Dear Mr. Mayo:
This letter responds to your request for modifications to the effluent monitoring requirements for
Henderson's Rest Home (Permit NC0071897). After consulting with the Asheville Regional Office and
reviewing effluent and stream monitoring data, the Division has decided tq grant part of your modification
request.
Henderson's Rest Home wastewater treatment facility has effluent limits of 5 mg/1 BOD5 and 2
mg/1 NH3-N in the summer due to the zero 7Q10 flow of the receiving stream. The wastewater treatment
facility performs very well and despite the low limits, has not had an effluent violation since July 1994.
This problem was related to effluent dissolved oxygen and was resolved.
In view of the above, the Division will allow you to modify the monitoring frequency to 2/month
for BOD5, TSS, NH3-N, and fecal coliform beginning in December 1995. However, as a precautionary
measure and to expedite a resolution of any problems, the Division requires that monitoring revert to
weekly for these parameters for the month following a month in which an effluent limit violation occurs
for these parameters. For example, if Henderson's Rest Home has an effluent limit violation in January,
weekly monitoring would be required for the month of February. If there were no violations in February,
2/month monitoring could resume in March.
Concerning the request to discontinue stream monitoring, the other two facilities in the immediate
area of Henderson's Rest Home discharge to different tributaries. Therefore, to maintain a database for
this portion of the stream, the Division will not allow stream monitoring to be completely discontinued, but
will allow Henderson's Rest Home to discontinue stream monitoring for the winter period (November 1 -
March 31).
Please find enclosed the modified sections of the permit referenced in the preceding paragraph.
Replace the original sections in your permit with the newer enclosed sections and discard the original
sections. All other terms and conditions contained in the original permit remain unchanged and in full
effect. These permit modifications are issued pursuant to the requirements of North Carolina General
Statutes 143-215.1 and the Memorandum of Agreement Between North Carolina and the U.S.
Environmental Protection Agency.

If any parts, measurement frequencies or sampling requirements contained in this permit
modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request
within thirty (30) days following receipt of this letter. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, an filed with the Office of
Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such
demand is made this decision shall be final and binding.
