DWQ Project # 10-0494
Durham County
On June 22, 2010, the Division of Water Quality (DWQ) received your application dated June 22, 2010, to fill
or otherwise impact 0.05 acres of Non-404, Jurisdictional and Isolated Wetland and 20 linear feet of perennial
stream (temporary impact), to develop the site. The DWQ has determined that your application was incomplete
and/or provided inaccurate information as discussed below. The DWQ will require additional information in
order to process your application to impact protected wetlands and/or streams on the subject property.
Therefore, unless we receive five copies of the additional information requested below, we will place this
project on hold as incomplete until we receive this additional information. If we do not receive the requested
information, your project will be formally returned as incomplete. Please provide the following information so
that we may continue to review your project.
Additional Information Requested:
1. Please provide verification from the USACE that they are permitting this project under a Nationwide
Permit 12, and not a Nationwide Permit 39.
2. Please indicate proposed lot layout as an overlay on the site plan and re-submit your site plans on full
plan sheets at a scale of no smaller than 1 "=50' with topographic contours shown.
3. Please provide building envelopes for all lots with wetlands, streams or buffers on the site plans.
4. Please locate all isolated or non-isolated wetlands, streams, and other waters of the State as overlays on
the site plan.
5. Please provide the overall percent imperviousness of the project, and an inventory of impervious for the
project. The inventory should include all proposed,building footprints, roads, driveways, sidewalks,
gravel-surfaced areas, amenity areas, etc.

6. Please note that the stormwater management information submitted with your application must be
approved by the City of Durham, and when approved, you are required to submit:
• A valid approval letter from the City of Durham and a copy of the approved SMP, including plan
details, operation and maintenance agreement(s), design calculations and any other supporting
information, OR
• A set of stormwater plan details, operation and maintenance agreement(s), and design calculations
stamped as "Approved" by the local government.
7. Please enumerate the Jordan Buffer impacts on both the impact map and the PCN form. Although
DWQ is not administering the Jordan Rules to private entities within the City of Durham, it is requested
that impacts to the buffers are enumerated on all projects requiring a 401 or Non-404 Jurisdictional
General Permit (IWP100000).
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you
will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized (at this
time) by the DWQ. Please call Mr. Ian McMillan or Ms. Amy Chapman at 919-733-1786 if you have any
