Dear Mr. Harwood:
On June 3, 2010, the Division of Water Quality (DWQ) received your "Courtesy Copy" application dated June
2, 2010, with additional information received on June 16, 2010, to fill or otherwise impact 142 linear feet of
perennial stream, 13,388 square feet of Zone 1 Neuse River basin protected riparian buffers and 10,650 square
feet of Zone 2 Neuse River basin protected riparian buffers, to construct the proposed stream restoration project
at the site. The DWQ has determined that your application remains incomplete and/or provided inaccurate
information as discussed below.
Additional Information Requested:
1. Please note Eric Kulz's email response to you assumed you were permitting this project under a
Nationwide Permit No. 27, which is the Nationwide Permit typically utilized for stream restoration. If
you were utilizing a Nationwide Permit No. 27 then you would be exempt from the State's Buffer Rules,
however, since you are utilizing a Nationwide Permit No. 18, this project will require written concurrence
from the DWQ.
2. Additionally, you did not address the proposed storm water pond fill slopes as previously requested.
For these reasons your permit application is hereby considered returned. Once you have redesigned your
project to address the problems and inadequacies with your application as it was submitted, you will need to
reapply for DWQ approval. This includes submitting a complete application package with the appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity and
any work done within waters of the state would be a violation of North Carolina General Statutes and
