposed 20' permanent maintenance corridor to a 10' permanent maintenance corridor, as exhibited in the enclosed site plans. "Perpendicular crossings that disturb less than 40 linear feet of riparian buffer with a maintenance corridor equal to or less than 10' in width" are identified as "Exempt" in the Neuse River Buffer Rules Table of Uses. Per Water Quality Certification No. 3821, Exempt activities do not require written approval from the Division of Water Quality. Therefore, the three original copies of the PCN are sufficient to satisfy the Courtesy Copy requirements, and two additional copies of the PCN have not been provided. A copy of the revised Impact Plan exhibiting the proposed 10' Permanent Maintenance Corridor has been provided as Appendix 1. Copies of the site plans have been provided as PDFs on the enclosed CD. 2. This project will require a permitting fee of $240 based on the reading of Water Quality Certification 3819 (NW12). For a complete application you would have to submit a drawing of the project area including the subdivision boundary and include all utilities and greenways that serve the site. I submitted a NWP 12 PCN for the Davis Village project to your office on July 12, 2010. We are proposing the use of the NWP 12 for 20 If of temporary stream impacts for the connection of the onsite sewer system to an existing offsite sewer line. We have already received a Request for More Information from DWQ, and one of the items is requesting verification from the Corps that the project would be authorized under a NWP 12. My reasoning for requesting a NWP 12 for this project is that the only impacts associated with the project were specific to the construction of the sewer connection. There are no other wetland/stream impacts as a result of construction of the project. Please let me know if the Corps agrees that a NWP 12 is applicable to this project Thanks in advance for your help. I sent him an email with the info he requested, along with some additional information that should complete the application. Since the Corps is requiring a NWP 29 and the project requires a Stormwater Management Plan, we are required by Water Quality General Certification 3821 to provide a courtesy copy of the PCN to DWQ. Here's what I need from you to complete the response to the DWQ letter. 1) An email from the Town of Cary stating that the Stormwater Management Plan has been preliminarily approved, and final authorization will not be issued until the appropriate 404/401 authorizations are issued. 2) A copy of the stormwater info that was submitted to the Town of Cary for approval.
