SUBJECT: Oxendale GP 30 Application, Lake James, McDowell County
DWQ No. 2010-0482
Dear Mr. McMillan:
Mr. Roger Oxendale requested a water quality certification to apply 395 feet of rip rap to Lake James
shoreline in McDowell County. Comments from the Commission are provided under provisions of the
Federal Power Act, as amended (16 U.S.C. 79la-825r) and the Fish and Wildlife Coordination Act (48
Stat. 401, as amended; 16 U.S.C. 661 et seq.) to assist Duke Power with their Federal Energy Regulatory
Commission license responsibilities.
The Commission has no major concerns with this project provided the "environmental area", which is
designated adjacent to the project site according to Duke's Shoreline Plan, is not encroached upon. Also, we
encourage the applicant not to remove large woody debris extending from the shore into the lake because this
material provides important cover for fish and wildlife.
