After discussions with staff, the Division of Marine Fisheries has not changed its position
regarding the permit application for Bennett Brothers Yachts, Inc. since commenting on the original
joint Division of Coastal Management/Division of Water Quality application. We continue to object to
issuance of the 401 permit due to significant adverse impacts to a productive primary nursery area.
Should the Division of Water Quality determine that they will be issuing
contact Anne Deaton of my staff to discuss specific permit conditions and mitigation.
