Carolina.
Dear Mr. Benjamin,
We have reviewed the referenced project using the North Carolina Field Office’s online project
review process and have followed all guidance and instructions in completing the review. We
completed our review on October 12, 2020 and are submitting our project review package in
accordance with the instructions for further review.
Our proposed action consists of a gas station and convenience store with associated amenities
and connections to public utilities. Development is anticipated to include the construction of an
access road across a jurisdictional relatively permanent water feature (does not constitute a
wetland or stream). At this time, no other impacts are anticipated.
The location of the project and the action area are identified on the enclosed maps (Figures 1 and
2 in Appendix C, including a USGS topographic map and aerial imagery).
The project is expected to be completed over 1 to 2-years. Construction is anticipated to take
place around mid-2021 and continue for approximately 5 to 8-months.
This project review is needed as supplement to U.S. Army Corps of Engineers consultation for
use of a Nationwide Permit due to impacts to jurisdictional waters anticipated with the proposed
road crossing. The Site and future development do not have any other federal or state
involvement.
The USFWS IPaC search for the Site (Consultation Code 04EN2000-2020-SLI-1886, Event
Code 04EN2000-2020-E-04204) identified six federally listed endangered species and eight
federally listed threatened species as potentially occurring in the vicinity of the Site: red-
cockaded woodpecker (Picoides borealis), Kemp’s Ridley sea turtle (Lepidochelys kempii),
leatherback sea turtle (Dermochelys coriacea), Cooley’s meadowrue (Thalictrum cooleyi),
golden sedge (Carex lutea), rough-leaved loosestrife (Lysimachia asperulaefolia), northern long-
eared bat (Myotis septentrionalis), West Indian manatee (Trichechus manatus), piping plover
(Charadrius melodus), red knot (Calidris canutus rufa), American alligator (Alligator
mississippiensis), green sea turtle (Chelonia mydas), loggerhead sea turtle (Caretta caretta), and
seabeach amaranth (Amaranthus pumilus) respectively. Additionally, the IPaC identified one
federally proposed threatened and one candidate species: Eastern black rail (Laterallus
jamaicensis ssp. jamaicensis) and magnificent ramshorn (Planorbella magnifica), respectively.
No critical habitat was identified within the project area. Additionally, per the instructions of the
Raleigh Field Office’s Project Review Steps, Timmons personnel assessed the potential for
impacts to the bald eagle (Haliaeetus leucocephalus).
Furthermore, a search of the North Carolina Natural Heritage Program’s (NC NHP) online
database (report ID: NCNHDE-12886) revealed a sighting of the federally endangered Atlantic
sturgeon (Acipenser oxyrinchus oxyrinchus) from September 2019 within the vicinity of the
project area. This species is not identified on the IPaC report.
The project area lacks water bodies suitable to sustain the following species: Kemp’s Ridley sea
turtle, leatherback sea turtle, Atlantic sturgeon, green sea turtle or loggerhead sea turtle.
Therefore, it is the opinion of Timmons that the proposed project will have no effect on these
species and they will not be described further.
Effects to critical habitat
No critical habitat is present within the project area or a 1-mile radius.
Effects to federally endangered species
The project area consists of a mixed hardwood and pine forest that is largely undisturbed and
could serve as potential foraging habitat for the red-cockaded woodpecker. However, the stand
has limited connectivity to other natural areas and is not of a sufficient size to support red-
cockaded woodpecker populations. Further, no occurrences of red-cockaded woodpecker were
observed at the time of the on-site inspection or noted in the NCNHP report as occurring in the
vicinity of the site. Therefore, it is the opinion of Timmons Group that the project may affect, but
is not likely to adversely affect the red-cockaded woodpecker.
While the project area contains regularly maintained areas, these areas could not sustain
Cooley’s meadowrue due to the extent of maintenance. Other portions of the site consist of
mature mixed hardwood-pine forests not capable of supporting Cooley’s meadowrue. Further, no
occurrences of Cooley’s meadowrue were noted in the NCNHP report as occurring in the
vicinity of the site. Therefore, it is the opinion of Timmons Group that the proposed project will
have no effect on Cooley’s meadowrue.
A majority of the project area is intensively managed, with the rest consisting of mature mixed
hardwood-pine forest and disturbed plant communities. As a result, the project area lacks diverse
plant communities and the ecotones between them that are preferred by the golden sedge.
Further, no occurrences of golden sedge were noted in the NC NHP report as occurring in the
vicinity of the site. Therefore, it is the opinion of Timmons Group that the proposed project will
have no effect on golden sedge.

Following an on-site inspection, the project area was observed have sandy to loamy/clayey soils,
lacking the peaty, poorly drained soils preferred by rough-leaved loosestrife. Further, no
occurrences of rough-leaved loosestrife were noted in the NC NHP report as occurring in the
vicinity of the site. Therefore, it is the opinion of Timmons Group that the proposed project will
have no effect on rough-leaved loosestrife.
Effects to federally threatened species
The project area contains mature mixed hardwood-pine forest with suitable roosting and foraging
habitat for the northern long-eared bat (NLEB). Additionally, the NC NHP report lists a 1994
sighting of the NLEB within a 1-mile radius of the project area. However, the project is not
located within a county with known roost trees, no occurrences were observed at the time of
inspection, and no hibernacula are anticipated to be located in the surrounding area to due
existing landscape characteristics. Relying upon the findings of the 1/5/2016 Programmatic
Biological Opinion for the Final 4(d) Rule on the Northern Long-Eared Bat and Activities
Exempted from Take Prohibitions to fulfil our project-specific section 7 responsibilities, it is the
opinion of Timmons Group that the proposed project may affect, but is not likely to adversely
affect NLEB.
While the NC NHP report lists a documented sighting of the West Indian manatee within 1-mile
of the project area in 2019, there are no bodies of water within the project area that could provide
suitable habitat or support the species. Therefore, it is the opinion of Timmons Group that the
project will have no effect on the West Indian manatee.
The project lacks open, sandy beaches required for the piping plover, red knot, and seabeach
amaranth species. Further, no occurrences of piping plover, red knot, or seabeach amaranth were
noted in the NC NHP report as occurring in the vicinity of the site or at the time of inspection.
Therefore, it is the opinion of Timmons Group that the project will have no effect on piping
plover, red knot, and seabeach amaranth.
The project area contains limited aquatic features, all of small size and primarily consisting of
small wetland areas, with the largest wetland area totaling 0.14 acres. Additionally, the two 0.07
acre stormwater ponds within the southeastern portion of the site represent low-quality habitat.
Due to the absence of occurrences observed and the low quality and disconnected nature of the
aquatic features identified on-site, the proposed project is not anticipated to have an adverse
impact on the American alligator. Further, no occurrences of American alligator were noted in
the NC NHP report as occurring in the vicinity of the site. Therefore, it is the opinion of
Timmons Group that the project may affect the American alligator.
Effects to proposed federally protected and candidate species
While wetlands were identified during an on-site inspection, the largest wetland is a 0.14 acre
forested wetland. Smaller wetlands identified featured emergent vegetation but were not the
dense marshes required by the Eastern black rail and were of relatively low-quality. Further, no
occurrences of Eastern black rail were noted in the NC NHP report as occurring in the vicinity of
the site. Therefore, it is the opinion of Timmons Group that the project will have no effect on
Eastern black rail.
A freshwater stream with slow moving and submerged vegetation is located in the southeastern
portion of the project that could serve as potential habitat for the magnificent ramshorn.
However, the project area is not located near one of the known populations of the magnificent
ramshorn, which is largely believed to be extinct in the wild. Further, aquatic on-site lack the
diverse aquatic vegetation required by the species. Therefore, it is the opinion of Timmons
Group that the project will have no effect on the magnificent ramshorn.
Effects to federally protected species not identified through IPaC
The Raleigh Field Office Project Review steps request that reviewers assess their projects for the
potential to impact bald eagle nests. Per the NCNHP Report, there are no occurrences of the bald
eagle or their nests at or within 1-mile of the project Site. Further, no occurrences of nests or bald
eagles were observed during the Site inspection. Therefore, any disturbance of the Site is
unlikely to disturb nesting bald eagles and no Eagle Act Permit is required.
The enclosed project review package provides the information about the species and critical
habitat considered in our review, and includes a species conclusions table identifying the
determinations.

The species list generated pursuant to the information you provided identifies threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by

If your project contains suitable habitat for any of the federally-listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally-protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel

Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle

using submeter, Bluetooth GPS antennas by Timmons Group.
