A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of North Carolina General
Statute (G.S.) 143-215.1 and the facility's NPDES WW Permit. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars ($25,000.00) may be assessed'against any person who violates or
fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.

If you -wish to provide additional information regarding the noted violation, request technical assistance, or
-discuss overall compliance please respond--in-writing within ten (10) business days after receipt of this Notice- -A
review of your response will be considered along with any information provided on the submitted Monitoring .
Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. If no
response is received in this Office within the 10-day period, a civil penalty assessment may be
prepared.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems,
and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by
Consent.
Reminder: Pursuant to Permit Condition 6 in Section E, the Permittee is required to verbally notify the Regional
Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at
the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may
be required within 5 days if directed by Division staff. Prior notice should be given for anticipated or
potential problems due to planned maintenance activities, taking units off-line, etc.

Dear NPDES Permittee:
The U.S. Environmental Protection Agency (EPA) recently published the National Pollutant Discharge
Elimination System (NPDES) Electronic Reporting Rule. The rule requires NPDES regulated facilities to
report information electronically, instead of filing written paper reports. The rule does not change what
information is required from facilities. It only changes the method by which information is provided (i.e.,
electronic rather than paper -based).
EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their
key milestones, are:
• Phase 1—Starting on December 21, 2016, regulated entities that are required to submit Discharge
Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently
reporting your DIVIR data electronically using eDMR, then you simply need to continue reporting
in the same way as you are now. The key change is that, starting on December 21, 2016,
electronic reporting of DMRs will be required, instead of voluntary.
• Phase 2 —Starting on December 21, 2020, regulated entities that are required to submit.certain
other NPDES reports will begin submitting these reports electronically. Reports covered in the
second phase include Notices of Intent to discharge in compliance with an NPDES general permit,
Sewer Overflow/Bypass Event Reports, and a number of other NPDES program reports.

Sixty Days' Notice of Minor Modification of the Subject NPDES Permit
The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic
reporting requirements into NPDES permits beginning December 21, 2015. Under the new rule, the
electronic reporting process supersedes the paper reporting process outlined in your existing permit. To
bring your permit up-to-date with the new reporting requirements, this letter serves to notify you that in
sixty days your NPDES permit will be modified to incorporate the new electronic reporting requirements.
The modification will require electronic reporting in place of paper -based reporting. Electronic reporting
will be required beginning as indicated above for Phases 1 and 2 reporting. Please attach the enclosed
NPDES Permit Standard Conditions Partili—Addendum to your permit. This permit modification becomes
effective on August 1, 2016.
All other terms and conditions in the original permit remain unchanged and in full effect. This
modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency.

petition for a contested case with the Office of Administrative Hearings within thirty (30) days following
receipt of this letter. This petition must conform to the requirements of Chapter 150B of the North

Office Drawer 11666, Raleigh, North Carolina 27604. If you do not file a petition within the required time,

Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems,
and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by
Consent.
Reminder: Pursuant to Permit Condition 6 in Section E, the Permittee is required to verbally notify the Regional
Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at
the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may
be required within 5 days if directed by Division staff. Prior notice should be given for anticipated or
potential problems due to planned maintenance activities, taking units off-line, etc.

This letter transmits a Notice of Violation and assessment of civil penalty in the amount of
$596.97 ($450 civil penalty + $146.97 enforcement costs) against the City of Albemarle.
This assessment is based upon the following facts: A review has been conducted of the self -
monitoring data reported for October 2014. This review has shown the subj ect facility to be in
violation of the discharge limitations found in NPDES Permit No. NC0075701. The violations are
summarized in Attachment A to this letter.
Based upon the above facts, I conclude as a matter of law that the City of Albemarle violated
the terms, conditions, or requirements of NPDES Permit No. NCO075701 and North Carolina General
Statute (G.S.) 143-215.1(a)(6) in the manner and extent shown in Attachment A. A civil penalty may
be assessed in accordance with the maximums established by G.S. 143-215.6A(a)(2).
Based upon the above findings of fact and conclusions of law, and in accordance with authority
provided by the Secretary of the Department of Environment and Natural Resources and the Director
of the Division of Water Resources, I, Michael L. Parker, Regional Supervisor for the Mooresville

Pursuant to G.S. 143-215.6A(c), in determining the amount of the penalty I have taken into account the
Findings of Fact and Conclusions of Law and the factors set forth at G.S. 143B-282.1(b), which are:
(1) The degree and extent of harm to the natural resources of the State, to the public health, or to
private. property resulting from the violations;
(2) The duration and gravity of the violations;
(3) The effect on ground or surface water quantity or quality or on air quality;
(4) The cost of rectifying the damage;
(5) The amount of money saved by noncompliance;
(6) Whether the violations were committed willfully or intentionally;
(7) The prior record of the violator in complying or failing to comply with programs over which
the Environmental Management Commission has regulatory authority; and
(8) The cost to the State of the enforcement procedures.
Within thirty days of receipt of this notice, you must do one of the following:

Please be aware that a request for remission is limited to consideration of the five factors listed
below as they may relate to the reasonableness of the amount of the penalty assessed. Requesting
remission is not the proper procedure for contesting whether the violation(s) occurred or the accuracy
of any of the factual statements contained in the civil penalty assessment document. Because a
remission request forecloses the option of an administrative hearing, such a request must be
accompanied by a waiver of your right to an administrative hearing and a stipulation that no factual or'

The TSS monthly average permit limit was exceeded by 2,860% during the month of October 2014.

The effect on the receiving stream is unknown. Increased suspended solids (turbidity) increase the
water temperature, thus reducing the amount of oxygen in water harming aquatic life. They also
reduce the amount of natural sunlight that penetrates through the water, further decreasing- oxygen
production and photosynthesis. In addition, high levels of solids can kill fish by clogging their gills,
lowering their resistance to disease, and smothering their eggs.

The effect on the receiving stream is unknown. Increased suspended solids (turbidity) increase the
water temperature, thus reducing the amount of oxygen in water harming aquatic life. They also
reduce the amount of natural sunlight that penetrates through the water, further decreasing oxygen
production and photosynthesis. In addition, high levels of solids can kill fish by clogging their gills,
lowering their resistance to disease, and smothering their eggs.
4) The cost of rectifying the damage;
The cost is unknown.

Dear Mr. Parker,
This purpose of this letter is to provide additional information for consideration in the above referenced matters in
accordance with your letters dated March 23, 2015 and received by the City of Albemarle on March 30, 2014. This
matter relates to exceedances of the discharge limits established in the NPDES Permit for Total Suspended Solids
(TSS) and Total Residual Chlorine (TRC) which occurred during the months of August and October of 2014 from the
waste treatment system at the Tuckertown Water Treatment Plant.
The City is of the opinion that the root cause of the exceedances noted above is the result of detrimental changes in
the initial raw water quality of the surface water that was being treated for drinking water purposes by the facility.
The higher solids level in the raw water generated a higher rate of alum sludge production from the drinking water
treatment process that eventually lead to a accelerated build up of the alum sludge blanket in the holding lagoons
for the waste treatment system at the facility. The volume of the sludge that accumulated interfered with the
clarification process of the supernatant that was being discharged due to the shortened residence time. The City is
also of the opinion that the exceedance of the TRC is also attributable to the shortened residence time in the
lagoons.
As the sludge build up was initially noted, plant personnel responded by increasing the frequency of the usual pump
and haul process for the removal of sludge with disposal at the Long Creek WWTP. Initially, the City believed that
the increased frequency of the pump and haul could maintain the proper sludge blanket depth in the lagoons
thereby maintaining permit compliance. However, as the raw quality continued to be more challenging with respect
to maintaining compliance with drinking water standards, the alum sludge production continued to increase and it
became apparent to the City that the pump and haul removal process would not be sufficient to maintain NPDES
compliance.

At that point the City entered into a service agreement with a disposal contractor for a more aggressive sludge
removal process. The disposal contractor expedited a mass removal and dewatering process for a significant portion
of the sludge that had accumulated in the lagoons. Approximately 300 tons of dewatered solids generated from the
mass removal were disposed of in an appropriate solid waste disposal facility. The service agreement also provides
for a regular and an process for mass removal and disposal of the sludge from the lagoons over the next
three (3) years. The initial disposal cost to the City in the first year was $65,000. The cost of the service contact over
the next three (3) years is expected to be approximately $30,000 per year. Since the initiation of the above actions,
the facility has been compliant with the limits contained in the NPDES permit. Tuckertown personnel have also
increased their observations and monitoring of the sludge levels in the lagoons and have plans in place to activate
the disposal contractor in case of future raw water quality challenges.
In addition to the above actions, the City has initiated an engineering study of the alum sludge production and
disposal alternatives for the facility. This study is being performed by LKC Engineering and is expected to be
completed in the near future. The City will use this study to identify possible improvements and alternatives for
alum sludge treatment and disposal to better ensure future compliance with the NPDES permit as seasonal changes
in the raw water quality occur. The City is also exploring options to move the location of the raw water intake to
obtain a more stable raw water quality that is less susceptible to seasonal changes.
With the above information being presented, it is respectfully requested that NCDENR consider in the
determination of the enforcement actions regarding this violation the corrective actions that the City has taken,
the associated corrective action costs to bring the facility back into compliance, and the planning actions the City is
currently taking to better ensure future compliance.

This letter is in response to the referenced NOD we recently received. The Tuckertown Water
Treatment Plant experienced unusually high raw water pH on January 7, 2014 causing
elevated levels of effluent pH beginning January 8, 2014. We believe this was due to an
algae bloom we were experiencing. hi order to compensate for the high levels of pH, the
amount of caustic used was lowered and PH levels returned to normal by January 10, 2014.
The plant has been operating under the permit limits since that time.

After additional review of the July 2013 renewal application, several details the Division needs for documentation
purposes were either missing or not clearly defined. We are requesting the following information:
1) The application did not include a narrative for how sludge/solids are disposed of. There were some maps
attached showing a sludge disposal area but no specific narrative summarizing the operation or other permits
that were required to conduct land application. Please provide a sludge plan narrative, including how the solids
are removed and disposed of from the settling lagoons. .
2) There was no simple wastewater process flow diagram, there was a narrative . There was a schematic for the
potable treatment process. We need a simple wastewater diagram staring with the WTP filters and tracing the
backwash/rinse wastewater flow through each component (decant tanks, clarifier, lagoons, effluent meter,
effluent dechlorination) to the outfall. Please confirm the source of backwash water, it appears to be the
finished drinking water (chemical applied fluoride, zinc phosphate, post chlorination, caustic, but no ammonia

A letter of request for an Authorization to Construct was received April 27, 2010, by the
Division of Water Quality (Division), and final plans and specifications for the subject project
have been reviewed and found to be satisfactory. Authorization is hereby granted for the
construction of modifications to the existing Water Treatment Plant, with discharge of
0.020 MGD of treated wastewater into an Unnamed tributary into Tuckertown Reservoir in the
Yadkin -Pee Dee River Basin.
This authorization results in no increase in design or permitted capacity and is awarded
for the construction of the following specific modifications:
Modification to existing chemical feed systems to allow for a flow -paced feed of
Caustic and Sodium Bisulfate, relocation of feed points and replacement of a
rectangular weir with a v-notch weir in conformity with the project plans, `' "
specifications, and other supporting data subsequently filed and approved by the
Department of Environment and Natural Resources.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of
NPDES Permit No. NCO075701 issued February 26, 2009, and shall be subject to revocation
unless the wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified in Permit No. NC0075701.
The sludge generated from these treatment facilities must be disposed of in accordance
with G.S..143-215.1 and in a manner approved by the Division.

In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by the Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.
The Mooresville Regional Office, telephone number [phone], shall be notified at
least forty-eight (48) hours in advance of operation of the installed facilities so that an on site
inspection can be made. ' Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.
Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted facility
has been installed in accordance with the NPDES Permit, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to: Construction Grants & Loans,
DWQ/DENR, 1633 Mail Service Center, Raleigh, NC 27699-1633.
Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be. in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of the type and. grade at
least equivalent to or greater than the classification assigned to the wastewater treatment
facilities by the Certification Commission.
The Permittee must also employ a certified back-up operator of the appropriate type and
grade to comply with the conditions of T15A:8G.0202. The ORC of the facility must visit each
Class I facility at least weekly and each Class H, III and N facility at least daily, excluding
weekends and holidays, must properly manage the facility, must document daily operation and
maintenance of the facility, and must comply with all other conditions of T15A:8G.0202.
A copy of the approved plans and specifications shall be maintained on file by the
Permittee for the life of the facility.
During the construction of the proposed additions/modifications, the permittee shall
continue to properly maintain and operate the existing wastewater treatment facilities at all times,
and in such a manner, as necessary to comply with the effluent limits specified in the NPDES
Permit.
You are reminded that it is mandatory for the project to be constructed in accordance
with the North Carolina Sedimentation Pollution Control Act, and when applicable, the North
Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractor's
responsibilities shall be in complying with these Acts.
Prior to entering into any contract(s) for construction, the recipient must have obtained all
applicable permits from the State.

Failure to abide by the requirements contained in this Authorization to Construct may
subject the Permittee to an enforcement action by the Division in accordance with North
Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from
complying with any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction.

This letter is in response to the compliance evaluation inspection report conducted at this facility
on March 11, 2010. The following items were implemented to mitigate the shortcomings identified
in the Compliance Inspection Report:
1. Record Keeping Section With reference to the self -monitoring data Discharge Monitoring Reports (DMR) we have
implemented a review of all DMRs. All record files have been organized by month. The
Assistant Superintendent has implemented a quality review process on all reports. She has
instructed all plant personnel which prepare the DMRs, in the proper quality control process
for records. The duties and responsibilities of the Operator in Responsible Charge (ORC)
have been reviewed with the individual in question to insure that compliance standards are
understood. The Chief Water Plant Operator, as the ORC of the water plant, has taken over
the wastewater oversight and will be working very closely with the ORC (wastewater) on this
to. insure compliance.
2. Backup ORC
The appointment of a Backup ORC (wastewater) at the TTWTP was an oversight due to
extensive personnel turbulence at this facility over the past year. This situation will be
resolved as soon as possible either through the eligible appointment of onsite personnel or the
hiring of a contractor. We anticipate the appointment of a Backup (ORC) by August 2010.

3. Lagoons
The Tuckertown Water Treatment Plant has two settling lagoons for waste sludge. One
lagoon has been recently cleaned. The second lagoon is scheduled to be cleaned during the
month of May 2010.
We sincerely hope that these explanations will suffice. The City of Albemarle has always strived
to insure compliance with all Division of Water Quality rules and regulations. We thoroughly
understand the consequences of non compliance. The City of Albemarle will make every effort to
insure the changes that were addressed in this letter, be carried out.

Enclosed is a copy of the Compliance Evaluation Inspection Report for the inspections
conducted at the subject facility on March 11, 2010 by Mr. Wes Bell of this Office. Please
advise the facility's Operator -in -Responsible Charge of our findings by forwarding a copy of the
enclosed report.
This report is being issued as a Notice of Violation (NOV) to the City for the monitoring
violations and the failures to designate a Backup ORC and maintain the permit -required
documentation. These are all violations of the subject NPDES Permit and North Carolina
General Statute (G.S.) 143-215.1, as detailed in the Record Keeping section of the attached
report. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand
dollars ($25,000.00) per violation, per day, may be assessed against any person who violates or
fails to act in accordance with the terms, conditions, or requirements of any permit issued
pursuant to G.S. 143-215.1.
It is requested that a written response be submitted to this Office by April 20, 2010,
addressing the above -noted violations in the attached report. In responding to the violations,
please address your comments to the attention of Mrs. Marcia Allocco.

Comment: The facility's records were not organized and not readily available prior to
April 09. Discharge Monitoring Reports (DMRs) were reviewed for the period January
09 through December 09. An effluent pH violation was reported in April 09. The
Division has separately addressed this limit violation by the issuance of an NOV. No
flow, effluent settleable solids and total residual chlorine, and upstream/downstream
turbidities were reported during the weeks of 3/1/09 - 3/7/09 and 3/8/09 - 3/14/09.
Non -numerical results (ND) were reported on the DMRs. In addition, effluent total
residual chlorine (TRC) values were being reported below the lowest standard verified
(15 ug/L) on TRC meter (annual calibration/verification curve). See Summary Section

A technical assistance request was received on June 17, 2009 from Mr. Jerry Cotton current ORC in
regards to the discharges of the Water Treatment Plants at both Hwy 49 and Hwy 52. A site visit was scheduled
for Thursday June 23, 2009 with Mr. Jerry Cotton and Ms. Holly Overcash.
NCO075701 Tucker Town Hwy 49 Water Treatment Plant
This facility is marginally compliant with the permit limits. This is partially due to the volume of sludge
in the lagoons which results in reduced detention time the wastewater has to equalize in the lagoons. Public
Water Supply has issued a 60-day schedule to clean out the additional basins in the water treatment plant. Mr.
Cotton is working on a plan to remove the alum sludge from the lagoons and apply this material to the 8 acres
on site under permit number WQ000759. This should begin in July 2009. I have been working with the
Aquifer Protection Section to determine data required to apply this material to all available land at Hwy 49
rather than the 8 acres. Two forms are .required to modify the existing permit, form DRS-08-07, which is for the
distribution of material to a non -dedicated site and the source certification form RSCA 070807 describing the
nature of the material. If the material is hauled to the landfill this year this will be needed in the future to
manage the alum sludge removed from the basins. Sodium hydroxide is to be added to the discharge of filter
rewash to raise the pH above 6.0 for compliance with the permit limit. Sodium bisulfite is already added for
dechlorination of the discharge. Once these modifications are made this facility should be in compliance.

Flow from this facility is intermittent and instantaneous; this total is to be recorded during each
discharge and the duration of each discharge for permit compliance. This water plant was built in 1947 and was
designed with a direct discharge to the stream. Currently the discharge is divided between the sewer and the
stream, measurement of actual flow to the stream is an estimate. Maintaining all the flow on the sewer side of
the manhole is impossible and some of the discharge is overflowing to the creek. In the future this discharge
will need to be settled prior.to discharge to remove filter solids or the sewer will have to be enlarged to handle
all the flow. Sending alum sludge to the wastewater treatment plant serves no benefit to the WWTP. Handling
the material just adds extra solids to process all the way through the wastewater treatment plant. The Hwy 52
water plant needs solids handling separation and storage much like that at Tucker Town for future compliance
of this discharge, the material could then be transferred to Tucker Town fields for final disposal.
I will offer my assistance to the City and your engineer as to determining the best approach to take in
rehabilitation of the system. The City has to, be committed to the repairs necessary to preserve the treatment
facility that they have already invested in. I have included forms to change the alum sludge permit and to
change the contact name on the discharge permits and the land application permit.

Dear Mr. Allen:
A fast track application for Authorization to Construct dechlorination facilities was
received on January 29, 2007, by the Division. Authorization is hereby granted for the
construction of modifications to the existing Tuckertown WTP with discharge of treated
wastewater into Yadkin River in the Yadkin River Basin.

This authorization results in no increase in design or permitted capacity and is awarded
for the construction of the following specific modifications:
Installation of a dechlorination system utilizing sodium bisulfite pursuant to the
fast track application received on January 29, 2007, and in conformity with the
Minimum Design Criteria for bechlorination Facilities.
This Authorization to Construct is issued in accordance with Part III, Paragraph,A of
NPDES Permit No. NCO075701 issued May 1, 2005, and shall be subject to revocation unless
the wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified in Permit No. N6075701.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by this Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.
The Mooresville Regional Office, telephone number [phone], shall be notified at

inspection can be made. Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.
Pursuant to 15A NCAC 2H .0140, upon completion of construction and prior to operation of
these permitted facilities, the completed Engineering Certification form attached to this permit shall be
submitted to the address provided on the form.
Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at least
equivalent to or greater than the classification assigned to the wastewater treatment facilities by
the Certification Commission.
The Permittee must also employ a certified back-up operator of the appropriate type and
grade to comply with the conditions of T 15A:8G.0202. The ORC of the facility must visit each
Class I facility at least weekly and each Class II, III and IV facility at least daily, excluding
weekends and holidays, must properly manage the facility, must document daily operation and
maintenance of the facility, and must comply with all other conditions of T15A:8G.0202.
A copy of the approved plans and specifications shall be maintained on file by the
Permittee for the life of the facility.
During the construction of the proposed additions/modifications, the permittee shall
continue to properly maintain and operate the existing wastewater treatment facilities at all times,
and in such a manner, as necessary to comply with the effluent limits specified in the NPDES
Permit.
You are reminded that it is mandatory for the project to be constructed in accordance
with the North Carolina Sedimentation Pollution Control Act, and, when applicable, the North
Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractor's
responsibilities shall be in complying with these Acts.
Failure to abide by the requirements contained in this Authorization to Construct may
subject the Permittee to an enforcement action by the Division of Water Quality in accordance
with North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from
complying with any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction.

Your NPDES permit expires on January 31, 2004. Federal (40 CFR 122.41) and North Carolina (15A NCAC
2H.0105(e)) regulations require that permit renewal applications must be filed at least 180 days prior to expiration of the current
permit. If you have already mailed your renewal, application, you may disregard this notice.
To satisfy this requirement, your renewal package must be sent to the,Division postmarked no later than August 4,
2003. Failure to request renewal of the permit by this date may result in a civil assessment of at least $500.00. Larger penalties
may be assessed depending upon the delinquency of the request.
If any wastewater discharge will occur after January 31, 2004, the current permit must be renewed. Discharge of
wastewater without a valid permit would violate North Carolina General Statute 143-215.1; unpermitted discharges of wastewater
may result in assessment of civil penalties of up to $25,000 per day.
If all wastewater discharge has ceased at your facility and you wish to rescind this permit, contact Bob Sledge of the
Division's Compliance Enforcement Unit at [phone], extension 547. You may also contact the Mooresville Regional
Office at [phone] to begin the rescission process.

The following items are REQUIRED for all renewal packages:
❑ A cover letter requesting renewal of the permit and documenting any changes at the facility since
issuance of the last permit. Submit one signed original and two copies.
❑ The completed application form (copy attached), signed by the permittee or an Authorized
Representative. Submit one signed original and two copies.
❑ If an Authorized Representative (such as a consulting engineer or environmental consultant) prepares
the renewal package, written documentation must be provided showing the authority delegated to any
such Authorized Representative (see Part II.B.1 Lb of the existing NPDES permit).
❑ A narrative description of the sludge management plan for the facility. Describe how sludge (or other
solids) generated during wastewater treatment are handled and disposed. If your facility has no such
plan (or the permitted facility does not generate any solids), explain this in writing. Submit one signed
original and two copies.
The..following items must be submitted by any Municipal, or Industrial facilities. discharging
t2rocess wastewater:
Industrial facilities classified as Primary Industries (see Appendices A-D to Title 40 of.the Code of Federal
Regulations, Part 122) and ALL Municipal facilities with a permitted flow ? 1.0 MGD must submit a
Priority Pollutant Analysis (PPA) in accordance with 40 CFR Part 122.21.
The above requirement does NOT apply to privately owned facilities'treatang 100%
domestic wastewater, or facilities which discharge non process wastewater (cooling
water, filter backwash, etc.)
PLEASE NOTE:
Due to a change in fees effective January 1, 1999, there is no renewal fee required with your
application package.
