Thank you again for taking the time to meet Susan and I on Friday to confirm the tidal influence of our 2 sites, we can’t
tell you how much we appreciate your quick response.
I just wanted to reach out to see where you were on the email confirmations verifying what we discussed and found on
Friday for both sites so we can go ahead and pass that along to the right people. If you wouldn’t mind sending 2
separate emails, one with a subject line of “NCNG New Hanover (PN 43932)” and the other “Circle K NTI Airport (PN

Yeah, sure. That shouldn’t be a problem at all. I have just learned that we are taking our District Manager out to lunch

And I know we had mentioned before that we have another site on the other side of ILM that we also need CAMA
verification for. (In the attached picture, the southernmost project area in red on the right of the map is the NCNG site
and the second site we’d like to try to visit is the one to the east in blue, ~38 acres). If we have time after the NCNG site,
which is the priority site, would it be possible to hop over to this second site while we’re all already out there?

I’ve attached the preliminary wetland determination map and circled the wetlands of concern, which are connected to
Smith Creek by intermittent streams, in red. If you don’t have time to go to this second site tomorrow, that’s okay, we’re
just trying to avoid having 2 separate site visits when the sites are this close to each other.

I have received the Agent Authorization Form and the District Manager has approved it if we determine the work will be
within the AEC and a CAMA permit required.

I will need the completed application by October 11TH in order to issue the permit (again, if it is needed).
I will make this determination on site and we’ll go from there. I am available tomorrow after 11:00 AM, on Monday the
7TH after 10:00 AM, Tuesday the 8TH, and on Friday the 11TH after 11:00 AM. Let me know which of these days and a time
that work for you and I will meet you there.

Susan,
If it is determined that any of the project sites to repair the damaged stormwater system are located within the AEC
then a CAMA General Permit would be required. For damages to property sustained from Hurricane Florence, Secretary
Regan activated the Emergency General Permit 15A NCAC 07H .2500 to cover these damages under this CAMA permit
with no fee. I have attached the rules under this permit to this email for you records. In order to qualify for this permit,
the replacement of a damaged or destroyed structure shall take place within the footprint and dimensions that existed
immediately prior to the damaging hurricane or tropical storm. No structural enlargement or additions shall be allowed
(.2505 (a)).
Now here’s the kicker…

This Emergency CAMA GP was enacted immediately after Hurricane Florence on September 20TH, 2018 and these GP’s
are valid for one year from the date the Secretary activates this permit (.2502 (f)). However, since there were so many
damages sustained from the storm and getting help from contractors was difficult due to the amount of work therefore
getting things repaired and rebuilt by the original deadline of September 20TH, 2019, the Secretary issued another year
for these Emergency GP’s as long as applicants have acquired the CAMA permit by October 12TH of this year. See
attached email for your records.
I can meet you on site at these project locations to determine if any of the maintenance work to the damaged
stormwater system would be located within the Estuarine Waters AEC, therefore requiring this CAMA Emergency GP. If
this CAMA permit is needed to cover the work, then I will need the project site plans (drawings) detailing the footprint
and dimensions of the stormwater system as well as an Agent Authorization Form. I have attached one of these forms
to this email as well.
Let me know when you are available to meet me on site so I can make this determination and I will accommodate your
request as best as possible. Let me know if you have any questions or concerns.

The current plan at this location is to restore the stormwater outfall area to what it was prior to Hurricane Florence. The
hurricane damaged the outfall area by tree throw and sedimentation. The area that will be impacted was determined to
be a wetland based on a delineation performed in September, 2019 by Timmons Group. The client is looking to push
this project through quickly as an emergency response to a need to fix the issue as a result of the damaged stormwater
outfall area.
How would the NHW/MHW be determined? Would a onsite visit be necessary?
Then does the project require a CAMA permit?
The wetland area in question is dominated by trees such as red maple, loblolly pine, sweetgum and in some areas pond
cypress. It does not support the species defined as a coastal wetland.

Good Morning Susan,
My name is Tyler McGuire and I will be the Environmental Specialist with the Division of Coastal Management handling
your projects near the Wilmington Airport. From your projects’ location descriptions and GPS coordinates the only
project site I am “worried” about would be the area located closest to Smith Creek south of the airport at GPS
coordinates 34.261162, ‐77.893806.
In order to determine if any of these project sites would be located within our Area of Environmental Concern (AEC) we
would need to locate Normal High water (NHW)/Mean High Water (MHW). It appears this furthest south location would
be the only project site from the ones you’ve described possibly located within our AEC and maybe require a CAMA
permit.
If there are any Coastal Wetlands growing this far up Smith Creek, we would need to locate those as well to prevent
impacts to that resource. It appears there might not be coastal wetlands at these locations, however it does appear
there are 404 Wetlands located within or adjacent to these project locations which would require authorization from
the US Army Corps of Engineers in order to work in and impact any of those areas.
Smith Creek at these locations is definitely tidally influenced and located within the coastal county of New Hanover, so if
any of the projects are located within 75’ from NHW/MHW, then a CAMA permit might possibly be required depending
on the type of work that’s being proposed.

I would like to get a CAMA verification for 2 projects located in New Hanover County on either side of the
Wilmington airport. They are both north of Smith Creek.
The first project, southeast of the airport, is located off Infantry Drive. There are 3 parcels associated with this
project. The latitude and longitudes for the 3 parcels are as follows:
