DWQ Project No. 07-0621 Forsyth County On July 9, 2007, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to place permanent fill in 120 linear feet of perennial stream and to place temporary fill in 20 linear feet of perennial stream in order to construct Chamberlain Place Apartments in Forsyth County. In order to meet Condition 2 of the 401 Certification for this project, a Stormwater Management Plan (SMP) was received by the DWQ on June 28, 2007. Additional information on the SMP was received by the DWQ on July 17, 2007. The SMP was approved by the DWQ on August 27, 2007. The DWQ is in receipt of the Certificate of Completion Form, signed by you on December 18, 2008 and signed by Mr. Michael Westcott, P.E. on December 15, 2008. The structural stormwater practices as approved by DWQ and certified by yourself and your consultant must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. Stormwater easements shall be recorded for a distance of at least 10 feet on each side of all stormwater conveyances on all lots containing these structures including future access for maintenance. The stormwater easements shall allow for the ability to maintain the structures, perform corrective actions as described above and shall provide protection of the structures from potential alternations by future property owners. Please note that per the latest version of the DWQ Best Management Practices Manual (published July 2, 2007), the DWQ will accept correctly designed grassed bioretention cells as well as bioretention cells vegetated with a combination of trees, shrubs and perennials as approved for this project. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
