Department of Transportation Ferry Division, 159 Lucinda Lane, Powells Point, NC 27966 Authorizing development in Brunswick/New Hanover County at Cape Fear River at NCDOT Ferry Basin as requested in the permittee's application letter dated 10/23/20, including the attached workplan drawings (4) dated 9/19/20_ This permit, issued on November 10,2020 , is subject to compliance with the application(where consistent with the permit), all applicable regulations, special conditions and notes set forth below.Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein,this Minor Modification authorizes reconstruction of the dock at the Southport Ferry Terminal, as depicted on the attached workplan drawings. 2) The installation of the piles shall be accomplished by pile driving andlor the use of a vibratory hammer. Should the permittee andlor its contractor propose to utilize another type of pile installation, such as jetting, additional authorization from DCM shall be required. 3) No vegetated wetlands or waters of the State shall be excavated or filled, without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and the Chair other qualified persons within twenty (20) days of the issuing of the Coastal Resources Commission. date. Department of Transportation Permit#561 Page 2 of 3 ADDITIONAL CONDITIONS 4) Pilings from the existing dock shall be removed in their entirety, except that in the event that a piling breaks during removal and cannot be removed in its entirety, it may be cut off flush with the bed of the water body, and the N.C. Division of Coastal Management (DCM) shall be notified of each occurrence within one working day. 5) During the placement and removal of barges, temporary impacts to shallow water habitat shall be avoided and minimized to the maximum extent practicable. 6) Turbidity curtains shall be used at all times to isolate all work areas from the adjacent waters. The turbidity curtains shall be of sufficient length and effectiveness to prevent a visible increase in the amount of suspended sediments in adjacent waters. The turbidity curtains shall encircle the immediate work area,but, shall not impede navigation. The turbidity curtains shall be properly maintained and retained in the water until construction is complete and shall only be removed when turbidity within the curtains reaches ambient levels. 7) This permit authorizes only the structures that are expressly and specifically set forth in the permit application and shown on the attached workplan drawings. No other structures, whether floating or stationary, may become a permanent part of this project without additional authorization from DCM. No non-water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 8) Construction staging areas shall be located only in upland areas, and not in wetlands or waters of the State_ 9) Any waste materials or debris associated with construction, demolition, or other activities shall be disposed of at an approved upland site or shall be recycled in an environmentally appropriate manner provided appropriate authorizations from any relevant state, federal, or local authorities are obtained. • 10) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorized permit application, a permit modification and/or additional authorization from DCM shall be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. The permittee shall contact a representative of DCM prior to commencement of any such activity for • this determination and any permit modification. • 11) The permittee shall maintain the authorized work in good condition and in conformance with the terms • and conditions of this permit. The permittee is not relieved of this requirement if it abandons the project without having the permit transferred to a third party. 12) The permittee shall install and maintain at its expense any signal lights or signals prescribed by the U.S. Coast Guard,through regulation or otherwise, on the authorized facilities. At a minimum,permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 13) The permittee shall exercise all available precautions in the day-to-day operation of the facility to prevent waste from entering the adjacent waters and wetlands. Department of Transportation Permit#561 Page 3 of 3 ADDITIONAL CONDITIONS 14) The peiu iittee and/or its contractor shall contact the DCM Transportation Project Field Representative in Morehead City to request a pre-construction conference prior to project initiation. NOTE: The N.C. Division of Water Resources (DWR) determined that the project is covered under General Water Quality Certification No. 4132 (DWR Project No. 20190745 v.3) NOTE: The U.S. Army Corps of Engineers determined that the project is covered under Nationwide Permit Number 3. 15) This Minor Modification does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required. 16) This Minor Modification shall be attached to the original of Permit No. 561, as well as all subsequent modifications, renewals, and letters of refinement, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 17) All conditions and stipulations of the active permit remain in force under this Minor Modification unless altered herein. NOTE: A minor modification application processing fee of$100 was received by DCM for this project.
