We concur with the summer effluent limits of 30-13-5 (BODS-(NH3-N)-DO, mg/1). This model was based on a 4.0 MGD discharge of treated wastewater from the City of Statesville STP to Third Creek (7Q10 = 11 cfs). Everett, Ph.D. Director Per your recent request, I have enclosed a copy of the model used to derive the City of Statesville's limits for oxygen - consuming wastes for its Third Creek WWTP (NC0020591). The model was not run for the recent waste load allocation since no instream dissolved oxygen problems have been observed. Therefore, existing limits were assigned which were based on the Division of Environ- mental Management's (DEM) old Level B model which did not break the oxygen demand into carbonaceous and nitrogenous components. You stated that the ammonia limit may not be acceptable due to possible toxicity. The facility passed its three chronic toxicity tests performed in 1989. DEM also performed an intensive toxico- logical evaluation of the facility in June, 1989. The results exhibited no significant acute toxicity, but there was a -chronic response. The chemical analyses indicated that there were elevated concentrations of zinc, chromium, and cadmium. Statesville was assigned either an effluent limit or monitoring requirement for each of these parameters. Our new ammonia toxicity procedure requires,us to assign a new ammonia limit to a facility if it is not passing its toxicity tests and the effluent data show concen- trations of ammonia which could be contributing to toxicity. Sta- tesville's effluent data show an average concentration of 0.16 mg/1 and a daily maximum concentration of 2.46 mg/1 which is below lev- els which would cause toxicity. PoQu&m Pr+e vaWon Pays P.O. Marlar, Chief Facilities Performance Branch Water Management Division U.S. Environmental Protection Agency 345 Courtland Street, NE Atlanta, GA 30365 Subject: Statesville/Third Creek WWTP NPDES No. NCO020591 Iredell County Dear Mr. Marlar: I am writing in response to your letter of August 21 concern- ing the City of Statesville's draft NPDES permit (NC0020591). The City received its existing limits (30 mg/1 BOD5, 13 mg/1 NH3, 5 mg/1 DO) for oxygen -consuming wastes in the draft permit per Divi- sion procedure. According to the procedure, the facility receives its existing limits if no instream water quality problems have been observed while the plant was in compliance with its past permit limits. Self monitoring data collected approximately 0.6 mile downstream of the outfall indicate no water quality problems. The lowest dissolved oxygen (DO) concentration reported between March, 1988 and February, 1989 was 7.1 mg/l while the highest monthly average BOD5 concentration at the site was 2.28 mg/l. Since this site is not near a predicted DO sag point, the monitoring location was changed to 1.9 mile below the discharge, and a site was added at 3.5 mile below the discharge in the draft permit. In addition, North Carolina has been collecting ambient data approximately 14 miles downstream. There was one DO reading of 4.6 mg/l, but the average summer concentration was 7.4 mg/l. The Facilities Performance Branch at EPA developed a QUAL2E model to predict the impact of STatesville's discharge on DO con- centrations in Third Creek. The model indicated that Stateville's existing effluent limits would not protect North Carolina's DO standard (DO minimum = 4.34 mg/1). These existing effluent limits were developed using a DO modeling procedure approved by EPA which Pollution Prevention Pays P.O. Box 27687, Raleigh, North Carolina 27611-7687 Telephone 919-733-7015 An Equal Opportunity Affirmative Action Employer includes empirical equations developed from data gathered in North Carolina streams. Since EPA's model was not based on actual stream characteristics, it seems inappropriate to change the permit limits based on its predictions. The limits developed by EPA (30 mg/l BODS, 4 mg/l NH3-N, 5 mg/l DO) were also more stringent than those required to protect DO. The predicted DO minimum was 5.47 mg/l using the recommended limits. Apparently, the ammonia limit was developed to prevent instream ammonia toxicity rather than to protect for the DO stan- dard. As North Carolina has argued in the past, the Statesville whole effluent toxicity limit should protect for ammonia toxicity. In addition, the Division of Environmental Management is currently working on a procedure to address ammonia toxicity. If you have any questions concerning this situation, please contact Trevor Clements of my staff at (919)733-5083. Salisbury Street Raleigh, NC 27611 RE: Statesville Third Creek WWTP Draft Permit NPDES No. NCO020591 Iredell County Dear Mr. Clements: I am writing in response to Mr. Wilms letter sent August 3, 1989, regarding Cadmium, Lead and Cyanide limits on the draft permit No. NC0020591. Mr. Wilms suggested the City may want to request monitoring for metals daily. We appreciate the alternative offered, but unfortunately, our data suggest the WWTP will not be able to meet these limits. We believe the solution may be two -fold: reduction at the source as well as modification of plant operation. This will take more than the 6 months allowed by the draft permit and therefore, the City will be requesting a Special Order of Consent through the Mooresville Regional Office. Thank you for your assistance in this matter. Sincerely, /C2 L. F. Box 1111 Statesville, NC 28677 Subject: 'Statesville Third Creek WWTP Draft Permit NPDES No. NCO020591 Ir-edell County Dear Mr. Hudson: I am writing in response to Mr. Connet's letter sent June 6 regarding, the draft permit .for the Third Creek WWTP (NC0020591). You inquired about the following permit conditions: (1) Cadmium, Lead, and Cyanide Limits The metals limits are based upon a mass balance tech- nique which the Division of Environmental Management (DEM) routinely applies to municipalities with industrial contribu- tors (attached). The mass balance is based upon the 7Q10 flow for the stream which was revised since your last permit due to new flow estimates from the U.S. Geological Survey. The domestic and industrial loads were obtained from informa- tionisubmitted in the City's pretreatment headworks analysis. Based upon this information, the effluent concentration is predicted using the actual industrial and domestic loads. This value is compared to the maximum effluent concentration which will not cause instream violations of the State stan- dard for that metal. It is Division procedure to assign a limit if the predicted effluent concentration is within 1/10 of the allowable effluent concentration for the metal. P.O. Box 27687, Raleigh, North Carolina 27611-7687 Telephone 919-733-7015 An Equal Opportunity Affirmative Action Employer Your concern that the facility will not be able to meet its metals limits is well taken. However you should be aware that many municipalities are required to meet more stringent limits than those required in your NPDES permit. Your pre- treatment information indicates that one industry (Southern Fasteners) comprises the bulk of industrial sources of these metals. It is permitted for 67% of the cadmium (1.44 lb/d), 60% of the lead (1.25 lb/d), and 98% of the cyanide (.52 lb/d). Monitoring data indicate that the facility is per- mitted at levels which are too high. Much of the monitoring data for lead and cyanide are below detection level for the facility. The permitted limits were probably derived from a standard for metal finishers, and the City may wish to consider revising the facility's permit based on actual moni- toring data. The City may formally request to monitor for metals daily. A weekly average limit equivalent to your existing limits for protection to the chronic no effect level would apply for compliance purposes, along with -a daily maximum concentration that at a minimum protects to the acute no effect level instream. For the purposes of determining the weekly average, daily values shown to be less than detection will be considered equal to zero. Based upon these criteria, your revised metal limits would be as follows: Weekly Average Daily Maximum Parameter (ug/1) (ug/1) Cadmium 5.2 12.9 Lead 64.5 87.7 Cyanide 1.2.9 54.0 This method allows more flexibility in evaluating compliance while ensuring protection of the State's water quality stan- dards. If the City chooses this alternative, the monitoring frequency will remain fixed as daily for the duration of the permit. Your letter stated that your laboratory personnel report a cadmium detection level of 5 ug/l. To meet the proposed limit (5.2 ug/1), it is recommended that the monitoring of cadmium include the selection of an approved analytical method with the lowest possible detection and reporting lev- els. The DEM Analytical Chemistry Laboratory reports a detection level of <2 ug/l using a graphite furnace. The method is outlined in the 1979 Chemical Analysis for Water and Wastewater, reference 213.2. 40 CFR, 136.3, Table 1B lists other EPA approved methods for cadmium detection. The City may have an additional six months after issu- ance of the NPDES permit to comply with the new permit limit for cadmium. This condition will be included in your final NPDES permit renewal. (7) Request for State assistance Per your request, the State will assist the City of Statesville in evaluating plant operations and determining if modification will enable the facility to meet compliance. Jerry Whittum, the Wastewater Treatment Plant Consultant from the Winston-Salem Regional Office, has agreed to assist in evaluating the plant operations and their ability to comply with the modifications. However, we strongly recommend hir- ing a private consultant since Mr. Whittum will only be able to provide limited time to this effort. If the City of Statesville wishes to extend the proposed effective schedule for six months, you will need to request a Special Order by Consent (SOC) or a Judicial Order by Con- sent (JOC) through the Mooresville Regional Office as soon as possible. Please remember that meeting the new limit for cadmium will be extended to six months after permit issuance. Contact Rex Gleason at (704) 663-1699 for -further details. I hope that this letter adequately addresses your concerns. However, if the above decisions are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of the issued permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. Should you decide to switch to daily monitoring with both weekly average and daily max- imum effluent limitations, please contact this office within 10 days of receipt_ of this letter. Unless such a request is made, this decision is final and binding. If you have any further questions or matter please contact Mr. Trevor Clements from my staff at (919) 733-5083. ENGrNEERrNr- p DIVISION OF ENVIRONMENTAL MANAGEMENT July 21, 1989 MEMORANDUM TO: Arthur Mouberry FROM: D. Rex Gleason .,.p Q,..,., PREPARED BY: Richard Brid eman SUBJECT: Draft Permit Comments Statesville -Third Creek WWTP NPDES Permit No. NC 0020591 Iredell County, North Carolina The following is in response to June 6, 1989 correspondence from the Permittee in which objections to the subject draft Permit are raised: Objection - Proposed limits for Cadmium (5.2 ug/1), Lead (64.5 ug/1), and Cyanide (12.9 ug/1) are unacceptably low and cannot currently be met. Response - Proposed limits are correctly based on stream standards set for subject pollutants and on statistical stream to effluent dilution ratio. Compliance with proposed limits will also insure protection of current water quality stream standards. Although the previous NPDES Permit did not include limit& for the subject pollutants, any completed headworks analyses used to develop local limits and specific user discharge limits had to take into consideration water quality standards in determining allowable influent loadings. A review of the City's pretreatment file suggests that neither over -allocation nor consistent noncompliance with limits set for the subject pollutants has occurred. For 1988 (2nd half) only one (1) Third Creek user was in reportable noncompliance (RNC) for Cyanide; none were in RNC for Cadmium or Lead. Also, on January 27, 1989 DEM personnel collected 24-hour composite samples (CN/grab) under normal conditions; instream waste concentrations for Cd. Pb, and CN did not exceed stream standards. Arthur Mouberry Page Two July 21, 1989 Objection - Statesville -Fourth Creek WWTP Laboratory instrumentation has a Cadmium detection limit of 5.0 ug/l. Implication that obtainable precision and accuracy may result in incidents of false noncompliance. Response - City laboratory with capabilities or Instrumentation be achieved. either needs to send samples to a commercial instrumentation having needed detection upgrade their own instrumentation. having a Cadmium detection limit of 2.0 ug/l can Permittee Request = Assistance in evaluating plant operations to determine if modifications will enable facility to comply with proposed limits. Response - Division should not function as operations/ design/engineering consultants. Permittee Request - Delay in instating proposed limits for six (6) months. Response - A chronic bioassay test conducted by the Division of Environmental Management in January, 1989 indicated no acute toxicity (mortality), but there was a significant difference in the mean reproduction of the test population in the control and test chambers. A chronic bioassay test conducted by the Division of Environmental Management in May, 1989 indicated a highly toxic effluent with total mortality in the test population. Two (2) acute bioassay tests in June, 1989 indicated acceptable toxicity (LC 0 = 42.5%) and no acute toxicity, respectively. City wi151 need to identify and eliminate or reduce toxic effluent constituents. Again, the results of the January, 1989 Division of Environmental Management sample analyses do not give credence to the City's fears. However, self -monitoring data (April, 1989) indicates that the proposed limit for Cadmium would have been violated. Approval of request would benefit City by obscuring noncompliance. Compliance at end of six month period could not be assured. Division would not have input into program to achieve compliance with discharge limits. Recommendations - Instate limits as proposed, with a recommendation that City request a compliance schedule to allow for conditional compliance should significant noncompliance occur. Wastewater'Treatment Plant reveals limits on Cadmium (5.2 ug/1), Lead (64.5,ug/1) and Cyanide (12.9 ug/1). Please be advised that current records show the treatment facility cannot meet these new limits. We believe these limits are unacceptably low. This proposed permit will have enormous impact on industry in Statesville. A quick survey reveals that in some instances industry will have to phase out parts of their operation. Have the environmental benefits been weighed against the cost (and possible loss of jobs) that will be incurred by the City as well as industry? How were the limits on Cadmium, Lead and Cyanide arrived at? Laboratory personnel find that 5.0 ug/1 is the detectable limit for Cadmium. Has the degree for error been taken into account for the proposed Cadmium limit? Why was the 7Q10 flow for Third Creek lowered? In order to fully understand and address this situation we feel we need answers or information to these questions. Due to the impact of this proposed permit, the City of Statesville respectfully requests the following: 1. Assistance from the State in evaluating plant operations to determine if operation modifications will enable the facility to meet compliance, and 2.
