Division personnel have reviewed and approved your application. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983, and as subsequently amended. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. Sullins' 9 30 92 memo Summary Components in use are described in a staff report (dated May 4, 1994) and a letter from the permittee's engineer (dated July 13, 1994). Subsequent discussion of the draft permit with Lee Spencer (DEH — WSRO) resulted in most components being removed from the list on the permit Supplement page. Lee pointed out that the other components are permitted by DEH, as they are part of the drinking -water treatment system, not the (filter backwash) wastewater system. No DMRs were present in Central Files. Info from the permittee indicates that no discharge has occurred from this facility — all supernatant is returned to the presettlement pond. The permittee wishes to retain the permit for possible future discharge. The Sparks Road facility was originally constructed with a presettling pond for raw water and twin gravity settling sludge lagoons for clarifier blowdown and filter backwash waters. Historically, clarifier blowdown and filter backwash waters have been treated in the twin sludge lagoons with supernatant being returned 'to the presettling pond and passed back through the treatment train. Due to the buildup of process chemicals and organics in the twin sludge settling lagoons and the increase in THM formation potential when the supernatant from the twin sludge settling lagoons is added to the presettling pond, Davie County wishes to discharge - supernatant from the lagoons to an unnamed tributary of the Yadkin River. It is our opinion that no additional treatment will be requiredr4or the supernatant from the lagoons to meet the discharge limitations specified in the draft permit that we received from your officeoon July 12th. On behalf of Davie County, we would like to regnst that a revised permit be issued for discharge of supernatant frolt the existing twin settling lagoons without further treatment.
