Daily Maximum, Exceeded 001 Effluent Copper, Total (as Cu) (01042) 7/31/2019 7.88 16 Monthly Average Exceeded A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of North Carolina General Statute (G.S.) 143-215.1 and the facility's NPDES WW Permit. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed'against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. If you -wish to provide additional information regarding the noted violation, request technical assistance, or -discuss overall compliance please respond--in-writing within ten (10) business days after receipt of this Notice- -A review of your response will be considered along with any information provided on the submitted Monitoring . Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. If no response is received in this Office within the 10-day period, a civil penalty assessment may be prepared. Remedial actions should have already been taken to correct this problem and prevent further occurrences in the future. The Division of Water Resources may pursue enforcement action for this and any additional violations of State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems, and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by Consent. Reminder: Pursuant to Permit Condition 6 in Section E, the Permittee is required to verbally notify the Regional Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may be required within 5 days if directed by Division staff. Increased suspended solids (turbidity) increase the water temperature, thus reducing the amount of oxygen in water harming aquatic life. They also reduce the amount of natural sunlight that penetrates through the water, further decreasing oxygen production and photosynthesis. This matter relates to exceedances of the discharge limits established in the NPDES Permit for Total Suspended Solids (TSS) and Total Residual Chlorine (TRC) which occurred during the months of August and October of 2014 from the waste treatment system at the Tuckertown Water Treatment Plant. The City is of the opinion that the root cause of the exceedances noted above is the result of detrimental changes in the initial raw water quality of the surface water that was being treated for drinking water purposes by the facility. The higher solids level in the raw water generated a higher rate of alum sludge production from the drinking water treatment process that eventually lead to a accelerated build up of the alum sludge blanket in the holding lagoons for the waste treatment system at the facility. The volume of the sludge that accumulated interfered with the clarification process of the supernatant that was being discharged due to the shortened residence time. The City is also of the opinion that the exceedance of the TRC is also attributable to the shortened residence time in the lagoons. As the sludge build up was initially noted, plant personnel responded by increasing the frequency of the usual pump and haul process for the removal of sludge with disposal at the Long Creek WWTP. Initially, the City believed that the increased frequency of the pump and haul could maintain the proper sludge blanket depth in the lagoons thereby maintaining permit compliance. However, as the raw quality continued to be more challenging with respect to maintaining compliance with drinking water standards, the alum sludge production continued to increase and it became apparent to the City that the pump and haul removal process would not be sufficient to maintain NPDES compliance. At that point the City entered into a service agreement with a disposal contractor for a more aggressive sludge removal process. The disposal contractor expedited a mass removal and dewatering process for a significant portion of the sludge that had accumulated in the lagoons. Approximately 300 tons of dewatered solids generated from the mass removal were disposed of in an appropriate solid waste disposal facility. The service agreement also provides for a regular and an process for mass removal and disposal of the sludge from the lagoons over the next three (3) years. The initial disposal cost to the City in the first year was $65,000. The cost of the service contact over the next three (3) years is expected to be approximately $30,000 per year. Since the initiation of the above actions, the facility has been compliant with the limits contained in the NPDES permit. Tuckertown personnel have also increased their observations and monitoring of the sludge levels in the lagoons and have plans in place to activate the disposal contractor in case of future raw water quality challenges. In addition to the above actions, the City has initiated an engineering study of the alum sludge production and disposal alternatives for the facility. This study is being performed by LKC Engineering and is expected to be completed in the near future. The City will use this study to identify possible improvements and alternatives for alum sludge treatment and disposal to better ensure future compliance with the NPDES permit as seasonal changes in the raw water quality occur. The City is also exploring options to move the location of the raw water intake to obtain a more stable raw water quality that is less susceptible to seasonal changes. With the above information being presented, it is respectfully requested that NCDENR consider in the determination of the enforcement actions regarding this violation the corrective actions that the City has taken, the associated corrective action costs to bring the facility back into compliance, and the planning actions the City is currently taking to better ensure future compliance. There were some maps attached showing a sludge disposal area but no specific narrative summarizing the operation or other permits that were required to conduct land application. Please provide a sludge plan narrative, including how the solids are removed and disposed of from the settling lagoons. . 2) There was no simple wastewater process flow diagram, there was a narrative . There was a schematic for the potable treatment process. We need a simple wastewater diagram staring with the WTP filters and tracing the backwash/rinse wastewater flow through each component (decant tanks, clarifier, lagoons, effluent meter, effluent dechlorination) to the outfall. Please confirm the source of backwash water, it appears to be the finished drinking water (chemical applied fluoride, zinc phosphate, post chlorination, caustic, but no ammonia sources). Please include the complete chemical name for all chemical additions and the capacity and number of each treatment components. Be sure to indicate were flows are pumped from one component to the next. Record Keeping Section With reference to the self -monitoring data Discharge Monitoring Reports (DMR) we have implemented a review of all DMRs. All record files have been organized by month. The Assistant Superintendent has implemented a quality review process on all reports. She has instructed all plant personnel which prepare the DMRs, in the proper quality control process for records. The duties and responsibilities of the Operator in Responsible Charge (ORC) have been reviewed with the individual in question to insure that compliance standards are understood. The Chief Water Plant Operator, as the ORC of the water plant, has taken over the wastewater oversight and will be working very closely with the ORC (wastewater) on this to. insure compliance. 2. Backup ORC The appointment of a Backup ORC (wastewater) at the TTWTP was an oversight due to extensive personnel turbulence at this facility over the past year. This situation will be resolved as soon as possible either through the eligible appointment of onsite personnel or the hiring of a contractor. We anticipate the appointment of a Backup (ORC) by August 2010. a N 3. Lagoons The Tuckertown Water Treatment Plant has two settling lagoons for waste sludge. One lagoon has been recently cleaned. The second lagoon is scheduled to be cleaned during the month of May 2010. We sincerely hope that these explanations will suffice. The City of Albemarle has always strived to insure compliance with all Division of Water Quality rules and regulations. We thoroughly understand the consequences of non compliance. A site visit was scheduled for Thursday June 23, 2009 with Mr. Jerry Cotton and Ms. Holly Overcash. NCO075701 Tucker Town Hwy 49 Water Treatment Plant This facility is marginally compliant with the permit limits. This is partially due to the volume of sludge in the lagoons which results in reduced detention time the wastewater has to equalize in the lagoons. Public Water Supply has issued a 60-day schedule to clean out the additional basins in the water treatment plant. Mr. Cotton is working on a plan to remove the alum sludge from the lagoons and apply this material to the 8 acres on site under permit number WQ000759. This should begin in July 2009. I have been working with the Aquifer Protection Section to determine data required to apply this material to all available land at Hwy 49 rather than the 8 acres. Two forms are .required to modify the existing permit, form DRS-08-07, which is for the distribution of material to a non -dedicated site and the source certification form RSCA 070807 describing the nature of the material. If the material is hauled to the landfill this year this will be needed in the future to manage the alum sludge removed from the basins. Sodium hydroxide is to be added to the discharge of filter rewash to raise the pH above 6.0 for compliance with the permit limit. Sodium bisulfite is already added for dechlorination of the discharge. Once these modifications are made this facility should be in compliance. This water plant was built in 1947 and was designed with a direct discharge to the stream. Currently the discharge is divided between the sewer and the stream, measurement of actual flow to the stream is an estimate. Maintaining all the flow on the sewer side of the manhole is impossible and some of the discharge is overflowing to the creek. In the future this discharge will need to be settled prior.to discharge to remove filter solids or the sewer will have to be enlarged to handle all the flow. Sending alum sludge to the wastewater treatment plant serves no benefit to the WWTP. Handling the material just adds extra solids to process all the way through the wastewater treatment plant. The Hwy 52 water plant needs solids handling separation and storage much like that at Tucker Town for future compliance of this discharge, the material could then be transferred to Tucker Town fields for final disposal. I will offer my assistance to the City and your engineer as to determining the best approach to take in rehabilitation of the system. The City has to, be committed to the repairs necessary to preserve the treatment facility that they have already invested in. I have included forms to change the alum sludge permit and to change the contact name on the discharge permits and the land application permit. Authorization is hereby granted for the construction of modifications to the existing Tuckertown WTP with discharge of treated wastewater into Yadkin River in the Yadkin River Basin. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of T 15A:8G.0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III and IV facility at least daily, excluding weekends and holidays, must properly manage the facility, must document daily operation and maintenance of the facility, and must comply with all other conditions of T15A:8G.0202. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the facility. During the construction of the proposed additions/modifications, the permittee shall continue to properly maintain and operate the existing wastewater treatment facilities at all times, and in such a manner, as necessary to comply with the effluent limits specified in the NPDES Permit. You are reminded that it is mandatory for the project to be constructed in accordance with the North Carolina Sedimentation Pollution Control Act, and, when applicable, the North Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractor's responsibilities shall be in complying with these Acts.
