PROJECT SUMMARY: The applicant proposes to install an 8' x12' floating dock, increasing the total slip count from two (2)to three(3). 3217 Seacrest Private Docking Facility September 30, 2020 Page 2 9. PROJECT DESCRIPTION The proposed project is located at 3217 Seacrest Ave, on the mainland side of the AIWW, across from Holden Beach, Brunswick County. The property can be reached by traveling NC HWY 17 south towards Holden Beach. Continue past the Supply intersection,turn left onto Mt. Pisgah Rd SW and travel 4 miles. Continue south onto 130 E and immediately turn right onto Oxpen Rd SW. Drive for 1.7 miles and then turn left onto W Tanglewood Dr SW. Continue for .5 miles and turn right onto Waterview Dr SW. Take the next left onto Bayshore Dr SW and continue until it turns into Seacrest Ave SW. The applicant's property will be on the right-hand side of the road. Existing structures on the project site include a single family residence and a shared 2 slip docking facility that originates on the property line between 3217 and 3223 Seacrest Ave SW. A new private two (2) slip docking facility has been permitted (GP 76468 on 7-30-20) for 3217 Seacrest Ave SW but has not been constructed as of 9-24-20. The shared docking facility will be fully removed prior to the completion of the docking facility permitted under GP 76468,per conditions stated on GP 76468. The permitted docking facility includes a 6' x 142' access pier, a 12.66' x 23.66' gazebo and two 13' x 13' open boatlifts. The project site is approximately .13 acres and is vegetated primarily with domestic grasses and ornamental landscaping. The high ground is elevated approximately 5'- 6' above the normal high water(NHW) level, and the shoreline (+/- 50 linear feet) is stabilized by native vegetation and 404 type wetlands. High marsh species extend approximately 20' waterward of the high ground and include Black Needlerush (Juncus roemerianus), Saltmeadow Cordgrass (Spartina patens), and Salt Grass (Distichlis spicata). A continuous patch of Smooth Cord Grass (Spartina alterniflora) extends approximately 50' waterward of the high marsh species. Residential properties border the project site to the east and west and the AIWW runs across the south side of the property. The width of the AIWW measures approximately 515 feet from marsh edge to marsh edge at the proposed project site. The waters of the canal system are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area(PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the July and September 2020 site visits, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. According to the application, water depths in the vicinity of the proposed floating dock range from approximately-1'2"to -1'4", relative to NLW(Page 3 of 3). Water depths were verified by DCM staff on 9-16-20. PROPOSED PROJECT The applicant proposes to install an 8' x 12' floating dock, increasing the total slip count from two (2)to three (3). The applicant proposes to install an 8' x 12' floating dock, accessed by a gangway attached to the previously permitted 12' x 23' gazebo (Page 2 of 3). The gazebo was designed to be built landward of the existing pier-head line to allow room for the proposed floating dock in the deepest water available (approximately-1'2"to -1'4"NLW). According to the applicant,the previously permitted docking facility(GP 76468) would be constructed at the same time as the proposed 8' x 12' floating dock. As proposed, the docking facility would extend approximately 142' from NHW into the AIWW. The submitted application indicates that the width of waterbody is approximately 515' across at the project location. The 1/4 waterbody width is approximately 129'. According to the workplat provided,the applicant's floating dock would not exceed the 1/4 width limitation, extending approximately 95' into the AIWW (as measured from the edge of Coastal Wetlands).As proposed,the proposed floating dock does not appear to encroach into the riparian corridor to the west. A setback waiver was obtained from the property owner to the east. 3217 Seacrest Private Docking Facility September 30,2020 Page 3 10. .ANTICIPATED IMPACTS The proposed docking facility would incorporate approximately 96 sq. ft. of Estuarine Waters and Public Trust Area. The docking facility would remain consistent with similar pier length requirements (established pier-head line). The proposed floating dock would not encroach into the 15-foot riparian corridor setback of the western property owner. Minor increases in turbidity should be expected during piling installation. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above,you should consider the review period extended. Under those circumstances,this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from September 20th,2020 you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner,developer,and project designer/consultant. NCGS I I 3A-119(b)requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a"Notice of Permit Filing"postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be:Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property;or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made,and if additional information is required,you will be contacted by the appropriate State or Federal agency.
