The City of Newton (City) was previously authorized to impact one stream and two wetlands during the construction of a greenway trail for public use. The authorized impacts include placement of a prefabricated bridge over the stream and approximately 0.195 acre of forested wetlands. Impacts associated with a second stream crossing were omitted from the original permit application due to a misunderstanding as to the work proposed to occur at that location. These impacts are described in the attached PCN Application. The City requests a modification of the previously authorized permit to include the second stream crossing. Please note that the parcel is owned by Catawba County, but the City holds an easement within the parcel for the purpose of developing and maintaining the greenway trail. Approximately 35% of the greenway trail will be constructed in an existing sewer corridor. The remainder of the project will be constructed in undeveloped wooded areas. Impacts to the UT to Hildebran Creek have been minimized to the extent feasible by designing a near-perpendicular crossing and by replacing the existing culvert with the new culverts immediately adjacent to the existing culvert and by minimizing the length of stream realignment to the extent practical while minimizing the potential for future degradation of the stream channel. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. All excavated materials will be removed from the site. Stockpiled materials will not be placed within jurisdictional wetlands, and sedimentation and erosion control devices will be placed on the downgradient side of the stockpiled materials. Normal flow conditions in the stream channel will be maintained throughout the construction period, and the stream will be maintained within the existing channel and existing culvert until the new culverts and channel are completed. 2. The stream channel on the property is known as Hildebran Creek which flows into the Catawba River and ultimately flows to the Atlantic Ocean through the Santee-Cooper River in South Carolina. D.
