This permit, issued on June 9 2010 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may he snhiect to fines. imorisonment or civil action; or may cause the permit to be null and void. Excavation 1) Unless specifically altered herein, the proposed development shall be carried out in accordance with the attached permit application and descriptive narrative. Any changes in the project plans may require a modification of this permit. The permittee shall contact a representative of the Division of Coastal Management at (252) 808-2808 prior to the commencement of any such activity for this determination. 2) No area outside the 100'x100' search grid shall be excavated without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on Signed by the authority of the Secretary of DENR and the Chairman of the Coastal Resources Commission. Permit # 63-10 Page 2 of 3 ADDITIONAL CONDITIONS 3) The amour_t of `excavation is limited to only that which is absolutely necessary to investigate anomalies or uncover any portions of a shipwreck or shipwreck artifacts that are discovered. NOTE: The permittee's contractor is advised to contact the U.S. Coast Guard at (910) 815-4895, ext. 108 to discuss operations and appropriate lighting, markers, etc. for all equipment. 4) The datum anchor shall be removed when each area has been eliminated as a candidate for the recovery. 5) Prior to construction the permittee shall provide confirmation to the Corps of Engineers that the northwestern corner of the 100-foot by 100-foot excavation area is located at Latitude 34.41.00, Longitude 76.42.00. 6) Within 30 days of completion of excavation and salvage activities at the 12 excavation sites, the applicant shall conduct bathymetric or diver surveys to ensure that each pit has restored to its original elevation. Three copies of these surveys shall be provided to the Corps of Engineers, Regulatory Branch, Mr. Dave Timpy within 45 days of completion of all excavation and salvage activities. General 7) The permittee shall adhere to all archaeological standards and conditions as stipulated in the Department of Cultural Resources' (DCR) permit 09BU1584. All work shall cease if DCR permit 09BU1584 expires or is terminated. Any violation of the permit approved by the DCR shall be considered a violation of this CAMA permit. 8) The permittee understands and agrees that, if future operations by the United States requires the alteration of work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage that may be caused from existing or future operations undertaken by the United States in the public interest. 10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity shall not interfere with the public's right to free navigation on all navigable waters of the United States. 11) This permit does not grant any property rights or exclusive privileges. ? x Intersal Inc Permit # 63-I0 . Page 3 of 3 A ,L ADDITIONAL CONDITIONS NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3642 (DWQ Project No. 03 0994 V2), which was issued on 3/29/10. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No. 201000295.
