On November 10, 2009, the Wilmington Regional Office received a plan revision for
Stormwater Management Permit Number SW8 990923. The revisions include the addition
of 14,766 sf of sidewalk to along the CFCC North Campus Loop Road. Runoff from 9,004
sf of sidewalk will drain to Pond #1 while the runoff from the remaining 5,762 sf of sidewalk
will drain to Pond #3. The future impervious areas allotted within the drainage areas of
Pond #1 and #3 have been reduced to 1,103,083 sf and 329,214 sf, respectively. It has
been determined that a formal permit modification is not required for the proposed changes.
We are forwarding you an approved copy of the revised plans for your files and an updated
page 3 of the permit. Please add the attached plans to the previously approved plan sheet.
Please replace page 3 of the permit approved on March 28, 2008 with the updated page.
Please be aware that all terms and conditions of the permit issued on March 28, 2008,
remain in full force and effect. Please also understand that the approval of this revision
to the approved plans for the subject State Stormwater Permit is done on a case -by -
case basis. Any other changes to this project must be approved through this Office prior
to construction. The issuance of this plan revision does not preclude the permittee from
complying with all other applicable statutes, rules, regulations or ordinances which may
have jurisdiction over the proposed activity, and obtaining a permit or approval prior to
construction.

1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface except roads.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be.followed in its
entirety and maintenance must occur at the scheduled intervals including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch
basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.

Dear Dr. McKeithan:
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of
Chapter 143 of the General Statutes, which is current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that is set to expire during this time frame to 3 years from its current
expiration date.
Accordingly, Stormwater Permit # SW8 990923, which was set to expire on January 28,
2010, is now in effect until January 28, 2013. Please submit the renewal application and
fee at least 180 days prior to January 28, 2013, which would be August 28, 2012. A
copy of the Renewal Application can be obtained from the following website:

Cape Fear Community College is building a sidewalk along the Cape Fear
Community College North Campus Loop Road in New Hanover County. The
project site is located on the main loop road for the campus beginning behind the
McKeithan Center and ending at an existing parking lot on the north side of the
loop road. The project area is approximately 1.0 acres. The site drains to an
unnamed.tributary to Prince George Creek, Index No. CPF23 (18-74-53), in the
Cape Fear River Basin. The stream classification is C; Sw. A modification to the'>°��`�

The existing site consists of fairly level open space. There are no wetlands on or
near the project area. In its existing condition, stormwater runoff from the project +rg/off
area drains by sheet flow to existing NCDENR permitted Stormwater Pond #1 and
Stormwater Pond #3. There is no offsite runoff being conveyed through the site.
In the proposed condition, all runoff from the new impervious surfaces in the
project area will be directed to either existing permitted Stormwater Pond #1 or
Stormwater Pond #3 via the existing stormwater drainage system. Stormwater Pond
#1 will receive 9,004 SF of new impervious surface and Stormwater Pond #3 will
received 5,762 SF of new impervious surface.
Stormwater Pond #1 is currently permitted for 41.60 acres of drainage area and
1,268,467 SF of impervious surface. Of the 1,268,467 SF of impervious surface
permitted, 156,380 SF of impervious surface has been constructed under previous
permit modifications, with the remaining 1,112,087 SF of impervious surface
allocated for future built upon area. This permit modification will increase the
amount of constructed impervious surface for Stormwater Pond #1 to 165,384 SF
with the remaining 1,103,083 SF allocated for future built upon area.
Stormwater Pond #3 is currently permitted for 40.00 acres of drainage area and
1,219,680 SF of impervious surface. Of the 1,219,680 SF of impervious surface
permitted, 884,704 SF of impervious surface has been constructed under previous
permit modifications, with the remaining 334,976 SF of impervious surface
allocated for future built upon area. This permit modification will increase the
amount of constructed impervious surface for Stormwater Pond #3 to 890,466 SF
with the remaining 329,214 SF allocated for future built upon area.
The amount of built upon area requested in the permit modification for Stormwater
Pond #1 and Stormwater Pond #3 is in accordance with the permitted built upon
area for the ponds.

We received a permit modification for this project on November 10, 2009. We weren't quite sure why this was
being submitted as a modification and not as a plan revision, but I think I remember why. I think back in 1999
when the original permit was issued, we thought a permit modification would be the only way to document the
future development of this project because the permit had to be "rewritten" to document the reduction in future
BUA allocation.
We have since changed our thinking as to when a modification is needed and I think it's time to start submitting
these as plan revisions instead of permit modifications. We can easily adapt page 3 of the permit to reflect the
changes to the future BUA allocation with the plan revision approval letter. The permittee simply needs to
replace the old page 3 with the new page 3 in the permit. Unless you tell me that you've made additions to the
drainage areas or BUA over and above the current permitted maximum amounts, I'm going to accept and
process this package as a plan revision and return the $505.00 check.
