Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The project Site consists of an approximately 37.8-acre section of the larger Wilmington International Airport property located southeast of the intersection of Airport Boulevard and North 23rd Street in Wilmington, North Carolina within New Hanover County. The project Site is bound by commercial developments and forested areas to the south, Airport Boulevard and commercial development to the north, North 23rd Street, institutional and commercial developments to the west, and Wilmington International Airport to the east. Approbmately 50 % of the Site is maintained lawn with the remaining 50% consisting of mixed hardwood -pine forest. The proposed commercial development will consist of a convenience store and gas station with associated parking, stormwater control measures, and utility improvements (i.e. road, public water supply and sanitary sewer alignment). A delineation of the Site was completed by Timmons Group on September 18 and October 4, 2019. A confirmation site visit was conducted with Rachel Capito of the USACE on November 6, 2019 confirming the boundaries utilized fro avoidance and minimization during project planning. Tyler McGuire with the NC Division of Coastal Management confirmed on October 10, 2019 that a CAMA permit was not needed for the project. 4b. All work will be conducted in accordance With local, state, and federal regulations. The three areas were overlapped to minimize overall project impacts. E. Impact Justification and Mitigation u 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by incorporating resourceful site planning, including utilization of the wetland/stream delineation to adjust the layout of the Site design to avoid and minimize impacts. The remaining impacts proposed are necessary in order for the project's goals to be realized. Site design was able to avoid wetland and stream impacts, minimizing impacts to only a portion of relatively permanent water on -site. These impacts were further minimized by overlapping the road, water line easement, and sewer line easement. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with the requirements of the North Carolina Department of Environment and Natural Resources: Erosion Control Planning and Design Manual (May 2013) and local codes. All work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground. The contractor shall install silt fence, inlet protection, sediment traps, division ditches, temporary coffer dams, tree protection, and clearing only as necessary to install devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept by the owner's representative. Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. Measures will be taken to prevent oil, tar, trash, debris, and other pollutants from entering adjacent jurisdictional features. Any excess excavated materials not utilized as back fill Will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore, stockpiling of excavated material within jurisdictional waters of the U.S. will be strictly prohibited as part of the construction of this project. All project construction activities initiated within jurisdictional waters of the U.S. Will be carried to completion in an expeditious manner to minimize the period of disturbance within jurisdictional waters. 2. A USFWS IPaC Report and NC Natural Heritage Program (NHP) Database Report were utilized for review of potential protected species in the vicinity of the project Site. Species identified by IPaC as potentially occurring the vicinity of the Site include the eastern black rail, piping plover, red knot, red - cockaded woodpecker, American alligator, green sea turtle, Kemp's Ridley sea turtle, leatherback sea turtle, loggerhead sea turtle, magnificent ramshorn, Cooley's meadowrue, golden sedge carex, rough -leaved loosestrife, seabeach amaranth, northern long-eared bat, and West Indian manatee. Additionally, the NCNHP report identified the federally endangered Atlantic sturgeon as potentially occurring within the Site or a 1-mile radius of the project limits. No occurrences of the aforementioned protected species were observed during the Site inspections. Due to the absence of forested areas of an appropriate age and size, it is the opinion of Timmons Group that the proposed project will have no effect on the red -cockaded woodpecker. Due to the lack of sandy beaches, open ocean, and large bodies of water with suitable water quality within the project limits and 1-mile radius, it is the opinion of Timmons Group that the proposed project will have no effect on the following species: West Indian manatee, piping plover, red knot, Atlantic sturgeon, American alligator, green sea turtle, Kemp's Ridley sea turtle, leatherback sea turtle, loggerhead sea turtle, magnificent ramshorn, and seabeach amaranth. Based on the lack of densely vegetated marshes and suitable ecotone transition zones, it is the opinion of Timmons Group that the proposed project will have no effect on the following species: eastern black rail, Cooley's meadowrue, golden sedge, and rough -leaved loosestrife. The NCNHP report listed an occurrence of the northern -long eared bat within a 1-mile radius of the proposed project limits. Additionally, suitable habitat was observed within the project area. However, the project is not located within a county with known roost trees, no occurrences were observed at the time of Site inspection, and no hibernacula are anticipated to be located in the surrounding area to landscape characteristics. Therefore, it is the opinion of Timmons Group that the proposed project may affect the northern long-eared bat. Per the NCNHP database report, no documented bald eagle nests are within the project area or a 1-mile radius. Therefore, it is the opinion of Timmons Group that the proposed project is unlikely to disturb nesting bald eagles and will not require an Eagle Act permit. Timmons Group initiated USFWS consultation to confirm these findings on October 15, 2020 (attached). No response has been received to date. What data sources did you use to determine whether your site would impact historic or archeological resources?* A search of the North Carolina Natural Heritage Preservation Office's online database (HPOWEB) revealed fourteen historical resources as occurring within a 1-mile radius of the proposed project limits. No historical places were listed within or in the immediate vicinity of the Site's boundaries. Of the fourteen historic listings, only one was determined eligible (DOE) for listing on the National Registry of Historic Places (NRHP) - New Hanover County Prison Farm (NH0537), which is located approximately 0.35-miles southwest of the Site. The remaining thirteen historical listings are survey only (SO), with four of those listings being deemed ineligible or listing on the NRHP. While historic sites listed as SO have not yet been deemed eligible for listing and can be deemed eligible in the future following further review from the State Historic Preservation Office (SHPO), the nearest undetermined SO site is located approximately 0.55-miles northeast of the Site. Additionally, following informal email consultation with the Office of State Archaeology (OSA), there are no archaeological sites recorded on or within the immediate vicinity of the proposed project's limits. However, seven archaeological sites, including one determined eligible for listing on the NRHP and four no data or undetermined sites are located within 1-mile of the project area. it is the opinion of Timmons Group that the proposed development is not anticipated to impact historic resources due to the disturbed nature of the Site and distance from known historic resources. 7c.
