Send all suspicious email as an attachment to report.spam@nc.gov Stephanie & Lyle: It took some effort, but they were able to find a solution to the stream downcutting issue described below in my October 23rd email. Please refer to the attached revised plans titled “Trailwood Apartments – IMPACT MAPS (revised 11-11-2020)”. Here is a list of changes from the permitted plans (attached). The originally proposed sewer crossing of Walnut Creek will been abandoned. Prior to realizing the stream downcutting issue, they had installed silt fencing and cleared the easement south of Walnut Creek. The easement north of Walnut Creek was not cleared. They are proposing to remove the silt fencing throughout and seed and mulch all disturbed areas. As Zone 1 was cleared within the easement south of Walnut Creek, they are proposing to replant this area with at least two (2) native hardwood tree species at a density of 320 trees per acre. To do this, they are proposing to install at least six (6) ball & burlap size swamp oak and river birch trees within Zone 1. These trees are consistent with other trees in the area. In addition to the Zone 1 replanting, the City is requiring them to revegetate the portion of the original sewer easement that will become tree conservation area (TCA) at the rate of 2-10 gallon trees per 50 foot linear increment. The new proposed sewer crossing of Walnut Creek is depicted on the attached revised plans. The sewer will still be jack & bored under Walnut Creek with no impacts to the creek (the same as what was permitted for the original crossing location). A minimum of 10.5” of cover will be maintained between the bottom of the creek and the sewer line. The City has revised the revised plans and has found them to be acceptable. The sewer crossing will be perpendicular with a 30’ easement (both construction and maintenance). The new manhole north of the creek will be located within the existing maintained, cleared sewer corridor as the existing manhole to which it will tie to. As these revised plans meet the following regulatory criteria, we’re hoping that you can concur that no additional permitting effort is needed (beyond this email notification) and that the project may proceed under the current permits and these revised plans. No impacts to Walnut Creek are proposed. No changes to the previously permitted 404/401 impacts. The buffers within the previously permitted sewer crossing location will be restored. The new sewer crossing and two minor Zone 2 parallel impacts are considered “deemed allowable” under the Neuse Buffer Rule (15A NCAC 02B .0714). Please confirm if our understand is correct that the project may proceed as previously permitted and these revised plans. The project is currently under construction. They have installed the silt fencing around the limits of disturbance and cleared the sanitary sewer corridor south of Walnut Creek. They have not yet installed the sewer line. During construction survey, they discovered that it appears Walnut Creek has down cut since the design survey used in the permit application. No impacts were proposed to Walnut Creek in the PCN application as they were to bore and jack under the creek, but the permit drawings showed a minimum of 12” of clearance between the sewer line casing and the stream bed as depicted on sheet “EX-03” attached to the NWP verification. The new survey indicates that they will not be able to maintain this clearance and the casing could actually be at or just above the streambed. They are actively looking at solutions to this issue, and I have been advising them of the potential permitting options for each solution, but it seems evident at this time that we’ll be at the very least submitting revised plans for your review and possible permit modifications. They are hoping to figure out the solution by early next week. I’ll be in touch as soon as the solution is determined. More to follow. Please don’t hesitate to contact me if you have any questions.
