Thorpe, Ph D, Acting Director Division of Water Quality May 13, 2002 Subject: FINAL NPDES Permit NCO026441 Siler City VWUTP Chatham County In response to your request to renew the subject permit, the Division of Water Quality (the Division) has reviewed and approved your application for Siler City's wastewater treatment plant (WWTP), received May 8, 2001. The Division hereby transmits your final permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,1994 (or as subsequently amended). Concerning Loves Creek. The Siler City WWVI'P discharges to Loves Creek, a waterbody officially included on North Carolina's 303(d) list as an impaired stream. This means that Loves Creek does not meet Water Quality Standards, and it is the Division's charge through the EPA and the Clean Water Act to recover and improve Loves Creek. Although non -point sources contribute to this degradation, the Siler City VVWTP comprises 96% of this creek under low -flow conditions and is therefore identified as a potential significant contributor to stream degradation. The Division will therefore continue to carefully monitor compliance at your facility. Ultimately, the removal of this discharge may be necessary. Concerning Ammonia. The Division may re -open this permit to require weekly average limits for ammonia. After calculating allowable concentrations, the Division will perform an analysis of past ammonia data to determine if there is reasonable potential for this discharge to exceed these potential limits. If there is, this permit will be re- opened. If there is not, the permit will not be re -opened, but will contain weekly average limits for ammonia upon renewal. Concerning Reasonable Potential Analyses. The Division conducted Reasonable Potential Analyses (RPA) on contaminants of concern, potential toxicants and metals considering Significant Industrial Users (SIUs), previous effluent monitoring and this facility's Pretreatment Program. These analyses evaluate "reasonable potential" for parameters to exceed North Carolina instream Water Quality Standards. Having concluded its review of stream. conditions, Siler City's compliance record and the RPA, the Division offers the following comments and changes to your previous permit. Concerning Revised Limits, and Monitoring Frequencies. A total of six parameters show reasonable potential to exceed instream Water Quality Standards. Therefore, new parameter limits and more stringent monitoring frequencies have been added to the permit. Several parameters do not show reasonable potential and have been deleted. The table on the following page summarizes permit changes. Concerning Mercury. Mercury continues to be a water quality concern throughout North Carolina. NPDES permittees have worked with the state to reduce potential risks from this pollutant, including tasks associated with collecting and reporting more accurate data. The most commonly used laboratory analysis (EPA Method 245.1) has a detection limit of 0.2 µg/L while the current water quality standard is an order of magnitude lower at 0.012 jig/L. A more recently approved analytical test (EPA Method 1631) should produce a detection limit below the level of the standard. This will allow the Division to assess potential water quality impacts from discharges more accurately. Therefore, beginning on or before September 1, 2003, you will be required to begin using EPA Method 1631 when analyzing for mercury. Concerning Instream Sampling. The Division acknowledges that Siler City has entered into a Memorandum of Agreement (MOD) with the Upper Cape Fear River Basin Association and has therefore deferred stream monitoring since May 2000. Should Siler City's membership in this association terminate for any reason, Siler City shall immediately inform the Division of Water Quality and immediately resume responsibility for instream monitoring requirements as presented in this permit. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing upon written request within thirty (30) days after receiving this letter. Your request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes, and must be filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding. This permit is not transferable except after notifying the Division of Water Quality. NPDES Permit No. NC002644i1 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A. (2.) CHRONIC TOXICITY PERMIT LBUT (QUARTERLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 90 %. The permit holder shall perform at a minimum, quarterl monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase H Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of March, June, September, and December. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. H the test procedure, performed as the first test of any single quarter, results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months, as described in "North Carolina Phase H Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. The permittee's 5-year NPDES permit expired April 30, 2001 and they have requested renewal from the Division of Water Quality (the Division). This Fact Sheet summarizes background information and rationale used by the Division's NPDES Unit to determine permit limits and monitoring conditions. This document also contains references to information sources relevant to this permit renewal (superscripted numbers in order of appearance, see References). FACILITY RECORDS REVIEW Facility Description. Siler City WWTP (Table 1) is a 4.0 MGD publicly owned treatment works (POTW) utilizing a Grade IV activated sludge wastewater treatment facilities to treat domestic and industrial wastewater. The treatment system includes automatic and manual bar screens, grit collection, equalization basin, influent pump station, aerobic digester, filter backwash holding station, DAF Unit, four additional equalization basins (not in use), sledge transfer station, lime tower, alum feed station, dual oxidation ditches, dual clarifiers (only one used at a time), four (4) tertiary filters, chlorine contact chamber, sulfur dioxide addition, and step aeration prior to discharge. The Division prepared the last WLA for the receiving stream in February 1996 and developed effluent limits and monitoring requirements considering an in -stream waste concentration (IWC) of 90 %.7 The Division views these limits and monitoring requirements appropriate for renewal except as outlined below (see Summary of Permitting Approach). Verifying Existing Stream Conditions. This facility discharges to the lower portion of Loves Creek, a Class C waterbody, tributary to the Rocky River within Subbasin 30612 of the Cape Fear River Basin.5 The Division has formally classified this portion of Loves Creek as an "impaired" stream [DWQ impaired list 303(d)], and notes that this portion of the creek, from the Siler City WWTP outfall to the Rocky River, is "not supporting" (NS) its intended uses.516 Although the parameters of impairment have yet to be established, the permittee is recognized as a major point source discharger and a potential source of impairment. CORRESPONDENCE Staff Report. Raleigh Regional Office (RRO) conducted an annual facility inspection and Bob Mangum prepared a Staff Report dated June 14, 2001. The RRO staff found the facility in good condition and in compliance with the permit. The RRO recommended that the NPDES Unit renew the permit. Division Records and Renewal Application. Division records for Siler City date from 1996. The current permit originally expired on April 30, 2001 but was extended by the Division to better manage permit renewals to October 31, 2001. The Division received the permittee's request to renew the permit (Standard Form A) on May 8, 2001.1 The permittee's notes on the application that the facility "... has not made any changes pertaining to the plant since the last permit was issued." COMPLIANCE REVIEW DMR Instream and Effluent Data Review. The Division reviewed 36 months (January 1999 through December 2001) of Discharge Monitoring Reports (DMRs). Siler City's DMR files for three years appear regular, thorough, and complete. Total flow for this time period averaged about 2.72 MGD or about 68 % of permitted capacity.11 The highest daily maximum flow rate (6.874 MGD) was reported for January 24, 1999 but the facility remained in compliance with January's monthly average limit. Effluent Chlorine. The permittee is currently restricted by a Total Residual Chlorine (TRC) limit of 17 µg/L and complies by de -chlorinating its effluent.4 Effluent TRC concentrations averaged < 10 µg/L (based on 36 months of data) with maximums reported occasionally at 15 µg/L TRC.11 Considering an Instream Waste Concentration (IWC) of 96.1 %, the Division commends the permittee's diligence in controlling chlorine. Division records for Siler City date from 1996. The current permit originally expired on April 30, 2001 but was extended by the Division to better manage permit renewals to October 31, 2001. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended), the Fish and Wildlife Coordination Act (48 Slat. 401, as amended; 16 U.S.C. 661-667d), and North Carolina General Statutes (C.S. 113-131 et seq.). The applicant has submitted a request for apermit renewal for the Siler City Wastewater Treatment Plant to discharge treated wastewater into the Loves Creek in the Cape Fear River basin. This WIVTP has had chronic problems in the past, and as of early December 2001, the Rocky River just downstream of the eonfluonee with Love's Creek has been afflicted with excessive algae growth. It is our understanding that this plant utilizes chlorine in their treatment system. Chlorine is acutely toxic to aquatic organisms and forms secondary compounds that are also detrimental to aquatic life. We are especially concerned with impacts of this project on the many sensitive species that are found in this system. This system supports the federal and state endangered Cane Fear shiner (Motropis meWtocholas); federal species of concern and state threatened brook floater (Alasmidonta vaelcosa), Atlantic pigtoe (Fusconaia masoni), and yellow latnpmussel (Lurnpsilds cariosa); federal species of concern and state special concern Carolina. ereekshell (Villosa vaughaniana) and Carolina darter (Etheostonia collts); federal species of concern and state significantly rare Carolina redhorse (Moxostoma sp.); state threatened creeper (S'traphitus undulatus); and the state significantly rare notched rainbow (Villosa constriela), Eastern creekshell ( Villosa delumbis), and a mayfly (Leptohypes robacla). Treatment units include an automatic and manual bar screen, grit collection, equalization basin, influent pump station, aerobic digester, filter backwash holding basin, DAF unit, 4 additional equalization basins (not in use), 2 additional digesters, 1 additional clarifier (not in use), sludge transfer station, lime tower, alum feed station, dual oxidation ditches, dual clarifiers (only one in use at a time), 4 tertiary filters, chlorine contact chamber, sulfer dioxide addition and step aeration prior to discharge. 2. A review of discharge monitoring report (DMR) data submitted showed a violation of mercury in December 2000. 3. The current permit expires 4/30/01, but a six month extension by this Division. 4. Mr. Brown stated that SYNAGRO land applies there sludge according to the requirements set forth in Permit No. WQ0003226. 5. All preventative maintenance records are kept on computer at the facility. 12. Mayor Charles Turner signs all DMR's which is consistent with their permit requirement. 13. The water in the 2 oxidation ditches had good color and no excessive foam. Their are 2 clarifiers, but only one is in use at a time and they are cleaned every 2-3 days. 14. The sludge depth in the chlorine contact basin was about 24 inches, but usually stays about 12- 15 inches, there is a 30 minute detention time in the chamber. 15. The entire facility is fenced and there is a good supply of spare parts on -site, there is also an o&m schedule on all equipment. 16. Specifically, an SIU: • has a flow of 25,ODO gallons or more per average workday; • has a flow greater than 5 percent of the total flow carried by the municipal system m receiving the waste, or • has a toxic material in its discharge. It may be necessary to alter these administrative criteria in certain cases, such as an instance where two or more contributing industries in combination can produce an undesirable effect on either the municipal facility or the quality of its effluent.
