Under the conditions of the Nationwide Permit, mitigation is required for your project. The mitigation proposal submitted with your application is insufficient. (see remarks.) ? Your application did not include a statement explaining how avoidance and minimization for losses of waters of the U.S. were achieved on the project site. (see remarks) ? Your submitted project plans or maps were insufficient, too large, or not legible (see remarks). ? You must submit a copy of your application to the NC Wildlife Resources Commission (WRC) since your proposed work is in a designated trout water county (see remarks section below for the address of your WRC representative) Other (see remarks below). REMARKS: C 1 In order for Mr. Dunnehoo to act as your agent, we will need a signed agent authorization form. 2. Nationwide Permit 29 is not available for the proposed project because it does not comply with Re ional Condition 4.5, which prohibits discharges into wetlands adjacent to High Qualit Waters g This project may be permitted under Nationwide Permit 18 instead y (Queens Creek). <h ://www,saw.usace.arm .mil/WetiandsMWP2007/PDF-SAW-NWP2007/NWP]8 6-07. df>. 3. The Total Wetland Impacts in Section C, 2g (0.03664 ac.) does not equal the total Area of Impact in Section C, 2f (0.083 ac.). Please correct this discrepancy. 4 Please bear in mind that an intermittent stream flows through the upper and lower wetland areas. As such ` the impacts proposed will impact a few linear feet of this stream in addition to wetlands stream impacts appear to be minor, please include them as itemized linear foot impacts in Sec ion Ct 3 of Page 1 oft-;1.?N _ 1 ?? the PCN. 5. It appears as though Wetland Impacts 2 and 3 will also raise the grade of the proposed culvert above that of the existing culvert. If raising the grade of this culvert is proposed, it will have the effect of raising the water level in the upper wetland area turning it into an open water pond. Please include information on the elevation of this existing culvert vs. the proposed culvert, and its effect on the water level in the upper wetland area. If this project does in fact raise the water level in the upper wetland area, please submit the acreage of wetland affected. 6. The proposed plans for Wetland Impact 3 appear to show a rip rap pad on the downstream end of the proposed culvert. If the grade of the proposed culvert is raised we would anticipate the need for a rip rap pad to dissipate erosive velocities from the culvert. However, the rip rap pad shown appears to fall within the footprint of the retaining wall. Is this correct? If the rip rap pad is proposed to be located outside of the retaining wall boundaries, please include this additional impact in the PCN and include a plan sheet. 7. The overall project sheet shows the proposed Iveybridge Court corridor in very close proximity to the existing wetland line. Please address our concern that silt fencing may not provide enough sedimentation and erosion control to prevent wetland impacts, given the steep grade at the site. Please submit the above information within 30 days of receipt of this Notification or we will consider your application withdrawn and close the file.
