PROJECT SUMMARY: The applicant proposes to construct the Coastal Studies Institute with 6 slips and a boat ramp in a smaller proposed canal in lieu of the permitted 46 lot subdivision and 46 slips on a larger permitted canal system. Major Modification - CAMA Major Permit No. 24-08 East Carolina University Dare County Coastal Studies Institute Express Permit Review Program Project setting Michael Morway, with Albemarle and Associates, on behalf of East Carolina University, has requested the attached application be processed as a major modification of the existing CAMA Major Permit No. 94-05 under the Express Permit Review Program. The proposed modification is for the construction of the Coastal Studies Institute onsite the old Skyco property including a reduction in the permitted excavation area and slip number. The project site is a 207 acre tract located on the west side of NC 345 in the Skyco Community, .8 miles south of the intersection of US 64/264 and NC 345 on Roanoke Island near the Town of Manteo, at the head of two manmade canals off Croatan Sound in Dare County, North Carolina. CAMA Major Permit No. 24-08 was originally issued to Skyco Development Company, LLC on 12 February 2008 for the development of a 46-lot subdivision with access roads, community building with parking, and a common area. The permitted project also included the enlargement of an existing canal system with new excavation as well as maintenance excavation, bulkheading along the canal bank and the creation of 46 boat slips for the individual lot owners. The permit was transferred to East Carolina University on 8 February 2010 with an expiration date of 18 November 2014. To date, work has taken place to level the existing site by removing spoil offsite, and the heads of the two canals have had limited excavation work undertaken to remove the wetland plugs as per the original permit request. The upland portion of the tract comprises ±25 acres that was used as a spoil site for a project the NC Division of Water Resources initiated that was authorized under Major CAMA Permit No. 106-04. The upland portion of the site has an existing elevation of ± 3-9' and is comprised of sandy soils/spoil materials. The remainder of the site (±182 acres) is dominated by a Juncus roemerianus salt marsh. There are three existing manmade canals on the property that run from the Croatan Sound to the upland area. The existing canals are ±40' wide with water depths ranging from 5 to 7 feet in the center and 1 to 3 feet near shore. The adjacent riparian property to the downstream (south) side is a similarly vegetated salt marsh with an upland area located on the east side of the property adjacent NC 345. The adjacent riparian property to the upstream (north) is a developed lot with a single family residence adjacent the northern most manmade canal. The Estuarine Water of the manmade canals off Roanoke Sound are classified as SA by the Division of Environmental Management and this area is open to shellfishing. Water will be provided by the County and an onsite Waste Water Treatment Plant is proposed. Major Modification - CAMA Major Permit No. 24-08 East Carolina University Dare County Coastal Studies Institute Express Permit Review Program Page Two Existing permits for the site include: Erosion and Sediment Control Plan #DARE- 2008-005 issued 7 December 2007, NCDWQ Stormwater Permit #SW7071108 issued 13 January 2010, and DWQ General Water Quality Certification No. 3642 (DWQ Project No. 061909 version 2) issued 20 December 2007. The US Army Corps of Engineers assigned the project Action ID #200702100. Project description The applicant proposes to modify the existing permit from 46 single family residential lots with a 46-slip marina, and canal excavation, to a 6 slip docking facility with reduced canal excavation, and a multi-building teaching facility on the upland portion of the site. The original permit authorized a ±2,409' long J-shaped canal and the applicant proposes to reduce the length to ±1,290' including the boat slip area. The proposed excavation will be a straight line connection of the heads of two of the existing manmade canals creating a loop system off the Croatan Sound. Spoil deposition will be in two upland locations on the project site. The canal will range from 50' to 85' wide with an average width of 67.5' and a finished depth of 5' below the Normal Water Level (NWL). All proposed canal excavation is in upland areas of the site. In the northern most end of the proposed canal excavation, the canal will be widened to ±135' over a distance of ±230' with a finished depth of 5' below NWL to create a basin area. At the northern end of the new canal/basin excavation, a 24' wide by 32' long concrete boat ramp is proposed. The waterward end of the proposed boat ramp will be protected by a 5' wide strip of rock riprap at the grade of the ramp to help prevent wash out. A 4' wide by 111' long dock on the north side of the ramp, and an 8' wide by 66' long dock on the south side of the ramp are proposed to aide in launch and retrieval of research vessels. Adjacent the boat ramp, the applicant proposes an 8' wide by 205' long dock with 3 finger piers (1 @ 4' by 18' and 2 @ 4' by 20') creating 6 slips. The docking area is for research vessels associated with the teaching facility. A 422 ft2 irregularly shaped platform (10'-18' wide by 30' long) is proposed at the south end of the docking area to aid in loading and offloading equipment on boats. The docking area will connect to the marine service building via an 8' wide by 98' long wooden boardwalk. An 18' wide by 70' long loading dock with an adjacent 18' wide by 30' long covered platform is proposed at the south end of the proposed canal. This loading area will provide boat loading access from the main teaching building to the canal for students and facility guests. The loading area will connect to the main building via an 8' wide by 136' long wooden walkway on uplands. The applicant proposes to connect the loading dock to the previously described slip area by constructing a 5' wide by 522' long boardwalk elevated 36 inches above a proposed wetland creation area running parallel to the proposed canal. Major Modification - CAMA Major Permit No. 24-08 East Carolina University Dare County Coastal Studies Institute Express Permit Review Program Page Three At the southwest corner of the upland portion of the property, a third existing manmade canal provides boating access to the site. The applicant proposes to construct a 6' wide by 60' long wooden walkway over Coastal Wetlands to a covered 23' by 34' kayak launch platform at the head of the canal. The platform will have 3 tiered racks for kayak storage and a section of the platform will ramp down to a floating platform for launching. The applicant also proposes to construct an 8' by 8' lattice walled enclosed storage room on the platform. A 5' wide by 504' long boardwalk is proposed to connect the upland portion of the site to a small upland hummock in the Coastal Wetland area east of the project area. The kayak access and platform, as well as the hummock access boardwalk will be elevated 36 inches above the marsh substrate as measured to the bottom of the decking. Upland development on the site will disturb a total of 18.1 (788,436 ft2) of the 25 acres and consist of a 56,800 ft2 main research building, a 9,700 ft2 marine service building, a 3,500 ft2 boat storage building, 2 - 6,591 ft2 dormitories and various paved parking areas and access roads. The total amount of impervious surface within the 75' Estuarine Shoreline is 1.0% (±10,890 ft2). The total impervious surface proposed for this project is 14.5% (±157.9 ft2). Anticipated impacts The project as proposed will reduce the overall impacts from canal excavation and slip number authorized in the existing Major CAMA Permit. The construction of the docks, finger piers and loading platforms will result in ±4,916 ft2 of shaded impact in the newly excavated canal system. Under the current 4 square foot per linear foot of shoreline allowed by rule, the applicant is allowed a maximum of 57,056 ft2. Approximately 5,994 ft2 of Coastal Wetlands will be shaded by the proposed boardwalks. The installation of the bulkheads will result in ±950 ft2 of fill in newly created Public Trust Area and Estuarine Water AEC. The project as proposed will result in the disturbance of ±788,436 ft2 (18.1 acres) of uplands as a result of the development activities. Approximately 25 acres of the site is upland area while the remaining land consists of Coastal and 404 wetlands. The Natural Resource Conservation Service Soil Survey for Dare County has mapped the upland soils on the site to consist primarily of Baymeade Fine Sand (BaC), John Loamy Sand (JoA) and Icaria Loamy Sand (IcA). This area was previously used for a dredge disposal site and several feet of dredged fill remain on much of the site. The site varies in elevation, with the majority of the area between 3.0 and 9.0 feet above mean sea level (NAVD 1988). The property is within a flood zone of "AE-8". Several canals extend into the site from the Croatan Sound, including two navigable canals that extend to the highland portions of the site. A Dare County well is located at the north end of the site near NC 345. Vegetation on the upland portions of the site consists of recently established native vegetation. The CAMA permit currently includes 46 boat slips for the project, which is currently approved for development of a 46-lot subdivision. Proposed Development: The University of North Carolina has purchased the site for the development of the Coastal Studies Institute. The project will consist of a new research and administration building, 6 boats slips and service building for research operations, as well as short term housing for a variety of students and researchers expected to utilize the facility. Water service will be supplied by Dare County and an on-site wastewater treatment and disposal system will facilitate septic needs for the project. Portions of the site will be developed in accordance with LEED criteria. Canal: Excavation of the canal is proposed to reduce the new canal length from approximately 2,350 feet to approximately 1,000 feet. This reduction will eliminate 1,350 feet of previously approved "dead end" canal. The portion of canal that will remain within the project will connect the two existing canals ("A" & "B") that extend into the site. Initial excavation of portions of this canal are expected to be performed this summer, but will not include connections to the existing canal. These connections will be performed during times compliant with permit conditions. The shoreline of both the marina as well as an additional loading area adjacent to the research building will be stabilized with bulkheads. The majority of the rest of the shoreline being created by this work will be stabilized with a vegetated shoreline "mitigation area". These are proposed using finger piers and mooring pilings. Development will also include a 24' wide boat ramp with adjacent 4' and 8' wide docks, a septic pump out facility (to be connected to the on-site sewage treatment and disposal system), an above ground stationary or mobile fueling facility, and a jib crane for unloading larger items. An 8' wide dock will be used to access 3 finger piers as well as a 422 sf platform adjacent to the larger boat slip. The provided access dock is 8' wide to allow for small transport vehicles ("gators"). Loading Area: A secondary loading area is also planned adjacent to the research facility in order to expedite the transport of sensitive equipment and other materials from the research facility to the vessels. A F and 8' wide raised wooden access are provided to accommodate pedestrian and "gators" to the loading area. A adjacent covered platform is also provided to provide a protected location to stage loading/unloading as well as an educational viewing area. Kayak Launch: A kayak launch is provided on the east side of the research building. The launch will provide storage of kayaks as well as a lower platform to launch from. A six-foot raised wooden access is provided. The primary use of this area is for localized research as well as educational tours that the facility is expected to accommodate. All elements of the launch and access that cross existing wetlands will be 3' above grade (bottom of deck boards). Upland "Hammock" Access: The site includes a remote upland area to the east. A 6' wide raised wooden walkway (3' minimum above the existing grade) is planned in order to provide access to this unique feature. Coastal Studies Institute - Research, (primarily post graduate) Education with short and long term temporary living facilties (dormatories), marine service and docking facilties for research c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type of equipment and where it is to be stored. Initial canal excavation will occur within the "rough grading" activities this summer, and will not include connection to the existing canals. Exacavtion is anticipated to be performed with an excavator, and material will be placed on site for rough grading of building pads and transitions. Bulkheading will also be installed during the rough grading operarions. With the exception of the required "free statnding" bulkhead at the connection to the sout canal, bulkheading can be performed within excavated areas. The boat ramp, docks and wakways will be installed during the main building package, expected to begin in November of 2010 and continue for 18 months. Equipment and materials will be stored in upland areas adjacent to the proposed improvements. d. List all development activities you propose. The project includes a 56,800 sf research building, 9,700 sf marine services building, 3,500 sf boat storage building and two 6,591 sf residential dormitory/bunkhouse buildings. Each of the residential buildings consists of three enclosed living areas connecting by exterior walkways and include both dormitory rooms for long term users and bunkhouse rooms for short term users. The site improvements will include an access roadway connecting to NC 345 and a watermain extension to the new Dare County waterline currently under design along NC 345. The site will be served by an on-site wastewater treatment system that is being design to achieve reuse quality effluent for reuse within the select toilet facilities or disposal into a high rate infiltration pond. Canal excavation will also and provide docking facilities for 6 boats, boat ramp, pumpout facility (connected to WWTP) and loading docking, fueling facility, loading crane and staging areas to facilitate a wide variety of marine research operations. Stormwater will be managed in rainwater cisterns, created stormwater wetlands (4) and bioretention areas (3), which are being designed to meet state stormwater requirements for the coastal county for areas that are adjacent to SA waters. The research facility and portions of the site will be LEED certified. e. NOW, THEREFORE, under the provisions of the Code, the following conditional use is granted to UNC-Coastal Studies Institute for a university campus subject to such conditions as are hereinafter set out: CONDITIONAL USE: A university campus consisting of coastal research and educational facilities, residential dormitories, and marine service facility. The campus will be located on Roanoke Island in the Skyco area. A site plan depicting the group development is identified as Appendix B, attached to this Permit. CONDITIONS: 1. The university campus shall consist of a 56,800 sq. ft. research building, a 9,700 sq ft. marine services building, a 3,500 sq ft. boat storage building, two 6,591 sq ft. residential dormitory/bunkhouse buildings, 6 boats slips, 98 parking spaces, and associated infrastructure improvements. 2. The site will be serviced by central water from the Dare County water system and an on-site wastewater treatment system. The building height shall be as established for university campuses in the R-1 residential district. 4. The existing vegetation on the site shall remain intact to serve as a buffer along the northern property line adjacent to the residential uses. This vegetation shall be supplemented with additional plantings as needed to provide an effective buffer along this property line. 5. Any changes to the site plan shall be reviewed by the Dare County Planning Department. An as-built survey of the improvements shall be submitted to the Planning Department upon completion of the improvements. 6. It is understood that all other terms and provisions of the Code shall remain in full force and effect except as herein lawfully permitted; 7. A violation of this Permit shall be a violation of the Code punishable as therein provided, and shall automatically void Permit; 8. I East Carolina University ADDITIONAL CONDITIONS Excavation Permit # 24-08 Page 2 of .5 2) In order to protect hivenil.e shrimp and f nfish populations, no excavation within anv Public Trust Area of Environmental Concern, or within areas designated as Coastal Wetlands shall be permitted between February 15 and June 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries and the Division of Water Quality. 3) In accordance with commitments made by the permittee in the attached application, an earthen plug shall be left between the upland basin and the existing canals and a 24-hour period after completion of excavation shall elapse prior to plug removal to prevent unnecessary siltation into the adjacent water body. In addition, prior to removal of the earthen plugs, a turbidity curtain shall be employed immediately downstream to reduce potential impacts of any sedimentation or turbidity issues. The turbidity curtains shall remain in place for 24-hours after the earthen plug removal. 4) Unless specifically altered herein, the dimensions of the areas to be excavated shall not exceed the areas that are expressly and specifically set forth in the attached permit application and workplan drawings. Any proposal to change the areas to be excavated shall require permit modification. 5) Excavation shall not exceed -5 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. 6) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. Spoil Disposal 7) All spoil material shall be located at least 30 feet from the normal water level and/or 30 feet from the edge of the upland basin/canal. 8) All excavated materials shall be confined above the normal water level and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. Shoreline Stabilization 9) The alignment of the authorized bulkhead associated with the upland basin shall adhere to the alignment depicted on the attached workplan drawings. Any proposal to alter this alignment may require permit modification. Contact a Division of Coastal Management representative at (252) 264-3901 for this determination. 10) Low profile, free standing bulkheads shall be constructed along the edges of the areas of the excavated connection of Canals A and B to the upland basin. The alignment of the authorized low profile bulkheads shall be staked by the permittee and approved by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of excavation of the connections to the canals. 'East Carolina University ADDITIONAL CONDITIONS Permit # 24-08 Page 3 of 5 11) The bulkhead associated with the upland basin shall be constructed prior to any backfilling activities. No backfilling of the low profile bulkheads is authorized. 12) All bulkheads shall be structurally tight so as to prevent seepage of backfill materials through the structure. 13) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles or other suitable materials approved by Division personnel. 14) The backfill material shall be clean and free of any pollutants except in trace quantities. 15) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Upland Marina 16) In accordance with commitments made by the permittee, no vessels shall be moored outside the areas indicated on the attached workplan drawings. To ensure compliance with this condition, signs indicating prohibited docking areas shall be posted along the canal shoreline outside of the defined docking areas. 17) Unless specifically altered herein, this permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the attached permit application and workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this marina facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 18) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 19) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal facility shall be installed, easily accessible, operable, and maintained for the life of the marina. 20) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on-site with a representative of the Division to ensure that the required pumpout facility is in place and operable. 21) The marina shall display a sign showing the location of the on-site pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier(s). 22) All portions of the access piers located over Coastal Wetlands shall not exceed a width of 6 ft. and shall be elevated a minimum of 3 feet above the marsh substrate as measured from the bottom of the decking. 23) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. East Carolina University Permit # 24-08 Page 4 of 5 ADDITIONAL CONDITIONS 24) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity %xithout having it transferred to a third party. 25) This permit authorizes a maximum of 43 boat slips. At no time shall more than 43 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. Sedimentation and Erosion Control NOTE: The N.C. Division of land Quality approved this project under Permit No. DARE-2008-005 on 12/7/07. 26) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Stormwater Management 27) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW7071108 on 12/10/07. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. Shellfishine Closure 28) The waters adjacent to the permitted project are classified as "Open" to the harvest of shellfish. The construction and/or operation of the authorized marina and subdivision shall not directly result in a permanent closure of any waters currently classified as "Open" and that support a significant shellfish resource. Any such permanent closure directly attributable to the authorized facility shall require that the permittee undertake remedial actions to remedy the situation. Such actions may include, but are not limited to, a removal of any unauthorized slips or mitigative measures to reduce or eliminate the cause(s) of the closure. Mitigation 29) This project will impact 0.07 acres of wetlands. In accordance with requirements of the US Army Corps of Engineers, the permittee shall make payment to the North Carolina Ecosystem Enhancement Program (NC EEP) in the amount determined by the NC EEP, sufficient to perform the restoration of 0.14-acres of Coastal Wetlands in the Pasquotank River Basin, Cataloging Unit 03010205. NOTE: Coastal Wetlands are defined in 15A NCAC 07H.0205(a) of the Rules of the Coastal Resources Commission. All mitigation for impacts to Coastal Wetlands should adhere to these criteria, including the list of applicable Coastal Wetland species. East Carolina University Permit # 24-08 Page 5 of 5 ADDITIONAL CONDITIONS 30) Construction within jurisdictional areas on the property shall begin only after the permittee has made full payment to the NC EEP and provided a copy of the payment documentation to the Corps of Engineers and DCM, and the NC EEP has provided written confirmation to the Corps of Engineers and DCM that it agrees to accept responsibility for the mitigation work required, in compliance with the MOU between the North Carolina Department of Environment and Natural Resources and the United States Army Corps of Engineers, Wilmington District, dated November 4, 1998. General 31) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 32) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately from the wetlands upon completion of construction in the associated areas. 33) Due to the fact that property lines extend across the areas to be excavated, should lots 21 through 38 be sold prior to the onset of any excavation, it shall be necessary for the new lot owner to became a co- applicant if this permit. 34) The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3642 (DWQ Project No. 061909 vs 2), which was issued on 12/20/07. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. NOTE: The applicant is encouraged to provide copies of the permit, including applicable permit drawings, to all future lot owners to ensure they are aware of the unique dockage configuration and all permit conditions. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of'the normal water level.
