This letter addresses items in NCDWQ's June 17, 2010 letter regarding the proposed
improvements to US 17 in Beaufort County. A copy is attached for your convenience.
1. Buffer impact types have been relisted on the impact summary sheet and buffer drawings
7-8, 16-19, and 26-27 have been revised.
2. With the exception of the stream at site 2 which was eliminated due to being non-
jurisdictional, all streams aze perennial.
We are investigating the need for a revision to our NCEEP acceptance letter. If necessary, a
revised letter will be forwarded upon receipt. If you have any further questions, please contact

Dear Dr. Thorpe:
The NC Division of Water Quality has reviewed your submittal for a 401 Wa[er Quality Certification and
TarPamlico Buffer Authorization for the aforementioned project. Review of your application revealed it
lacking nccessary infonnation required for making an informed permi[ decision. The permit application
was deficient in the following areas:
Buffer impacts listed incorrecHy. The buffer impact summary sheet included with the
modification request lists the buffer impacts associated with the bridges at Sites lA and 4C as
mitigable. According [0 15A NCAC 2B .0259(6), buffer impacts due to the bridge structures
are allowable and do not require mitigation. The road approaches leading to the bridge are
considered road crossings and would trigger mitigation if buffer impacts exceed 150 linear
feet or one-third of an acre. Please modify your buffer impact calculations to reflect this.
Stream classification. Please identify thejurisdictional streams in the project area as
intermittent or perennial. This is necessary for mitigation purposes. Also, a recent field visit
to the project area by DOT and DWQ staff on June 15, 2010 revealed that the stream at Site 2
may not bejurisdictional. Please confirm this with the Army Corps of Engineers and adjust
stream impact calculations as needed.
Therefore, pursuant to 1 SA NCAC ZH .0507(a)(5), we will have to place the permit application on hold
until Nve are supplied the necessan' information. You have 21 days to respond in writing with the
requested information or notification to this office that the information is forthcomine. If, at the end of
the 21 days, this office has not received this information in writing, we will assume you are withdrawing
your application and it will be returned. Furthermore, until the information is received by the NC
Division of Water Quality, we request (by copy of this letter) that the US Arnry Corps of Engineers place
the permit application on hold.
