PROJECT SUMMARY: The applicants propose filling of 0.08 acres of Section 404 Wetlands and construction of a single- family residence on septic, a new and replacement bulkhead, a retaining wall, riprap, and a pier structure on their property located at the end of Whitehat Road (SR 1311), Perquimans County, and on a manmade canal and Perquimans River. PROJECT SETTING The applicants' property consists of two unnumbered lots, being 25,700 square feet (0.59 acres) and 61,420 square feet (1.41 acres) in size. The smaller lot is adjacent to Perquimans River and the majority of the larger lot is adjacent to a manmade canal to Perquimans River. Total size of the property including both lots is 87,120 square feet (2 acres), located at the end of Whitehat Road (SR 1311), New Hope Community, in Perquimans County and adjacent to a manmade canal and Perquimans River. The property has an elevation of approximately 2-feet above normal water level (NWL) in the wetlands and up to approximately 11.5-feet above NWL on the high ground. The upland portion of the property has Roanoke silt loam {Ro), while-the wetland-portion of the property-has Dogue fine-sandy loam-(DgB). Currently, there is a dilapidated single-family dwelling on septic not in working order with a grassy driveway on the property with 148 linear feet of riprap shoreline stabilization and remnant bulkhead pilings. There is a cleared area with native grasses growing around the dwelling, and the rest of the lot is wooded. Primary species found on the property include Loblolly Pine (Pinus taeda), Bald cypress (Taxodium distichum), Sweet gum (Liquidambar styraciflua), Red Maple (Ater rubrum), Wax Myrtle (Myrica cerifera), and Redbay (Persea borbonia). There were no coastal wetlands found on the property and no submerged aquatic vegetation found in the adjacent waters on March 6, 2007. However, the majority of the 1.41-acre lot and a portion of the 0.59-acre lot is Section 404 Wetlands approved by the U.S Army Corps of Engineers on August 14, 2006. Adjacent property to the north consists of asingle-family dwelling with a bulkhead and pier structure with a boathouse, native trees along the shoreline and along the property lines and native grasses entirely on high ground. The property to the east adjacent the manmade canal is a grass vegetated lawn lot that has been cleared of trees. The property across the canal to the south is a pine forest with a wetland fringe. The existing riprap alignment on the applicants' property may have accelerated erosion to the south of the riprap after the bulkhead failed during Hurricane Isabel in September of 2003. The bulkhead remnant pilings are located 22-feet waterward normal water level (NWL). South of the failed bulkhead area are Section 404 Wetlands with a natural shoreline. An approximate 5-foot tall erosion escarpment exists adjacent the area that use to have a bulkhead. .~ itichar'd and Phyllis Davis Field Investigation Report Page 3 The water depth close to shore ranges from -0.5 feet to -1.0 foot where the failed bulkhead was aligned and gradually deepens to -3.0 feet at waterward end of proposed pier structure. Native clamshell halves were observed along the shoreline. The waters of Perquimans River adjacent the applicants' property is not primary or secondary nursery areas, are closed to shellfish harvesting, and are classified as SB waters by the Division of Environmental Management. There are no known archeological sites or geologic formations associated with the applicants' property. Perquimans River is approximately 1 mile wide adjacent the applicants' property. DEVELOPMENT PROPOSAL In order to prevent further erosion, the applicants propose to construct 2401inear feet of wood bulkhead average 12-feet, maximum 22-feet waterward NWL with a 15-foot long wingwall along the property line to the north and another 15-foot wingwall along the Section 404 Wetland line to the south. The old remnant bulkhead replacement is 113 linear feet of the total 2401inear feet of total bulkhead being proposed. Clean, dry fill will be used for backfill from an upland pit. The tieback area will extend approximately 12-feet landward of the bulkhead sheathing, and the bulkhead will be constructed with silt cloth on the landward side prior to backfill. The applicants are requesting this bulkhead alignment to regain lost uplands and to meet septic setback requirements. The applicants propose to construct 2401inear feet of riprap aligned immediately waterward of proposed bulkhead with the toe of the riprap to extend 8-feet waterward of proposed bulkhead. The riprap adjacent the bulkhead will be located a maximum distance of 30-feet waterward NWL, 2.5-feet in height, and installed after the bulkhead is constructed. The applicants propose an additional 148 linear feet of riprap average 5-feet waterward NWL adjacent the existing wetland escarpment south of the proposed bulkhead to be placed no higher than 6-inches above the wetland substrate. The entire riprap alignment will total to 4141inear feet. The applicants propose to construct an SO-foot long by 6-foot wide pier to a 12-foot long by 20-foot wide "T" head platform. Two mooring pilings are proposed 20-feet waterward of proposed "T" head platform to form one boat slip. An additional 17-foot long by 6-foot wide portion of the pier walkway will extend landward of NWL, elevated 3-feet above wetlands. The proposed pier structure will be located 207-feet from the nearest riparian line to the north. The platform and slip area will be located in approximately -3-feet water depth. The riparian pier to the north extends approximately 105-feet into Perquimans River, and piers to the north along the same shoreline extend 150-feet into Perquimans River. The proposed pier structure will extend 107-feet into Perquimans River. The applicant proposes 610 linear feet of wood retaining wall to be installed prior to upland disturbance. After the retaining wall is installed, the applicants propose to fill a total of 3,450 square feet (.08 acres) of Section 404 Wetlands, creating a 2:1 slope from high ground to the retaining wall. The fill and disturbed areas will be graded, then immediately seeded with lawn grasses. The applicants propose to replace the existing single-family dwelling with a 70-foot long by 30-foot wide single-family dwelling with a 3,455 square foot, irregular shaped concrete driveway with a 30-foot long by 12-foot wide septic system replacement. Richard and Phyllis Davis Field Investigation Report Page 4 ANTICIPATED IMPACTS The proposed bulkhead alignment with backfill will result in the filling of approximately 1, 826 square feet of Public Trust Area (PTA), Estuarine Waters (EW) Area of Environmental Concern (AEC). Approximately 75 cubic yards of fill material will be placed below NWL for the backfill. An additional approximately 270 cubic yards of fill material will be placed in the escarpment area behind the bulkhead to match grade in the 30-foot buffer of the Estuarine Shoreline (ES) AEC. The proposed riprap will result in the total filling of approximately 2,790 square feet (113.6 cubic yards) of PTA, EW AEC. The proposed riprap waterward of the proposed bulkhead will result in the filling of 1,920 square feet (78.2 cubic yards) of PTA, EW AEC, and the proposed riprap waterward of the wetland escarpment will result in the filling of 870 square feet (35.4 cubic yards) of PTA, EW AEC. The proposed pier structure will shade 720 square feet of PTA, EW AEC. There are no expected navigational impacts due to the pier structure. There is one proposed boat slip formed by the construction of two mooring pilings located off the "T" head platform. The water depth in the proposed slip area is -3-feet. The entire structure, with slip area included, will take up 1,120 square feet of Public Trust Area. The waters of Perquimans River in the area the proposed pier will be located are classified as SB waters by the Division of Environmental Management and are closed to shellfish harvesting. The applicants propose to disturb a total of 610 square feet of Section 404 Wetlands and uplands in and outside the ES AEC for the installation of a wood retaining wall. The applicants propose to fill 2,630 square feet of Section 404 Wetlands in the ES AEC and 820 square feet of Section 404 Wetlands outside the ES AEC immediately landward of the proposed retaining wall with grading at a 2:1 slope from the high ground down to the retaining wall. A total of 3,450 square feet (0.08 acres) of Section 404 Wetlands are proposed for filling as site preparation for the single-family dwelling and driveway. A total of 530 cubic yards of fill are proposed in the wetlands landward of the retaining wall for grading to uplands. Proposed impervious surfaces on the property include 4,257 square feet of concrete driveway and single- family dwelling roofline within the ES AEC. The proposed single-family dwelling will be 2,100 square feet in size, while the concrete parking associated with the house will be 3,455 square feet in size. The entire house and parking area will be located outside the 30-foot buffer. The septic system will also be located outside the 30-foot buffer and will disturb approximately 360 square feet of ES AEC for installation. The fill areas behind the retaining wall will be immediately vegetated after grading. There is 5 % impervious surfaces proposed within the ES AEC, and the portion of the driveway within the 30-foot buffer will remain grassy. The percent impervious surfaces were calculated based upon the alignment of the proposed bulkhead. Temporary water turbidity will occur during construction. The use of a filter cloth behind the bulkhead will minimize future erosion and turbidity. Submitted by: Kimberly Hedrick Date: 03/29/2007 ~~~:~~® 6VC D~N~ PROJECT NARRATIVE Richard Davis - CAMA Major Permit Application Hertford, Perquimans County, North Carolina February 21, 2007 Page 1 of 3 ~E~ ~ ~ zoos ~®~gSTA~ t1r1~,N~iC~ Elizabeth Cityt~Ef~ PURPOSE: The purpose of the proposed activity is to reconstruct an existing 113 linear foot dilapidated bulkhead, which has been destroyed from prior hurricane and storm events, and construct 127 additional linear feet of bulkhead; a total of 240 linear feet of bulkhead, point to point. The proposed activity also includes the removal of a dilapidated inhabitable single-family dwelling to reconstruct asingle-family dwelling; a landscaping wall (610') around the proposed house and fill area; an 80' pier with a platform and two mooring pilings for one boat slip; rock rip rap waterward of proposed bulkhead (240') and waterward of the wetland shoreline (174'). Fill is also proposed in Section 404 wetlands to reconstruct a residential dwelling and meet septic setbacks. EXISTING CONDITIONS: Richard Davis currently owns the two subject parcels: 0.59 ac. and 1.41 ac. The 1.41 acre parcel primarily consists of a manmade canal and Section 404 wetlands (1.25 ac.). Existing structures on 0.59 ac parcel are dilapidated residential dwelling (1,105 s.f.), rip rap and remnant bulkhead. Remnant bulkhead on this parcel is 113 linear feet, which mostly comprises of pilings. There is existing rip rap along the shoreline of the 0.59 acre parcel (150' x 5'- 8'(width varies)), which will be capped with additional rip rap to a height of 2.5 feet and width of 8 feet. Total wetlands on 0.59 ac. parcel is 0.22 ac. Breaks in the 113' bulkhead left the shoreline vulnerable to storm erosion causing distinct escarpment averaging four feet (4+') in depth. Predominant north and southwest winds make this area along the Perquimans River a high wave energy area; therefore, without continued shoreline stabilization the shoreline is vulnerable to continual erosion. Personal observation from the property owner observed eroded shoreline 22 feet in the past 3 years; majority of damage from ...-hurricane Isabell. _ __. __ __ __ __ Predominant north and southwest winds make this a high wave energy area, therefore, submerged aquatic vegetation (SAV's) does not normally exist in these high-energy areas. AEC staff confirmed during a site visit, no submerged aquatic vegetation (SAV's) within the project area or outside the project area. With the absence of SAV's, aquatic invertebrate and vertebrate species should not be impacted by the proposed activity. There are no coastal wetlands present within or adjacent to the project area. The project site has been delineated by AEC on August 2, 2006 and approved by the U.S. Army Corp of Engineers (Josh Pelletier) on August 18, 2006. Vegetation on project sites consists of bald cypress, loblolly pine, oaks, hickory, red bay and grasses. AEC took field measurements on 8-2-06 and 1-16-07. All field measurements taken during a normal tide. Water depths were taken in ten-foot increments from the NWL to the existing bulkhead alignment. Transects were taken 50 feet apart since the river bottom was consistent. Escarpment measurements were taken every 20 feet at each transect. PROPOSED CONSTRUCTION: • Single-family residential home (2,100 s.f.) • 240 linear feet of bulkhead with associated backfill • Two (15') return walls -Total 30 linear feet. • Six foot wide pier 80 feet in length • 240 square foot platform on the end of pier • Two mooring pilings for one boat slip at end of pier/platform • Rip rap a total of 414 linear feet • Landscaping wall 610' • Fill in Section 404 wetlands (3,450 s.f.) (Davis -page 2) Linear footage of bulkhead to be replaced is 113 linear feet. Additional bulkhead to be constructed is 127 linear feet (Total constructed bulkhead 240 linear feet). Two 15 foot return walls (one at each end) are proposed to be constructed as well (30 linear feet). Rock Rip rap (240 linear feet, 8' base, 2.5' in height) is proposed waterward of the bulkhead once the bulkhead is reconstructed. Rip rap is also proposed waterward of the wetland shoreline (174 linear feet, 8' base, 1.6' in height (1.1' below NWL 6" above NWL)), to break wave action to minimize erosion of existing wetlands. Construction of a six foot wide pier (80' in length), 12'x 20' platform (240 s.f.) and one boat slip with two mooring pilings. Once the reconstructed bulkhead is in place, rip rap placed in front of the bulkhead will armor the bulkhead and minimize future destruction due to the high-energy impact zone. Rip rap is proposed in front of the bulkhead, since historical bulkheads armored with rip rap have proven to be left intact after major storm events, when portions of bulkhead without rip rap have failed (refer to previous CAMA Major Permit "Albemarle Estates" in Currituck County). Fill proposed below the NWL for Bulkhead alignment: Maximum distance from NWL to remnant/proposed bulkhead is 22 feet; minimum distance from NWL to remnant/proposed bulkhead is two feet (2'). Open water fill from NWL to bulkhead =1,826 s.f. x 1.1 (ave. depth) = 27 = 75 c. yds Rip rap proposed below the NWL: Maximum height of rip rap adjacent to wetlands will be 6" from wetland substrate. Methods of Construction: Residential dwelling to be constructed (2,100 s.f.) using hand tools and concrete truck. Bulkhead, pier and mooring pilings to be constructed using hand tools, hydraulic pumps and barge. Bulkhead backfill will be trucked in from a commercial source to consist of sandy upland soils; bulldozed and graded towards the constructed bulkhead placed with filter cloth. Rock rip rap waterward of bulkhead will be trucked in after backfill and bulkhead are in place, and placed directly in front of the bulkhead using an excavator (240 linear feet). Rip rap waterward of wetlands will be barged in and hand placed at a height no greater than 6 inches above the wetland substrate. A landscaping wall will be constructed (610') around the disturbed area and wetland fill area to prepare the site for residential construction. Landscaping wall will be constructed using hand tools and hydraulic pump. (Davis -page 3) Total disturbed area within the 30' Buffer= 8,164 s.f. (backfill & wetland fill 416 s.f.) Wetland fill is necessary for septic setbacks and residential construction, including parking area next to house. Wetland fill was limited to 0.08 ac. to stay within the Nationwide Permit. Highground is limited within the 2 acres since the majority of the 2 acre tract is wetlands and manmade canal, therefore the location of house with parking and septic is limited due to the 30 foot buffer and limited amount of highground. Mitigation: Compensatory mitigation is proposed to offset wetland impacts. Compensatory mitigation proposed by the property owner is the purchase of wetland credits (1/4 acre) from NCEEP once permits are in place. stormwater: Once the landscaping wall and fill is in place, site will be prepared for residential construction grading the highground area on a 2:1 slope towards the landscaping wall. Graded area will be seeded with grass seed after grading is complete. Gutters along the roof of the residential home will route stormwater to several areas in the grassed area to prevent stormwater in a concentrated area. Total disturbed area for the proposed activity = 19,861 s.f. Due to a manmade canal, narrowed access due to erosion, extensive wetlands and the 30 foot buffer this two acre tract (2 parcels) is limited to construction and access. The proposed activity will allow the property owner to reconstruct the dilapidated residential structure, which is not habitable, on his property, reconstruct the dilapidated bulkhead with additional bulkhead and further armoring the shoreline with rock rip rap to prevent further erosion to his property, which would prevent future access to the highground portion of his property. Due to the aforementioned limitations of the property, wetland fill is necessary to accomplish the scope of the project. Mitigation is proposed to offset the impacts to wetlands.
