Mr. Mike Conard, acting as agent for Ms. Etta Rooks, is requesting a modification of State Permit No. 198-
08. State Permit No. 198-08 was issued to the Mr. John Jenkins and Etta Rooks for dredging of the canal
adjacent to the Atlantic Intracoastal Waterway (AIWW) and reconfiguration of Mr. Jenkins' docking facility
on December 19, 2008. It was modified on February 8, 2010 to allow for the replacement of a finger pier.
The permit will expire on January 11, 2014 (as extended by Session Law 2009-406).
Mr. Conard is requesting that the permit be modified again to allow the relocation of docking facility four
feet to the north. As proposed, the existing floating access platform would be moved four feet to the north,
the previously approved finger pier would be relocated to the center of the floating access platform
(approximately 10' to the east) and a boatlift would be installed on the landward side of the finger pier, which
would measure 10' in length by 10' in width. The current structure is non-conforming with the 1/4 width rule.
While relocating the docking facility to the north would place it in a slightly wider portion of the channel, the
docking facility would still not meet the 1/4 width rule, as the floating platform would extend over 20' into the
waterbody measuring less than 38' in width at this location. The proposed new location of the finger pier
would also exceed 1/4 width of the waterbody, as it would extend approximately 14' into the waterbody.

The proposed structure would be located within the northern 15' riparian setback and a waiver has been
submitted from the adjacent riparian property owner (Mr. Hardee). As proposed, the structure would meet the
4 square foot rule. This project is not located in waters classified as Primary Nursery Area by the NC
Division of Marine Fisheries. The proposed work would result in an additional slip, thereby creating a total of
three slips, if including the potential docking on the northern side of the float for smaller vessels. All work
previously authorized by State Permit #198-08 has been completed.
The agent has submitted a check (ck. # 4246) in the amount of $100.00 for the modification request.
This office objects to the permit modification request, as the proposed work is inconsistent with the use
standard set forth in NCAC 07H. 0208 (b)(6)(J). Please submit any comments or concerns regarding the
proposed de'veiopntut to Doug Huggett in writing by June 10, 2010.

proposing to relocate the finger pier to the center of the main dock in order to accommodate a
boat lift. We are also proposing to shift the entire structure 4' to the North 1) to easily moor on
either side of the finger pier and 2) still allow for launching and retrieving kayaks/canoes and
