Please find attached information we are providing you to modify our existing 401 Water Quality Certification and Authorization Certificate for the Neuse River Buffer Protection Rules dated January 31, 2006. We are requesting modifications to this permit to eliminate the construction of a level spreader adjacent to Lot 28 as shown on the attached plans. The attached construction drawings indicate a proposed swale across the top of the retaining wall from Lots 20 to 28. This would have created a concentrated discharge point beside Lot 28 where a riprap pad would have been provided and then the proposed double level spreader as shown on the plans. The swale was never constructed at the top of the retaining wall and, therefore, there is not a concentrated point of discharge as depicted in the design drawings. We have provided pictures of the site conditions in this area which demonstrate that there is no point source of stormwater discharge. Also included are pictures showing the vegetation of the buffer area and visual evidence that diffuse flow is accomplished. We believe that there would be more environmental consequences with the clearing and grading required to construct the level spreader than leaving the conditions as they currently exist. The Town of Cary has said that we need to obtain approval from your office to eliminate this level spreader. Furthermore, we believe that this request should be granted per Chapter 8 of the NCDENR Stormwater BMP Manual which states that "concentrated runoff from new ditches or manmade conveyances shall be converted to diffuse flow before the runoff enters Zone 2 of the riparian buffer" and that "periodic corrective action to restore diffuse flow shall be taken if necessary to impede the formation of erosion gullies." As stated previously we do not have concentrated runoff, there are no erosion gullies and diffuse flow is accomplished. An additional modification consists of relocation of a greenway storm drainage pipe crossing shown at Lot 15. Due to field conditions, this crossing was moved to the west behind Lot 16. The discharge is not directly adjacent to the riparian buffer. Diffuse flow is achieved as depicted in the attached photographs and a level spreader was not needed. We have also reviewed the calculations for this crossing and the results are attached. The Q10 for this pie is 0.5 cfs which results in a V10 of 1.72 ft/sec and confirms expected site conditions as shown in the photographs.
