PUBLIC NOTICE is hereby given
that Duke Energy Carolinas, LLC
North Carolina, has applied to
the North Carolina Division of
Water Quality for a Water Quality
Certification pursuant to Section
401 of the Federal Clean Water
Act and Water Quality Commis-
sion rules in 15A NCAC 2H 1300.
The activity for this certification
is sought to relicense the West
Fork Hydroelectric plant on the
Little Tennessee River in Macon
County. The application refers to
water quality-related provisions
of the Tuckaseegee Settlement
application discusses water
quality-related improvements
that are planned to the hydro-
electric facilities including mini-
mum flow release, water quality
monitoring and compensatory
flow mitigation. A draft 401 Cer-
tification is also available for
review.
The public is invited to comment
on the above-mentioned applica-
tion or Certification to the Divi-
sion of Water Quality. Comment
shall be in writing and shall be
received by the Division no later
than May 28, 2010. Comments
