The project site is on two Transylvania County parcels (8593-74-0366-000 & 8593-64-2665-000) located along Steel Creek Road in Dunns Rock, North Carolina. The applicant is pursuing an after -the -fact Nationwide Permit 29 to authorize 40 linear feet of permanent stream impact (culvert) associated with access to the residential property. The applicant is also seeking a Nationwide Permit 27 to authorize two permanent stream impacts for stream restoration activities associated with the removal of two 40-foot culverts. Installation of the culverts were not previously authorized by NC Division of Water Resources (DWR) or the US Army Corps of Engineers (USACE). Completion of the work proposed in this application will resolve the remainders of the violations. The completion of the project will involve a single access road to a private residential property, which will not result in additional development that could impact downstream water quality. Page 10 of 10 PCN Form Additional Information Section A.3b The Transylvania County GIS parcel boundaries have a slight discrepancy with the survey plat for the actual parcel boundaries in the vicinity of the upstream 40-foot culvert proposed for removal. The included survey plat of the parcel now currently owner by William Scherer, shows ownership of the turnaround and the majority of the private Black Beaver Road. A 45-foot right-of-way is shown for the road, which covers the 40-foot culvert proposed for removal. Section B.3d The purpose of the project is to provide property access to the subject parcels and remove unnecessary alternative access routes. Section B.3e Two culverts have been installed on an unnamed tributary to Steel Creek: • The upstream 40-foot long culvert is proposed for removal (Stream Impact 3). The stream substrate is primarily bedrock on both ends of this culvert. Upon removal of the culvert, the stream channel will match the surrounding contours and return to the original bedrock channel. The existing longitudinal profile for this reach can be found in Appendix A. • The downstream 80-foot long culvert is proposed to be shortened to 40 feet. The uppermost 40- foot section of culvert to remain (Stream Impact 1) would be the minimum width necessary for the access road stream crossing. The lower 40-foot section of the culvert is proposed for removal (Stream Impact 3). If the 40-foot section of culvert to remain is perched at the downstream end, a step-pool structure (per previously approved McGill Stream restoration Plan) will be utilized to allow for aquatic passage. The stream banks will be stabilized per the formerly approved McGill Stream Restoration Plan (May 26, 2017) (Appendix A). Typical earth-moving equipment will be used (i.e. backhoe, etc.) in uplands. Section D.1a There are currently two existing culverts that are utilized for property access. The proposed project would remove one of the culverts and shorten the second one to 40 feet. The design avoids having two access routes (both with stream crossings) and presents the minimum culvert width necessary for the singular access road stream crossing. The proposed design would restore 80 feet of stream channel, leaving only one 40-foot culvert. Section D.1b The culverts would be removed or shortened when the stream channel is dry; by utilizing a pump around system. The stream banks would be stabilized and planted with an appropriate native seed mix and live stakes. All construction equipment would be operated from high ground. Special attention will used with erosion and sediment control measures and best management practices to avoid unintended water quality impacts to downstream waters. Section F.5d CEC consulted the FWS's "Northern Long-Eared Bat Consultation Areas" map for Transylvania County. Transylvania County is not listed as having known occurrences of hibernation or maternity sites. It is the opinion of CEC that the project would have “no effect" on the northern long-eared bat. A review of the NC Natural Heritage Program database on July 10, 2020 indicates no documented occurrences of federally protected species occurring within the project boundary. See Appendix B. Section F.7b. There are three nearest potential historic sites are between 0.9-1.0 miles from the project site. The T(S/A) designation bans the collection and interstate and international commercial trade of bog turtles from the southern population. The T(S/A) designation has no effect on land management activities by private landowners in North Carolina, part of the southern population of the species.
