Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: We did aerial sewer crossing above high water mark, approbmately 30 linear feet. Impacts were limited to one temporary crossing by implementing an aerial crossing of the second tributary on -site. During construction, the stream channel shall be protected with appropriated erosion and sediment control devices to prevent impact to the jurisdictional feature. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: A perennial stream crossing with temporary disturbance with dewater pump around method used. Impacts are limited to temporary impacts of one on - site perennial stream channel. During construction, erosion and sediment control practices will be implemented to limit disturbance to downstream water ways, following construction channel bed and bank will be restored to a stable cross section and stream profile. 2. On August 12, 2020, Mr. Bryan Tompkins spoke with you about the proposed project via telephone. We have reviewed the information you presented and are providing the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e), and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). According to the information you presented, the City of Morganton is proposing to extend an existing gravity sewer line to provide service to a proposed multi-family development. The new 12-inch sewer line will be about 1,898-linear feet in length and will require a crossing of an un- named stream. The stream banks consists of a narrow vegetated riparian buffer area and tree removal will be necessary to complete the stream crossing. Endangered Species. Based on the information provided, the project site contains potential suitable summer roosting habitat for northern long-eared bat (Myotis septentrionalis) which is currently federally listed as a threatened species. The PCN indicates that all tree removal associated with the project will be conducted during the winter (October 15 – April 15) when northern long-eared bats are not using summer roost trees. Given the winter tree clearing, you have made a “may affect, not likely to adversely affect” determination for northern long-eared bat. We concur. Further, we do not believe the project will have no effect to other federally listed species known to occur in Burke County. Therefore, the requirements under section 7(c) of the Act are fulfilled. However, obligations under section 7 of the Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in Mr. Sclarandis - City of Morganton 2 a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action. Project Recommendations – We have no objections to this project. However, we recommend the following measures be included in any permit for the proposed project: • Stringent erosion-control measures should be installed where soil is disturbed and should be maintained until project completion. • Streamside vegetation should be left unaltered as much as possible. Riparian buffers should be re-established with plantings of the native species and efforts should be made to increase riparian buffer widths wherever practicable.
