This is a quick summary of my thoughts after reading the documents. In my 11/26 e-mail, I had agreed with Kathy that the 339 acres of preservation should have a 10:1 credit ratio unless LMG provided information to demonstrate a lower ratio. The second attachment is their analysis of each preservation area where they designated a ratio for each and then averaged the credit ratio to a final 7.1:1, resulting in 47.7 credits. In my review of their report, along with my cursory onsite observations, I have no problem concurring with the 7.1:1. 1 would prefer to make it an even 48 credits to simplify and make the accounting more manageable; and give minor credit for the 50' upland buffer. For the credit release schedule (the first attachment), there will have to be a few changes in keeping with the NCIRT agreed schedule upon late last summer. This would correlate to the following: WETLANDS- Riverine and non-riverine 1) 15%- signing of MBI, good 2) 15%-completion of physical and biological improvements, good 3) 10%-first year, good 4) 10%-second year, not 15% 5) 20%-third year, not 10% 6) 10%-fourth year, good 7) 10%-five year, not 20% 8) 10%- could be combined with #7 at year five if MBRT agrees that the bank meets the overall objectives and the Success Criteria set forth in the plan. STREAMS 1) 15%- signing of MBI, good 2) 15%- completion of physical and biological improvements, good 3) 10%- first year, good 4) 10%- second year, not 15% 5) 10%- third year, not 15% 6) 10%- fourth year, good 7) 15%- fifth year, not 20% 8) 15%- MBRT agrees bank meets overall obj. and S.C. - two bank full events in different years of the monitoring period. Lastly, in my conversations with LMG, they will not have the stream component fully completed at the same time the Carolina Bay is finished, receiving only the 15% credits when the MBI is signed. The projected completion dates for each are disclosed in the release schedule attachment. I instructed LMG that only one annual monitoring report should be sent out, but the report should be concise and clear in separating the two areas. Take a look at this and let me know what you think. If possible, could you provide me any comments within the next two weeks? Also, I have enclosed a copy of the Nationwide Permit No. 27 construct the site that was issued last week.
