How can I help you find the clarity of this project? You stated yesterday that you wanted to close this application or
move it along. I am doing my best to move it along as fast as possible so what other information do you require? My
time, like yours, is very limited so moving forward is incredibly important. Where do we stand right now moving
forward?
My number one concern is minimal impact. A $100K+ wall on a .5 acre lot is the farthest thing from ideal but will have
the most minimal impact and comply with the regulations of all parties. The impact comes down to primary 9 trees that
are either leaning or will fall in the water in the next year or two. If you think this might be a matter of option, open
Mecklenburg GIS map and look at the property over the last several years. You can see a tree fall every year or every
other year. When it comes to impact, this is terrible to all aspects of the environment if that is your concern. Two of
these trees will for sure fall in the next year since over half their roots are exposed and barely holding on. These will pull
the dirt and sediment with them in the water. Removal of these trees are deemed allowable in accordance with state
regulation 15A NCAC 02B .0614 as well.
It comes down to if I do nothing at all, which legally is allowed, and just build my house, the same 9 trees will fall taking
the dirt/sediment with them. Additionally, there will never be any established erosion control along the bank so rain and
water current will continue to erode and pollute the lake. If minimal impact is your concern this is the worst scenario
possible and is not what I am desiring. This property is worsening by the day and currently encroaching on damaging
neighboring properties' shoreline stabilization.
Cindy is generously working hard to help with the project but in the meantime what information do you need to move
forward. I would rather do as much as possible via computer since we have all been on the property already (Cindy and
Leslie last week). With my work, there is no way to guarantee my availability that far out but will do my best. Have a

and seek clarity for the project as it relates to minimizing impacts to the buffer. It would be
helpful to meet at the site with Cindy and have the various drawing/plans (both the proposed
and suggested by DWR). As stated earlier this is not a typical project that comes through the
door. Until I am comfortable with the project, have clarity on the potential impacts, only then

Good afternoon Alan,
The plans appear similar to the original because they are due to the property constraints. My original goal was to slope
the property since financially it is best but out of the 14 contractors and two engineers that looked at the property not
a single one is able to build a slope across the entire property and be remotely in compliance with the regulations.
These are highly skilled and educated people that do this day in and day out. To mitigate the massive vertical drop a
wall is the only way. In lower areas, a 2:1 slope is fine but not in front of the house and where the massive drop is.
Please see my attached drawing and keep in mind that some parts of the top of the bank are dug out from below:
- If I go from the current bank, I would be backing filling the lake a ton and making a land bridge. Duke
power's lawyers would destroy me overnight.
- If I cut the slope into the property not only would I destroy all vegetation, at the top of the slope I would
be well past the area where anything could be built.
- The 2:1 slope need to be adhered to due to Dukes, Meck, and State requirements. Without it continuous
erosions would be happening.
- Additionally, if somehow the slope was able to be pushed back, a house would not be able to be built due
to nothing holding back the load. The house would be on the edge of the slope and be cracking in a matter of
years. Structurally it would destroy my house over time.
Your diagram does not work on my property due to your slope. The bank only going 10' horizontally is impossible to
make a 2:1 slope (2- feet horizontal to 1 foot vertically). Your diagram is 1/2 :1 which would be so vertical that it
would be near impossible to get anything to stay on it. With a close to a 20' vertical drop a 2:1 ratio would be 40'
horizontally in some areas. That is not remotely possible without violating every rule under the sun. You have been
to the property and know as well that this can't be done without a ton of illegal backfill or destroying absolutely
everything in the buffer and more.
- I have provided the house footprint on the survey. The house is 58' long and 26' wide on the south side
and 38' wide on the north side. A floor plan is not needed to work the 30' state buffer and makes me
unconformable with the ability to see others' properties/personal information in Laserfiche. Please respect my
privacy in doing that.
- The last email included two preliminary wall designs that provide a very detailed minimal impact that the
wall will have. Please reference those attachments and let me know if you have any questions

- The tree that will have to be removed due to under rooting is marked with a single red slash on the survey.

Mitigation is included in the previous attached word document. Please reference that and let me know if
you have any questions.
Base off this reasoning and your site visit, do you agree that a slope cannot be done across the entire property and
still, be in compliance with the regulations as well as creating a structurally sound area for a house?
I have spent almost two years researching into these regulations and trying to find the best outcome for this
property.

You will need to work through the trees within the 50 ft buffer. You can't just clear cut to
gain access. First you must avoid and minimize the impact to the buffer. Given the
limitation, you need to work with your contractor to see what he can/can't do. Once you
get his comments, Then submit that design as your final plan for review. I can look at your
basic plan, prior to showing to a contractor. But whoever you hire, you don't want to get
approval and then the person says he can, but can't or you need to make changes.
Trees will have to be replaced that are removed from the buffer. The proposed bench isn't
allowed. You must first start with minimal impact to get the work done. This is a basic
info that I discussed with your father. We spoke about just placing riprap at the base, and
leaving the bank alone otherwise. Share this email with your parents and/or give me a call

I greatly appreciate all your help with this and being flexible to meet up for a site visit.
Unfortunately as of a couple of minutes ago a critical mission just surfaced and it is looking like I will be no
longer be in the country the 9th. The user changes his mind a lot so if something changes I will let you all

much more important than mine given the proposed impacts to the buffer. From Duke's standpoint, we
simply need to visually confirm the eroded bank height, which can be done anytime, but preferably after
you have obtained DWR and Meck Co. approvals for your plan. As discussed, Duke's authority to
approve work on the shoreline stops at 1 ft. above the full pond elevation of 569.4 (aka 101), so any work
proposed above that level falls outside Duke's purview. Please let me know if I can provide any additional

Unfortunately with my military service I have no control over my schedule a month out. I generally have a
better estimate a week to two weeks out. I am getting back from the Middle East hopefully late tonight
then heading back out to the desert very shortly after Labor Day. I would expect to be back to the
Carolina's around the 14-18th of Sep. Unfortunately it can be incredibly hard to predict but would like to
schedule the meeting as soon as possible to get the construction moving before the continuous rain comes
in winter and have it complete by the appropriate months. I will call you all tomorrow to see if we can find
a date and time that works for all.

It would be good to meet on site. This is a wooded lot, so any major tree clearing will
require trees to be planted. What is proposed is unconventional and an atypical for project,
if for no other reason is the height of the bank.
Also you need to meet up with Duke Lake Management and see how they will treat the
full pond elevation, given that the lot has washed away which may affect the buffer/full
pond elevations shown on the survey.

Just following up with you now that the fee has been paid and the application is complete for a couple of
weeks now. What other information do you need or how can I help. I just got back from a two -week
deployment to Iraq and have a week before I have to return so I will do my best to get you any
