application:
Land use in the vicinity of the project is medium intensity residential, agricultural, and forested. Conditions within the
construction easement on site are predominantly forested, with some open field area. The condition of wetlands, streams,
and/or open waters within or adjacent to the project site, as identified by F&R and verified by DWQ, are described in
Attachment 1. Wetlands within the project site include herbaceous and/or forested areas, and roadside swales. Streams
within the project site include Poplar Creek and numerous unnamed tributaries of Poplar Creek. Open water features
include several in-line beaver ponds/swamps.

3d. Explain the purpose of the proposed project:
The Upper Poplar Creek Sanitary Sewer Extension will allow the City to abandon two existing City pump stations as part
of the initial project and provide the ability to extend additional gravity main (from the interceptor) in the future to two other
existing City pump stations (thereby abandoning those two stations also). By collecting flow at the existing pump stations
and diverting flow to the new interceptor the project will remove antiquated infrastructure from the City's sewer collection
system in the Mingo Creek sewer basin where capacity is very limited. The proposed improvements will also provide for
safe and reliable sewer service to the Poplar Creek sewer basin customers.
3e. Describe the overall project in detail, including the type of equipment to be used:
The Upper Poplar Creek Sanitary Sewer Extension project includes construction of approximately 20,000 LF of 8"
through 30" gravity sewer, a new vacuum primed wastewater pumping station at Poole Road and approximately 4,300 LF
of 16" sewer force main. The gravity sewer interceptor will extend northward along Poplar Creek from the proposed
pump station at Poole Road to the north side of the railroad right-of-way in Knightdale. Two 8" sewer mains will be
extended from the interceptor to existing City of Raleigh wastewater pump stations. The mains will connect to the
existing sewer system and divert flow to the interceptor, thereby allowing the two existing wastewater pump stations
(Flowers Street PS and Wil-Ros PS) to be abandoned. The force main will extend southward along Poplar Creek from
Poole Road to Grasshopper Road where the line will be connected to the existing 16" sewer force main serving the Town
of Wendell and Wendell Falls Community. All activities will be performed in accordance with Best Management Practices
and the NC Sediment and Erosion Control Planning and Design Manual. Typical trenching, earth moving, and lifting
equipment (i.e., backhoe, trackhoe, crane, etc.) will be used for the installation of the utility line.

Avoidance and minimization of indirect and cumulative impacts was a primary concern recognized throughout project
planning, resulting in development and consideration of numerous alignments. Additional details are contained in the attached
engineers table of replies to NCDWQ pre-submittal meeting comments.

Specific measures incorporated to minimize impacts in the proposed design include 1) widths of construction corridor
narrowed to 40' for gravity sewer; 2) near-perpendicular crossings of channels where avoidance was not practical (e.g.,
directional drilling cost prohibitive, use of previously impacted existing easement not possible; installation of sewer line above
or below existing culverts not practical); 3) stabilization of excavated areas with stone or rip-rap, geotextile fabric, timber mats
at crossings, and anti-seep collars; 4) compliance with conditions of WQC #3699; 5) compliance with NCDENR Erosion and
Sedimentation Control requirements through approval of plan through Land Quality; and 6) appropriate best management
practices.

description of the responses to your comments contained in your letter of February 19, 2010
and Tyler Crumbly's comments in his letter of March 10, 2010.
1. Mr. Chris Windley of McKim & Creed has provided a response to your comments and
these are included as a separate attachment titled "Upper Poplar Creek Sanitary Sewer
Extension Response Letter to USACE and DWQ Comments".
2. The Town of Knightdale has provided supplementary information to the PCN Application
section F. Supplementary Information- 313 in an attachment titled "City of Raleigh Poplar
Creek Sewer-Request for Information".
3. In response to clarification of method of stream crossing, Mr. Aaron Brower of the City
of Raleigh has engaged in Dialogue with Amy Chapman of NCDWQ. His response is
included as an email titled "Stream Crossings".
4. In addressing your comments, stream, buffer, and wetland impacts have been
recalculated within the impact plans. We have depicted these calculations on the plans
and the PCN. Consequently, the mitigation credit letters we have previously provided do
not reflect the recalculated mitigation requirements. We have submitted new credit
requests to Earth Mark Mitigation and the NCEEP and will forward those letters
immediately upon receipt.

contractually commit to the purchase of 40,942 Riparian Buffer Mitigation Credits/Unites from the Forrest
Creek Riparian Buffer Mitigation Bank under a separate agreement.
The Forrest Creek Stream Mitigation Bank attests to the fact that 40,942 Riparian Buffer Mitigation
Credits/Unites are available for immediate transfer from its Official Bank Credit Ledger at the time of this
document and as of this date places 40.942 creditslunits into "no-sale"- reservation status under the name of
the project on this document.
40,942 credits/units will remain in reservation status until State 401 permits are issued to the applicant and
payment in full is received, according to separate agreement, from the applicant resulting in the issuance of a
Transfer Certificate by the bank acknowledging that the applicant has fully secured credits from the bank and
the banker has accepted full responsibility for the mitigation obligation requiring the credits/units.
The Banker will issue the Certificate of Transfer, within ten (10) days of receipt of the balance of the Purchase
Price. Banker shall provide to Applicant the Transfer Certificate debiting credits from the Bank Official Credit
Ledger showing the permit number and the resource type secured by the applicant, and will send a copy of
the Transfer Certificate with an updated Official Credit Ledger to regulatory agencies showing the proper
documentation.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will
be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these
agencies to determine if payment to the NCEEP will be approved. You must also comply with all other state, federal or local

Response Letter to USACE and DWQ Comments
Dear Mr. Colson:
Items 1 - 4 below are responses to the request for additional information from
NCDENR DWQ (letter attached) submitted to the City of Raleigh on February
19, 2010 by Cyndi Karoly.
1. McKim & Creed has reviewed the stream and buffer impacts labeled on
the plans as exhibit 18. The sewer alignment is positioned at the
particular location shown in order to minimize the depth of the future
gravity sewer and to minimize the impact to the land owner's usable land
space. In order to completely avoid the small branch leg of the main
stream and the associated buffer the easement would have to be moved
uphill approximately 70 feet. This would impact the property owner and
increase the depth of the future gravity sewer contained within the
permanent easement. City of Raleigh proposes to keep the easement and
sewer alignment in the current location to minimize the gravity sewer
depth and impact to the land owner. The impact to this branch's buffers
will be temporary except where the 10' wide maintenance corridor will
cross.
2. Condition No. 20 of the General Certification 3699 pertains to permanent,
maintained access corridors. The City of Raleigh only plans to maintain a
10' wide permanent access corridor within the permanent easement. The
permanent access corridor has been calculated as a permanent impact
where it crosses buffers and wetlands and these impacts have been
included on the updated impact maps.

3. This project will take two existing City of Raleigh owned pump stations
offline (abandon) and allow for abandonment of other City owned pump
stations in the future. This sewer will also collect flow diverted from
surrounding sewer basins in the future to alleviate capacity concerns in
those basins. Any development within the Poplar Creek basin that
connects to the proposed sewer will be required to follow the conditions
of the Town of Knightdale's Unified Development Ordinance (UDO).
The Town of Knightdale is an NPDES Phase 11 Stormwater community
and their UDO requires developments disturbing more than one acre to
provide stormwater controls for water quality and quantity. With these
requirements in place it is not anticipated that development connecting to
the sewer line in the future will pose water quality concerns. Please see
the attached letter from the Town of Knightdale mailed to Cyndi Karoly
on March 16, 2010 that discusses the Town's requirements.
4. The impact maps have been updated to provide for different hatch
patterns discerning permanent (compensatory) impacts from temporary
impacts. The impact tables in the PCN should correspond with the
impact notations at each jurisdictional feature in the exhibits.
The following paragraphs provide a response to the remarks provided by the US
Army Corp of Engineers (letter attached) to the City of Raleigh in regards to the
initial PCN application submittal.
The check dams indicated on the construction plans are temporary erosion
control measures intended to collect and contain sediment during construction.
Once the channels containing the check dams are restored and stabilized and
Land Quality has authorized removal of the temporary erosion control measures,
the dams will be removed. The rip-rap indicated to be installed in the channels
on the construction plans are intended to provide permanent bank stabilization
as required by the erosion and sedimentation plan design calculations. The rip-
rap will only be installed on the banks and will remain in place. The rip-rap will
not be placed in the bottom of the channels. The City of Raleigh operations and
maintenance staff will utilize temporary crossing mats if the channels have to be
forded (see attached email from Aaron Brower dated May 19, 2010). The
wetland/stream/buffer impact maps have been revised to indicate permanent
impact at the streams containing rip-rap.

Post-construction access for maintenance of the wastewater collection system
will be accomplished by the planned 10' wide permanent maintenance corridor
within the City's permanent utility easement. The easement will be accessed
from state roadways where the sewer line crosses these roads and from the
permanent access easement on the north end of the sewer at the railroad.
Updated impact maps have been enclosed that display individual permanent
and temporary impact areas in correspondence with the updated PCN.
In addition to the responses provided above we have enclosed an updated
stream channel rip-rap detail that shows the rip-rap placement limited to the
banks as the City discussed with DWQ.
If you need any additional information in order to make the revised PCN and
additional information submittal complete please let us know. As you are aware,
the City of Raleigh PUD is very anxious to get approval from USACE and DWQ
so that their contractor can begin work without further delay.

On February 10, 2010, the Division of Water Quality (DWQ) received your application dated February 8,
2010, to fill or otherwise impact 1.326 acres of 4041vetland (0.270 acres permanent impact and 1,056
acres temporary impact), 598 linear feet of perennial stream (temporary impact), and 36,455 square feet
of Zone I Neuse River basin protected riparian buffers and 33,955 square feet of Zone 2 Neuse River
basin protected riparian buffers to construct the proposed sewer system project at the site, The DWQ has
determined that your application was incomplete and/or provided inaccurate information as discussed
below, The DWQ will require additional information in order to process your application to impact
protected wetlands and/or streams on the subject property. Therefore, unless Nye receive five copies of the
additional information requested below, we will place this project on hold as incomplete until we receive
this additional information. If we do not receive the requested information, your project will be formally
returned as incomplete. Please provide the following information so that we may continue to review your
project.

The Town of Knightdale, as a utility merger community with the City of Raleigh, has received your
request for more information dated 2/19/2010 in association with the Poplar Creek Sewer Project. In
the PCN application requested to be returned, box 3a for "Will this project (based on reasonably
anticipated future impacts) result in additional development, which could impact nearby downstream
water quality?" has been checked "no". In support of this determination, the Town offers that we are
an NPDES Phase 11 community and require stonnwater controls on all construction projects disturbing

This email is to confirm that I have spoken with our acting construction superintendent, whom is responsible for
easement clearing/maintenance, and he confirmed that the City owns and uses timber bridge mats to cross small
streams such as those that we are crossing perpendicularly on the Upper Poplar Creek project. With this
information known, the City does not desire to install a rip rap ford in the bottom of the stream as originally
proposed the PCN application. It is our desire to use rip rap as streambank stabilization for the side slopes as we
have done on many other recent projects with DWQ and Corps approval. Please move forward with revising the
PCN and resubmitting to the agencies so that we can move forward with this project asap. Thank you and please
let me know if you have any further questions or concerns.
