Dear Mr. Cordello:
On September 23, 2009, the Division of Water Quality (DWQ) received your revised Bank Parcel
Development Plan (BPDP), for the Carl Lloyd Parcel in Orange County, North Carolina. The DWQ
approved the site for addition into the Mid-Atlantic Mitigation Cape Fear Riparian Buffer and Nutrient
Offset Umbrella Mitigation Bank. On June 9, 2010 we received additional documents from you related
to the above referenced parcel including: As Built Report and Conservation Easement dated May 14,
2010. The BPDP proposed to restore 11.0 acres; however, the As Built Report enumerates 10.84 acres
which (24,639.32 lb-N at 2,273 lb-N/acre) for nutrient offset credit.
The Bank Parcel Development Package and Umbrella Mitigation Banking Instrument were approved
through execution of the UMBI by the Director on October 2, 2009.
. According to the UMBI, the following Project Milestones have been met, and the corresponding credits
shall be released:
Milestones Credit
1) BPDP approval by DWQ, Conservation Easement recorded
and financial assurances provided 20%
2) Site Work Complete and Monitoring Plots Established 20%
By copy of this correspondence, DWQ confirms that you have satisfied the above requirements for the
above-referenced tract and 40% of your nutrient offset credits (0.4 x 24,639.32 = 9,855.73 lb-N) are
now available for sale. Once the signed and notarized monitoring bond for the Carl Lloyd Bank Parcel
is received, an additional 10% of your nutrient offset (N) credits will be released for sale.
