Sullins Dee Freeman Governor Director Secretary June 28, 2010 Wake County DWQ Project No. 05-2199v2 Mr. Justin Patsey John Wieland Homes 107-A Quail Field Court Morrisville, NC 27560 Subject Property: Governor's Row formerly known as Holloman Tract Crabtree Creek [030402, 27-33-3.5, B NSW] 303(d) APPROVAL OF MODIFIED DIFFUSE FLOW PLAN Dear Mr. Patsey: On January 31, 2005, the NC Division of Water Quality (DWQ) issued a 401 Water Quality Certification and a Neuse Buffer Authorization Certificate to impact 149 linear feet of streams and 19,561 square feet of protected riparian buffer for the purpose of constructing the above named residential subdivision. Per Condition 4 of that approval, all constructed stormwater conveyances shall be directed and maintained as diffuse flow at non-erosive velocities through the protected stream buffers such that it will not reconcentrate before discharging into a stream. The January 31, 2005 approval of this project included an approval of the diffuse flow plan. On June 2, 2010, the DWQ received a modified diffuse flow plan submitted by Withers & Ravenel, Inc. The DWQ has reviewed the modifications to the diffuse flow plan and has determined that they comply with current state design requirements. The stormwater conveyance system, which includes one dry detention pond, three level spreaders, and the signed and notarized Operation and Maintenance Agreements dated December 6, 2005, as approved by this Office, and the drainage patterns depicted on the plan sheets, must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. All stormwater management conveyances, detention and treatment structures shall have maintenance access and at least 10-foot drainage easement on each side to allow for the ability to maintain the structures, to perform corrective actions and shall provide protection of the structures from potential alterations by future property owners. This letter completes the review of the DWQ under Section 401 of the Clean Water Act.
