On January 24, 2003, the Wilmington Regional Office received a plan revision for
Stormwater Management Permit Number SW8 990923. The revision involves the construction of
an access street and parking lot within the previously permitted drainage area for Pond 3. It has
been determined that a formal permit modification is not required for the proposed changes. We
are forwarding you an approved copy of the revised plans for your files and a revised built -upon
area breakdown table. Please add the enclosed plan sheets to the approved plan set, and replace
the previously approved built -upon area breakdown table with the enclosed one dated January 24,
2003.
Please be aware that all terms and conditions of the permit issued on August 26, 2002,
remain in full force and effect. Please also understand that the approval of this revision to the
State Stormwater Permit is done on a case -by -case basis. Any other changes to this project must
be approved by this office prior to construction. If it is determined that the proposed revision
will require a modification to the permit, you will be notified.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, out parcels, and future development prior to the sale of any lot. If lot sizes vary significantly, a
table listing each lot number, size, and the allowable built -upon area for each lot must be provided as an
attachment.
The following covenants are intended to ensure ongoing compliance with state stormwater management
permit number as issued by the Division of Water Quality. These covenants may not
be changed or deleted without the consent of the State.
2. No more than square feet of lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but not include
wood decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit
modification prior to construction.
S. Allpermitted runoff from the outparcels or future development shall be directed into the permitted
stormwater control system. These connections to the stormwater control system shall be performed in a
manner that maintains the integrity and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and protective covenants for this project
shall include all the applicable items required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted
without concurrence from the State, and that they will be recorded prior to the sale of any lot.

the appropriate DWQ Regional Office.

Stormwater management for the Cape Fear Community College project consist of three (3) detention
ponds sized to achieve a 90% reduction in Total Suspended Solids. Each pond's drainage area is
assumed to be 70% impervious. The ponds are sized to handle runoff from future impervious areas.
The only impervious area proposed for this submittal is for the impervious area associated 'with the
extension of the access road on the north side of the campus and for the expansion of the parking lot on
the north side of the recently constructed building. All of the runoff from this phase of the project will
be directed to Pond No. 3. The pond is permitted to treat 29.33acres of impervious area. The
impervious area for this project along with what has previously been permitted to drain to Pond No. 3
now stands at 14.35 acres. Another 14.98 acres of impervious area is permitted to drain to. Pond No. 3.
