REQUEST FOR MORE INFORMATION
Dear Mr. Hughes:
On June 25, 2010, the Division of Water Quality (DWQ) received your application dated June 16, 2010 to
impact 455 square feet (ft) of Zone 1 protected riparian buffers and 496 square feet (ft) of Zone 2
protected riparian buffers for the stormwater outfall at the subject property. The DWQ has determined
that your application was incomplete and/or provided inaccurate information as discussed below. The
DWQ will require additional information in order to process your application to impact protected
wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the
additional information requested below, we will place this project on hold as incomplete until we receive
this additional information. If we do not receive the requested information, your project will be formally
returned as incomplete. Please provide the following information so that we may continue to review your
project.
Additional Information Requested:
1. Please provide an agent authorization letter for the application signature.
2. Per the requirements of the Jordan Riparian Buffer Rule, all new stormwater conveyances from this
site must be discharged through a correctly designed level spreader or other BMP that removes 30%
of total nitrogen and total phosphorus. Because the bioretention area is being used in lieu of a level
spreader, the DWQ considers this device to be the diffuse flow plan for new stormwater outlets A and
B.
3. Please provide a full-size plan sheet showing the entire site with its storm drainage system, including
every inlet, outlet and conveyance device. Please show how diffuse flow requirements have been met
at each proposed new stormwater outlet location.

4. Please address the following design issues with the bioretention area. Additional design issues may
become apparent after the DWQ has the opportunity to review the supplement form and required
items:
• The forebays of the proposed bioretention areas should be equipped with liners to prevent
stormwater from seeping through the berm and passing directly to the underdrain system
without appropriate treatment. Please provide a design for the northeastern forebay.
• The planting plan must show the actual location of the plants within the bioretention cell.
• The use of two-year, slow release fertilizer is in excess of the BMP manual's fertilizer
limitations, which allow only a one-time fertilizer application to establish vegetation.
• A scaled cross-section must be provided showing the forebay, treatment area, underdrains,
media, outlet structure, sand layer, mulch, filter fabric, etc.
• The tree and shrub planting details should be modified to show one-half to one-third of the
rootball above grade.
• The discharge pipe should be extended to the stream bank to avoid erosion issues within the
riparian buffer.
• A soil test to document the estimated elevation of the seasonal high water table must be
provided.
• The engineered soil media must have a minimum depth of three feet. The appropriate P-
index for the soil media must be specified.
• A signed and notarized Operation and Maintenance Agreement must be provided.
5. Please explain how the remaining undeveloped area on the north side of the property fronting US-64
will be utilized.

If the plans are too large to store in TIFF format, they can be stored in PDF format.
Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this
information to me. If you will not be able to provide the requested information within that timeframe,
please provide written confirmation that you intend to provide the requested information, and include a
specific timetable delineating when the requested materials will be provided. If we do not hear from you
in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider
the project as returned.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized (at
