Dear Mr. Basinger,
In reply to the Compliance Evaluation Inspection dated September 22, 2020 concerning standby/backup
power for our WWTP. Our Town Council meeting for October was held Monday, Oct. 12tf'. The purchase
of the generator was an item on the agenda. Maintenance Director, Mark McDaniel provided the Board
with three quotes he had obtained. This is all public records, and we can provide you copies for your
records if you would like. The Board agreed that the size of the KW's quoted for the generator were
substantially different. The Town received a $30,000 search grant earlier this year concerning a new
WWTP. We are currently waiting on a PER from an engineer concerning the new WWTP project. Once
the Board votes on the exact wastewater plant, we are going to install we will then determine the right
size generator needed for that plant.
Timeline as follows:
1. Waiting on PER from Engineer on WWTP project
2. Board will be voting soon on the exact wastewater plant to install
3. The correct size of the generator will be determined and purchased

Dear Mr. Dyer:
Enclosed is a copy of the Compliance Evaluation Inspection for the inspection conducted
at the subject facility on September 10, 2020, by Ori Tuvia. The cooperation of James Davis during
the site visit was much appreciated. Please advise the staff involved with this NPDES Permit by
forwarding a copy of the enclosed report.
Overall the facility has shown signs of improvement since the last inspection. However,
the facility still has no source of standby/backup power. This is a continuing violation that was
noted on the previous two inspection reports (dated February 14, 2019, and December 20, 2017).
Part 11, Section C (7) of NPDES Permit No.NC0065242 dated September 1, 2018, states: Power
Failures "The Permittee is responsible for maintaining adequate safeguards to prevent the
discharge of untreated or inadequately treated wastewater during power failures by means of
alternate power sources, standby generators or retention of inadequately treated effluent".
Please be advised that this correspondence is being issued as a Notice of Violation with a
Recommendation for Enforcement Action. You are requested to respond to this Notice, in writing,
regarding the above noted violation, within fifteen (15) days of receipt. The response should
include a timeline for the installation of an appropriate standby power source. Failure to respond
and7Tor fdlure to resolve�the violations could subject you to further action by the Division of Water
Resources. Please be advised that pursuant to G.S. 143-215.6A, a civil penalty of not more than

twenty-five thousand dollars ($25,000.00) per day, per violation and may be assessed against any
person who violates or fails to act in accordance with the terms, conditions, or requirements of any
permit issued pursuant to G.S. 143-215.1.
