Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements, of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). The terms included in this final permit are considerably different from those found in draft permit sent to you on May 6, 2009. Since that time, this office has reevaluated its guidance for the permitting of wastewater discharges from conventional water treatment plants. The results of that reevaluation are included in the permit. While some parameters have been removed from the list of those to be monitored and others have been added, the overall effect of these changes is believed to impose less of a regulatory burden to the permittee. We would. like to thank the ORC of the Sparks Road WTP, Mr. Michael Weir for his assistance and persistence during the permitting process. The changes between this final permit and the original draft were described in an October 15, 2009 e- mail from Bob Sledge of our staff to Mr. Weir. Changes in this final version include: • The flow limit has been removed, but the requirement for continuous flow monitoring has been retained. However, the requirement for continuous flow monitoring of the effluent will not become effective until March 1, 2011. This should allow the County time for planning, budgeting and installation of an adequate flow measurement device. • • Monitoring for Calcium and Magnesium have been eliminated from the permit. • Monitoring for Turbidity has been reestablished as a term of the permit, but monitoring of the effluent (as opposed to instream monitoring) is now to be performed. 1617 Mail Service Center, Raleigh, North Carolina 27699-1617 One Location: 512 N. There is no explicit provision within this permit to have monitoring for particular parameters reduced or removed during the life of the permit based upon submittal of data from the discharge. Such modification may be requested, but would be deemed a major modification of the permit and subject to (currently) a $260.00 modification fee. Otherwise, monitoring frequencies shall remain the same through the full term of the permit. At the time of the next permit renewal, monitoring parameters, frequencies and limits could be changed (added, reduced or eliminated) based upon results of sampling during this permit cycle. • Mr. Weir has questioned the reintroduction of monitoring and a limit for pH in the permit. This action has been taken based upon the recommendations of a stakeholder group whose charge was to evaluate the potential for effects to water quality based on the characteristics of WTP discharges. The group cited the introduction of caustic chemicals as its rationale for adding this parameter. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. The requirement for continuous flow monitoring will become effective on March 1, 2011. Until that date, flow monitoring shall be conducted on a weekly basis, using instantaneous sampling methods. 2. The Division shall consider all effluent TRC values reported below 50 µg/L to be in compliance with the permit. However, the Permittee shall continue to record and submit all values reported by a North Carolina certified laboratory (including field certified), even if these values fall below 50 µme• 3. The pH shall not be less than 6.0 standard units, nor greater than 9.0 standard units. 4. Monitoring should be performed in conjunction with toxicity testing. 5. See Condition A. (2.) for toxicity testing requirements. Toxicity sampling should coincide with sampling for parameters covered by footnote 4. All samples collected should be of a representative discharge. CHRONIC TOXICITY MONITORING (QUARTERLY) The permittee shall conduct guarterl chronic toxicity tests using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions. The effluent concentration defined as treatment two in the procedure document is 90 %. The testing shall be performed as a Ceriodaphnia dubia May pass/fail test. The tests will be performed during the months of February, May, August and November. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Additionally, DWQ Form AT-1(original) is to be sent to the following address: Attention: NC DENR / DWQ / Environmental Sciences Section 1621 Mail Service Center Raleigh, N.C. 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re- opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently then required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. There has been a good deal of reevaluation of our current permitting strategy for WTPs over the past few months. Those who have conducted the review will soon issue a modified strategy to our staff for development of new permits. Because of the incomplete status of some of the permit renewals I'm handling, I've been authorized to offer the terms of the modified strategy to those permittees. While there may be parts of this strategy that some people will remain dissatisfied with, I believe that overall, it is an improvement from what we were using in the past. Please be advised that for the combined sake of consistency and management of the workload in this office, I can offer you essentially the terms you saw in the draft permit, or those noted within this draft version of a modified permitting strategy for conventional water treatment plant discharges. Changes within the new strategy include: The new strategy contains no flow limit. However, flow -based monitoring requirements and limits will be determined through reexamination of flow data already provided. Monitoring for most constituent parameters will be quarterly. WTP Dee Freeman Secretary First of all, I want to apologize for the late response on these NPDES draft. perm its. Even though we have discussed my concerns via phone conversation, I should have provided you a written response before now. Tom Belnick and I also discussed my concerns via a phone conversation on June 19, 2009. As you know, my primary concerns are the proposed monitoring changes for these Water Treatment Plant (WTP) discharges. If there are true environmental concerns associated with these longstanding discharges, then certainly the concerns should be addressed. However, especially in view of current economic difficulties for most local governments, added monitoring requirements, without sound justification, seems inappropriate. Many of the added constituents proposed for monitoring should not be a significant presence in the WTP discharges. 'These appear to include: calcium, magnesium, fluoride, copper, zinc, and ammonia nitrogen. Corrosion inhibitors, fluoridation, and chloramination are all introduced after filtration at a WTP. Therefore, it is very unlikely that associated contaminants would ever be in backwash water, or settled water sludge. Additionally, I would like to see Whole Effluent Toxicity monitoring quickly removed from the monitoring requirements, if no problems are observed. It seems strange to me that monitoring requirements for Settleable Solids and Turbidity have been removed from these permits. These should be the main constituents in conventional WTP discharges, and permittees need to be aware to keep these contaminants to a minimum in their discharges. WTP - NC0084212 Bob - Below are my comments on the above draft permit for the Sparks Road WTP• Q! 1) The monthly average flow limit of 0.023 MGD is too low. Is this a decimal err r7 The cover letter states that the limit is based on the highest monthly average flow reported over the last three years. I pulled just the 2008 monitoring reports from our files and the highest month was 0.177 MGD in October 2008. 1 would suggest that the limit be set higher than any value they have reported to date. With anticipated growth in the county the WTP output will surely increase causing higher backwash flows than previously reported. Perhaps the NPDES flow limit could be based on maximum backwash flow at maximum WTP output so we don't create a noncompliance issue. 2) Suggest a grace period of 18 months instead of 12 months to have flow meter installed. Spoke with Mike Weir, ORC, on Friday and he indicated that they are working to find funds for an open channel flow meter with sonar attached to their SCADA system. 3) Recommend that footnote (4) also apply to Whole Effluent Toxicity testing. Weaver, Jr.: This letter is a request for renewal of our NPDES permit NC0084212 issued to Sparks Road WTP, Davie County, which expires on May 31, 2009. This NPDES permit covers the discharge of two 785,000 gallon lagoons located at the Sparks Rd. WTP which handle clarifier and filter backwash. Since our permit was issued in 2004 this facility has had one change to its design. In fall of 2005 a Fast -Track Application for Dechlorination Facilities Authorization to Construct was acquired and a new dechlorination unit was installed. The unit is a NORWECO Bio-Dynamic Series 4000 Dechlorination Tablet Feeder that uses NORWECO Bio-Neutralizer Dechlorination Tablets. These tablets utilize Sodium Sulfite to effectively reduce the chlorine residual in our supernatant discharge. Effective February 1, 2006 a Total Residual Chlorine limit was attached to our parameters for our Self -Monitoring Testing. In the spring of 2005 the sludge in our lagoons was dredged and land applied on neighboring farm fields. This was the first time since beginning of operation that the sludge was removed from the lagoons. The lagoons lasted as designed for 10 years and estimated year of next sludge removal will be around 2015 unless it becomes necessary for removal sooner. Since 2004 this facility has had complete satisfactory Compliance Evaluation Inspections and no violations towards all aspects of our current NPDES permit. WTP Physical Chemical ORC Da aunty Public Utilities Davie County Public Utilities Sparks Road Water Treatment Plant Sludge Handling Plan The Sparks Road WTP has two parallel 785,000-gallon filter backwash lagoons. The lagoons provide long-term storage of sludge developed during clarifier flushing and filter backwash operations. As sludge is added to the lagoons the chemical solids are settled by gravity. The supernatant is discharged through the overflow -supernatant pipe to a man made ditch that flows to an unnamed tributary of the Yadkin River. Sludge depth is monitored in each lagoon and lagoons are designed to last up to 10 years at the expected plant sludge disposal rate before solids have to be removed. Once lagoons are classified as full, sludge in the lagoons is dredged and land applied on neighboring farm fields. Prior to dredging a land application permit is acquired and the sludge is analyzed to assure it is safe to apply. The sludge removal is contracted out to a specialized private company to assure that all state and federal laws would be followed though out the sludge removal process.
