Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,1994 (or as subsequently amended). This final permit contains no significant changes from the draft you were sent on November 9, 2005. Please note that this facility will be subject to additional treatment requirements upon expansion above 5 MGD. The Catawba Basinwide Water Quality Plan recommends that all new and expanding discharges of oxygen consuming wastes to the lakes (including Lake Wylie) should be required to meet a minimum of advanced treatment limits of 15 mg/L BOD5 and 4 mg/L NH3. In addition, upon future expansion, this facility will be subject to the lake Wylie Nutrient Management Strategy, which requires monthly average limits of 1 mg/L total phosphorus and 6 mg/L total nitrogen (summer only). If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. There shall be no discharge of floating solids or foam visible in other than trace amounts. it Permit No. NC0021181 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A (2). CHRONIC TOXICITY PERMIT LIMIT (QRTRLY) - The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 8%. The permit holder shall perform at a minimum, uag rterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase 11 Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of February, May, August, and November. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase lI Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a'detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase H Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Permit No. NCO021181 A. (3) EFFLUENT POLLUTANT SCAN The permittee shall perform an annual Effluent Pollutant Scan for all parameters listed in the table below (in accordance with 40 CFR Part 136). The annual effluent pollutant scan samples shall represent seasonal (summer, winter, fall, spring) variations over the 5-year permit cycle. Unless otherwise indicated, metals shall be analyzed as "total recoverable." Additionally, the method detection level and the minimum level shall be the most sensitive as provided by the appropriate analytical procedure. The submerged outfall structure is located 345 feet from the shoreline, approximately 12 feet below the water surface. The discharge point falls within the lake Wylie Nutrient management Strategy area, and therefore the facility would be subject to nutrient limits upon expansion. This facility has a STMP and will be required to continue implementing its pretreatment program. There are no SIUs currently discharging to the WWTP and only one CIU (Spartan Dyes) 3.0 Compliance Summary DMR Data Review DMR data was reviewed for the period of January 2002- August 2005. A summary of monthly average effluent data is presented in the following table. Maximum monthly average flows are currently at 47% capacity. The facility has violated its BOD, fecal coliform, TSS and pH limits over the past permit cycle. Those violations will be discussed in the section on Compliance History. Analyses were performed for arsenic, cadmium, chromium, copper, cyanide, lead, mercury, molybdenum, nickel, selenium, silver, zinc. With the exception of copper and zinc, predicted maximum concentrations for all parameters were below the allowable concentrations. Although levels of copper and zinc were predicted above the allowable concentration, these are action level parameters' and data does not show that they are having a toxic effect on the receiving stream. WET Test Results The Belmont WWTP has a chronic WET testing requirement at 8%. Since January 2001 they have passed 19/20 tests administered. The single failure was in May 2004. No cause was determined. Correspondence File Review/Compliance History Between January 2002 and August 2005 the facility has incurred two permit violations for BOD (one weekly average, one monthly average), four for fecal coliform (weekly geometric mean exceedances), one TSS monthly average exceedance, and 12 pH violations (11 daily minimum and one daily maximum). The permit I have listed above, NC0021181, City of Belmont, was originally listed as having 4 monitoring wells (probably in their ATC). I wrote a memo to Dave and he concurred (7/5/2005) that we need to close out these wells. We (APS) were going to address this in a letter, but since you are in the middle of your review of this permit, I was wondering if it would be more expedient for you to address this when you issue the permit, for example, in your cover letter or comments "groundwater monitoring is not required at this time" -- this is basically for their clarification as to whether or not they need to monitor. They continue to pass their toxicity test, so copper is not really considered a problem, and we'll have enough cyanide data to do the RPA. I noticed that the fact sheet and cover page talked about "maintaining the LTMP monthly sampling" for cyanide and copper and re-evaluating the data at the next renewal. The City does have monthly effluent sampling for all LTMP POCs (including CN and cu), which is unusual. The City is interested in cutting this back to the normal quarterly sampling frequency that is in our guidance and that most other POTWs do. I plan to approve this for all other LTMP POCs, but wanted NPDES Unit concurrence before I approved quarterly effluent for copper and cyanide. I looked at the DMRs beginning with 4/02 when the current permit became effective to see what the effect of them cutting back would be, both on your RPA and our Headworks Analysis (HWA): 1. The coppers have been bouncing around in the 11 to 60 ug/l level, and the monthly sampling from 4/02 to 12/03 gives us 21 samples. If they cut back to quarterly for 2004, you'll still have at least 25 samples when the renewal is done in early 2005. I'm also thinking this is plenty to do an RPA ... what are your thoughts? [HWA isn't due til 2007, so I'll be happy with quarterly till then.] 2. The cyanides, unfortunately, are another matter altogether ... I discovered that they haven't been meeting the LTMP required detection level of 0.01 mg/I since 10/02. So between 4/02 and 12/03, you have monthly data with 2 detections @ 0.011 and 0.013 mg/l, 4 values @ <0.01 mg/1, and 15 values at 0.02 mg/1.. I've told the POTW that they need to get this fixed pronto, beginning with seeing if the lab still has the January sample and can re -run it at 0.01. (and the MRO may want to send them an NOV). I'm inclined to require them to continue with the monthly for awhile at least, to make up for the LTMP violation. But since the HWA isn't due til early 2007, from my perspective I don't necessarily need lots more monthlys as we still have three years to get enough good data. But you need to do the RPA in early 2005, so I propose I require the POTW to continue with monthly cyanide through the end of 2004 so you'll have 12 data points with a good detection level, and then let then go to quarterly in 2005. Would this be acceptable for your RPA needs? Note you also have the 6 good detection values between 4/02 and 9/02 if you want to use those, plus if you wanted, you could use the 15 <0.02's as one-half detection level.
