An Environmental Assessment (EA) for the project plan has been prepared and a Public Notice and Notice of Availability for the EA are enclosed for your information, use, and/or action. Chief, Environmental and Land Management Division Enclosure: Public Notice and Notice of Availability R[A@[i9%qr.,i3P JUL - 1 2010 DM-WATER QUALITY WETLANDS AND SMRMWATER BRANCH June 23, 2010 PUBLIC NOTICE AND NOTICE OF AVAILABILITY ENVIRONMENTAL ASSESSEMENT (EA) LIGHTNING PROTECTION SYSTEM MILITARY OCEAN TERMINAL SUNNYPOINT (MOTSU) BRUNSWICK COUNTY, NORTH CAROLINA, MAY 2009 TO WHOM IT MAY CONCERN: An environmental assessment has been prepared which discusses the environmental effects associated with the proposed Lightning Protection System (LPS) Project at the Military Ocean Terminal, Sunny Point (MOTSU). The project area includes the South Rail Holding Area (including Transfer Areas #2 and #3, Bridge Crane Area, South Rail Holding Yard and the South Secure Rail Area), Container Re-stuff Facility, Transfer Area #1, Sunny Point Road Rail Area, North Wharf Hardstand, South Wharf Hardstand, Suspect Container Area, Suspect Truck Pad, and the Ammunition Surveillance Facility (Figure 1 - MOTSU Location Map, Figure 2 - Aerial Photographs of Main Terminal and Project Locations). The LPS Project includes installation of LPS masts, trenching for underground wiring, test wells, other associated equipment and maintenance access roadways (South Rail Holding Yard only). The new installation portion of the project would occur within the South Rail Holding Yard along each of the 28 railroad spurs and in the Bridge Crane Rail Area along the parallel tracks and upgrade, replacement, repair and expansion activities would occur at the other locations throughout the project area. The project would occur entirely on government owned property. The EA was prepared in accordance with the National Environmental Policy Act (NEPA) of 1969 (Title 42 of the United States Code (USC) 4321-4347) guidelines; the Council on Environmental Quality (CEQ) regulations codified in Title 40 of the Code of Federal Regulations (CFR) Parts 1500-1508; and Army Regulation (AR) 200-2 Environmental Effects of Army Actions, March 2002. These criteria establish the process by which MOTSU considered the potential environmental effects of the proposed LPS project. The proposed project is consistent with MOTSU's mission and operational requirements set forth by the U.S. Department of Defense (DoD) and the U.S. Army's Military Surface Deployment and Distribution Command (SDDC). Project coordination with the Regulatory Division of the US Army Corps of Engineers, Wilmington District regarding Section 404 of the Clean Water Act, the North Carolina Division of Water Quality (NC DWQ) regarding 401 Water Quality Certification, and the North Carolina Division of Coastal Management for their concurrence that the project is consistent with the North Carolina Coastal Management Program is presently occurring. No work will commence until all approvals and permits have been issued. This Public Notice is being distributed to notify all known interested persons of the availability of the EA for review. The EA is currently being circulated to known interested parties, including federal and state resource agencies, for review and comment. The EA may be reviewed at the US Army Corps of Engineer's Wilmington District Office or a CD may be requested from the same. It is requested that written comments on the EA be mailed to arrive no later than 30 days from the date of this Notice.
