The upstream location is approx. 1,000 feet above the discharge point. The downstream sampling point is approx. 50 feet below the discharge point. I have discussed these locations with our regional office and with our modeling group. Thermal modeling of the discharge will not be necessary and the distance below the discharge should allow for mixing with the stream water under low flow conditions (most critical times for thermal impacts). We are of the opinion that the sampling locations that you propose are acceptable to the Division for purposes of the General Permit If you have any questions or need further information, please contact me at 733-5083 ext 548. Klimek, P.E., Director Division of Water Quality Reference is made to your recent request for rescission of the subject NPDES General Permit. In your letter you state that the specific activity associated with the permit has been eliminated at the site and that similar, but modified activities should be covered under your permit NCG0300039. In accordance with your request, NPDES General Permit NCG500359 is rescinded, effective immediately. Future discharges of potable water from fire truck pump testing will be subject to the terms of permit NCG0300039. Please be advised that this permit rescission is based wholly upon your statement that the activities which would require general permit coverage at the site have ceased or been eliminated. Division staff has not visited the site to obtain independent verification. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. Freightliner was issued a separate stormwater permit for American. LaFrance, COC No. NCG500359, for the discharge of potable city water ised for testing fire truck crater pumpers. American La -France is currently relocating the majority of its operations to South Carolina and no longer conducts this particular test. However, a refurbishing building will remain on -site anc. discharges ap��roximately 5,000 gallons of city water from fire trucks !-2 times per month. There is no direct discharge of this potable city water into Freightliner's stormwater outfall OF-001.. In fact, the majority of this water doesn't reach the ou.tfall, as it is absorbed by a large grassed area. Because this disch.arge is uncontaminated potable city water, Freightliner requests the rescission of COC N'CG500359 and that this discharge be covered under Freightliner's exiting COC NCG 030039. Kamya Vice President Power Plant Development & Construction Department 919 546-7428 By transmittal dated February 17, 2000, Carolina Power & Light Company (CP&L) requested coverage under General Permit NCG500000 for the initial phase (Phase 1) of the subject project. On June 16, 2000, CP&L was issued the. certificate of coverage (NCG500582) for the project. CP&L is hereby proposing to relocate the discharge point and to modify the configuration of the conveyance of wastewater to the relocated discharge point. Relocation of Proposed Discharge Point The previously proposed discharge point was to Second Creek at a location southeast of the project site. CP&L is now proposing to relocate the discharge point to a tributary to Second Creek which is located at the eastern side of the site. A location map is attached. Rowan County CT Revised NOI Page 1 Wastewater Discharge Confi urg ation The inlet evaporative cooling water and other small water sources such as equipment condensate and drains will be introduced into a section of the permanent site storm water drainage system. This drainage system section conveys to a sediment retention basin that will be a permanent storm water retention basin once the construction on the site is finished and the site is stabilized. The inlet evaporative cooling water will represent only a small fraction of the hydraulic retention capacity of this basin so there should be no displacement of any needed storm water retention volume in the basin. The retention basin is not considered to be treatment for the inlet evaporative cooling water since no treatment is needed. The storm water retention basin will discharge into a small swale which will conduct storm water and any residual evaporative cooling water to the tributary to Second Creek. The remaining scope of the project remains basically the same as the information presented in the February 17, 2000 submittal. CP&L is herewith resubmitting a revised NOI with supplemental information. CP&L requests that coverage under General Permit NCG500000 be issued to reflect our proposed revisions. Additionally, we request authorization to construct any wastewater conveyances and appurtenances associated with this project.
