Debit$570 from WBS Element No. 44997.1.1 Dear Ms. Hair: The North Carolina Department of Transportation (NCDOT)proposes to upgrade the existing at- grade intersection at US 74 and SR 1506 (Old Boardman Road/Macedonia Church Road) to an interchange. The interchange will consist of constructing a diamond interchange at US 74/SR 1506 east of the current interchange with roundabouts north and south of US 74, realigning Old Boardman Road onto a structure over US 74, and upgrading US 74 within the project limits to interstate standards. Please see the enclosed ENG 4345 form, list of property owners, State Stormwater Management Plan (SMP),permit drawings, and design plans for the above referenced project. PROJECT SCHEDULE The Let date for the R-5797 Project is April 20, 2021. Full construction is anticipated to begin by May 2021 and be completed by October 2023. The primary purposes for the project are to improve safety, improve transportation mobility within the project study area, and upgrade US 74 within the project limits to interstate standards. NEPA DOCUMENT STATUS A Categorical Exclusion(CE)was approved for the project in August 2018 and has been provided to all appropriate agencies. The CE is also available on the NCDOT website at https://connect.ncdot.gov/resources/Environmental/Pages/default.aspx, under Quick Links > Environmental Documents. INDEPENDENT UTILITY The subject project is in compliance with 23 CFR Part 771.111(f) which lists the Federal Highway Administration(FHWA) characteristics of independent utility of a project: 1. The project connects logical termini and is of sufficient length to address environmental matters on a broad scope, 2. The project is usable and a reasonable expenditure, even if no additional transportation improvements are made in the area, 3. The project does not restrict consideration of alternatives for other reasonably foreseeable transportation improvements. Project R-5797 can function as a stand-alone project that can be built without additional transportation improvements since it is designed improve safety and mobility within the project area. Therefore, the R-5797 project would be a reasonable expenditure in keeping with 23 CFR Section (23) 771.111 (f)(2). RESOURCE STATUS Wetland and stream determinations within the R-5797 project study area were conducted using the field delineation methodologies outlined in the 1987 Corps of Engineers Wetland Delineation Manual(Environmental Laboratory, 1987) and the subsequent Regional Supplement to the Corps of Engineers Delineation Manual:Atlantic and Gulf Coastal Plain Region (U.S. Army Corps of Engineers [USACE] Version 2.0 [April 2012]). The N.C. Wetland Assessment Method(NCWAM) User Manual, Version 4.1 (October 2010)was also used to classify wetlands within the project study area. Stream identification and classification followed the Methodology for Identification of Intermittent and Perennial Streams and Their Origins, Version 4.11, [September 2010]. The jurisdictional wetlands and streams were field verified by Liz Hair(USACE Regulatory Specialist) on April 9, 2019. R-5797 Individual Permit Application Page 2 of 8 The project area lies within the Coastal Plain physiographic region of North Carolina. Jurisdictional features within the project footprint are located in the Lumber River Basin(United States Geological Survey [USGS] Hydrologic Unit 03040203) in Columbus County. There are no jurisdictional streams that will be impacted by this project within this river basin. There are no designated High Quality Waters (HQW), Outstanding Resource Waters (ORW), Water Supply I(WS-I), Water Supply II(WS-II), or Trout Waters (Tr) occurring within 1.0 mile of the project area. No Anadromous Fish Spawning Areas or potential habitat areas are located near or within the project study area. Within 1.0 mile of the construction footprint, no streams are listed as a 303(d) water in the 2018 Final North Carolina 303(d) List of Impaired Waters of North Carolina for turbidity or sedimentation. IMPACTS TO WATERS OF THE UNITED STATES Wetlands There will be a total of 11.40 acres of permanent wetland impacts associated with this project due to fill, 1.89 acres due to mechanized clearing, and 0.06 acres due to excavation. There will be no impacts to wetlands resulting from utilities or hand clearing. These impacts are summarized in Table 1 below. Table 1. 'Mitigation ratio for all applicable wetland sites is 1:1. 'Rounded total is based on the sum of the actual impacts. Permit Impact Sites The R-5797 project involves five impact sites described below and presented in the attached plans. Site 1 Wetland impacts at this site result from the proposed fill slopes and lateral roadside ditch for runoff. Permanent wetland fill in wetland WB is proposed to be 0.09 acre with an additional 0.09 acre of impact due to mechanized clearing for construction and maintenance access. R-5797 Individual Permit Application Page 3 of 8 This site also includes a 20 foot extension of an existing 210 ft 30"RCP pipe under US 74 carrying stormwater runoff and drainage from the proposed roadway and surrounding properties on the north side of the project. There will be a pipe outlet basin excavated within wetland WB in order to slow the velocity of throughflow and prevent future erosion at the pipe outlet, resulting in 0.01 acre of wetland excavation. Site 2 Wetland impacts at this site result from the US 74 westbound proposed fill slopes, exit ramp, and roundabout. Permanent fill in wetland WE is proposed to be 5.10 acres with an additional 0.71 acre of impact due to mechanized clearing for construction and maintenance access. The location of the proposed roundabout is designed to avoid impacts to the existing gas station, and to allow for traffic to safely negotiate the roundabout and access US 74 on and off-ramps as well as Old Boardman Road and the gas station. There are two equalizer pipes planned to be installed in order to maintain wetland hydrology internal to the interchange. Site 3 Wetland impacts at this site result from the US 74 eastbound proposed fill slopes, US 74 entrance ramp, and roundabout. Permanent fill in wetland WH is proposed to be 6.17 acres with an additional 1.05 acre of impact due to mechanized clearing for construction and maintenance access. Excavation in the wetland for culvert installation and maintenance, as well as ditch construction, will result in 0.04 acre of permanent wetland impact. The location of the proposed roundabout is designed to align with the northern roundabout and retain traffic on Macedonia Church Road. There are two equalizer pipes planned to be installed in order to maintain hydrology internal to the interchange. Site 4 Permanent wetland impacts at Site 4 are<0.01 acre (200 square feet) of mechanized clearing within wetland WD that will allow for the construction and maintenance of the proposed culvert, rip rap pad, and stormwater management system. The channel that is carrying flow under the existing Macedonia Church Road in this location was determined during USACE site verification to be a tributary, thus resulting in no permanent stream loss due to the installation of the proposed culvert. Site 5 Impacts at Site 5 are required to construct a proposed turn-around on US 74 West. This site proposes permanent fill in wetland WE of 0.04 acre, and 0.04 acre of mechanized clearing. MITIGATION OPTIONS The USACE has adopted, through the Council on Environmental Quality(CEQ), a wetland mitigation policy that embraces the concept of"no net loss of wetlands" and sequencing. The R-5797 Individual Permit Application Page 4 of 8 purpose of this policy is to restore and maintain the chemical, biological, and physical integrity of the waters of the United States. CEQ has defined mitigation of wetland and surface water impacts to include: avoiding impacts, minimizing impacts, rectifying impacts, reducing impacts over time, and compensating for impacts (40 CFR 1508.20). The NCDOT is committed to incorporating all reasonable and practicable design features to avoid and minimize jurisdictional impacts, and to provide full compensatory mitigation of all remaining, unavoidable jurisdictional impacts. Avoidance measures were taken during the planning phase and minimization measures were incorporated as part of the project design. Minimization includes the examination of appropriate and practicable steps to reduce adverse impacts. Shifting the interchange west of the existing location was evaluated to reduce or avoid wetland impacts. However, this westward shift would have required roadway improvements in the floodplain of the Lumber River, and potentially increased impacts to the higher quality floodplain riparian wetland system. Avoidance and Minimization Avoidance and minimization has been employed in the project area to the maximum extent practicable. Listed below are some of the measures implemented on the project: • Side slopes have been steepened to 3:1 adjacent to jurisdictional impact areas to minimize impacts to surface waters, except for areas were side slopes are 4:1 due to the addition of a guardrail not being feasible at these locations; • Steepened fill slopes will be revegetated using NCDOT approved vegetation. • NCDOT's Best Management Practices (BMPs) for the Protection of Surface Waters will be enforced; • NCDOT's BMPs for Construction and Maintenance Activities will be utilized; • NCDOT will implement installation, inspection, and maintenance of erosion and sediment control measures; • Rip rap pads at drainage system outlets will dissipate flow and reduce velocities and erosive potential; • Rip rap stabilization has been sized appropriately based on flow velocity to ensure long term stability of banks; • Existing drainage patterns have been maintained to the maximum extent practicable. Compensatory Mitigation This project will permanently impact 0.19 acre of forested riparian wetlands and 13.16 acres of forested non-riparian wetlands. NCDOT will be requesting the Division of Mitigation Services to debit from the Juniper Bay Mitigation Site in Robeson County for 13.35 acres of wetland impact at a 1:1 ratio based on this mitigation site being in the ground and successful. R-5797 Individual Permit Application Page 5 of 8 FEDERALLY PROTECTED SPECIES Plants and animals with federal classifications of Endangered(E) or Threatened(T) are afforded protection under provisions of Section 7 and Section 9 of the Endangered Species Act (ESA) of 1973, as amended. As of July 17, 2020, the U.S. Fish and Wildlife Service (USFWS) lists seven(7) species as threatened and/or endangered, of which one (1) species is listed as threatened by similarity of appearance in Columbus County,NC. Summary of Species with Habitat Cooley's meadowrue Suitable habitat for Cooley's meadowrue exists along roadsides and rights-of-way in the study area. A survey was conducted throughout the area of suitable habitat on June 23, 2017 and October 28, 2020. No individuals of Cooley's meadowrue were observed. A review of the NCNHP records, updated October 2020, indicates no known occurrences within 1.0 mile of the study area. Rough-leaved loosestrife Suitable habitat for rough-leaved loosestrife exists along roadsides and rights-of-way in the study area. A survey was conducted throughout the area of suitable habitat on June 23, 2017. No individuals of rough-leaved loosestrife were observed. No additional surveys are required since the documented occurrence is considered historical (more than 50 years ago). A review of the NCNHP records, updated October 2020, indicates no known occurrences within 1.0 mile of the study area. Northern long-eared bat USFWS has developed a programmatic biological conclusion(PBC) in conjunction with the Federal Highway Administration(FHWA), the USACE, and NCDOT for the northern long-eared bat(NLEB) in eastern North Carolina. The PBO covers the entire NCDOT program in Divisions 1- 8, including all NCDOT projects and activities. The programmatic determination for NLEB for the NCDOT program is "May Affect, Likely to Adversely Affect". The PBO provides incidental take coverage for NLEB and will ensure compliance with Section 7 of the Endangered Species Act for R-5797 Individual Permit Application Page 6 of 8 five years for all NCDOT projects with a federal nexus in Divisions 1-8, which includes Columbus County, where TIP R-5797 is located. CULTURAL RESOURCES In order to comply with Section 106 of the National Historic Preservation Act (1966, as amended), FHWA and NCDOT must evaluate the project's impact upon any extant architectural and archaeological resources, and determine if additional measures will be necessary to mitigate any adverse effects of the project upon any significant properties and sites. Based on North Carolina Department of Cultural Resources' State Historic Preservation Office's (NC-HPO) statewide survey of historic buildings, districts, and landscapes, there are no historic property within the project study area. This project was reviewed by NCDOT under the terms of the 2007 Programmatic Agreement for minor transportation projects resulting in a No Archaeological Survey Required determination on December 19, 2017. FEMA COMPLIANCE There are no streams within the project limits requiring FEMA coordination. INDIRECT CUMULATIVE IMPACT ANALYSIS This project involves modification to an existing interchange and is not expected to result in induced growth or a change in land use that would not otherwise occur. The project will not notably alter traffic capacity or travel patterns, reduce travel time, affect access to properties in the area, or open areas for development or redevelopment. Overall, the project is not expected to have a long-term impact on water quality in the project area. Direct natural environment impacts by this project have been addressed by avoidance, minimization, or mitigation, consistent with review by the natural resource agencies during the permitting process. All other developments will be required to follow appropriate local, state, and federal guidelines and permitting regulations. WILD AND SCENIC RIVER SYSTEM The project will not impact any designated Wild and Scenic Rivers or any rivers included in the list of study rivers (Public Law 90-542, as amended) or North Carolina Natural and Scenic Rivers. ESSENTIAL FISH HABITAT The project will not impact any essential fish habitat afforded protection under the Magnuson- Stevens Act of 1996 (16 U.S.0 1801 etseq.).
