PROJECT SUMMARY: The applicant is proposing to rebuild the docks that support an existing
82-slip marina.

9. Narrative Description:
The property is located in Oriental at 415 Whittaker Point Road, Pamlico County. The parcel is a
0.5-acre tract adjacent to Whittaker Creek. This site is currently developed with a commercial
marina known as Whittaker Creek Yacht Harbor. The adjacent and nearby properties are
residential and similar marina operations. Whittaker Creek Yacht Harbor is under dual ownership,
having multiple riparian property areas.
The average elevation of the high ground of the parcel is +6' above normal water level.
Vegetation on this particular tract mainly consists of lawn grasses, but also includes Coastal
Wetlands along the shoreline. This tract has approximately 900' of shoreline along Whittaker
Creek. Immediate offshore water depths adjacent to the tract along Whittaker Creek range from
about -1.8' to -6.4' nwl. The subaqueous substrate is firm without shell.
This parcel is situated on a point of land as a peninsula. The waterbody is about 500 feet across at
this location on one side, and approximately 296' across on the other side. These waters are
classified as a Primary Nursery Area and there is no submerged aquatic vegetation present. This
area is closed to shellfish harvest and is classified as SA, High Quality Waters. There is not a
Federal Channel in the immediate vicinity of the project area.
10. Proposed Development:
The applicant wishes to reconstruct the existing docks at the community marina adjacent to
Whittaker Creek. The existing wooden docks will be replaced and include concrete decking. The
marina is located on a parcel at the end of Whittaker Point Road. The majority of the high ground
is under the separate ownership of a full service marina. The applicant has two easements along
the shoreline adjacent to their two docking facilities.
The marina will have 82 slips. They will be supported by two main docking facilities, a west dock
and an east dock. These slips can support vessels up to 60' long. These boat slips will be in an
average -4.0' nwl depth.
The east dock is the larger facility. It will support 59 formalized boat slips. The proposed access
pier will be 9' wide and 61' long. At the terminus of the pier, there will be another pier access,
parallel to the shoreline, 800' long and 9' wide. There will be 28 finger piers extending from the
platform. These finger piers will be 4' wide and will vary from 6' to 50' in length.
The west dock will support the remaining 23 formalized boat slips. The access pier will be 9' wide
and 63' long. It will connect to a pier running parallel to the shoreline, which will be 424' long
and 9' wide. There will be 13 finger piers 4' wide extending from the platform varying in lengths
from 12' up to 50'. There will be a total of 333 tie pilings associated with both of the marina's
docks.

11. Anticipated Impacts:
The marina docks will encroach into adjacent riparian properties. The marina will shade 90 square
feet of Coastal Wetlands. The east dock will extend 128' waterward into a 500' wide tributary.
The west dock will extend 103' into a 296' wide tributary. The waters of Whittaker Creek are
classified as SA Waters and are designated as a Primary Nursery Area. Water depths in the slips
average -5.5' nwl. These waters are closed to the harvest of shellfish and there are no beds of
submerged aquatic vegetation present.

SUBJECT: Comments and Recommendations - CAMA Major Permit - Whittaker Creek Yacht
Owners Association, Pamlico County
The following is my assessment and consequent recommendations of the above referenced
proposal: This proposal involves the shading of 90 ft2 of Coastal Wetlands and usurps 194,200
ft2 of Public Trust Waters. The waters of Whittaker Creek are closed to shellfish harvest. This
waterbody is a Primary Nursery Area. This proposal will not pose a hazard to navigation. The
west dock extends beyond % of the width of the waterbody, but will not exceed the established
pier head line nor 1/3 of the waterbody width.
This marina was built prior to the effective dates of the CRC rules. These structures will
encroach into adjacent riparian property corridors and is inconsistent with current CRC rules,
thus making it "non-conforming development." Non-conforming development is addressed
under 15A NCAC 07J .0211. The marina will serve the same use. The structures will not be
significantly enlarged beyond the existing dimensions, and it appears that there are no practical
alternatives for replacing the structures to provide the same or similar benefits in compliance
with current rules.

The rebuilt docks will continue to act as wet slip storage for sailboats and large motor boats. The dock at this time is
deteriorating and in some areas is unsafe for pedestrains.

of equipment and where it is to be stored.
The existing wooden dock and existing pilings will be removed using excavaters on barges. Dump trucks will be used to
remove the debris created by the demolition of the existing dock. New pilings will be installed using an excavator with a
vibrating head located on a barge. Wooden supports will be added and concrete decking will be installed.

Whittaker Creek Yacht Owners Association Rebuild

B. Prescott Marine Construction, LLC has been contacted by Mr. John Vinci, member of
the Whittaker Creek Yacht Owner's Association, to obtain the Major CAMA Permit
required to rebuild the docking facility owned by the association. The docking facility in
question is within the Whittaker Creek Yacht Harbor owned by Mr. Knute Byshiem. The
marina and its docking facilities have been in place for over 45 years. The association
was formed in 1989.
Current Conditions
The current dock is a "patch" work of wooden sections that have been repaired over the
many years the dock has been in use. The dock is uneven with many warped boards and
rusted hardware. The dock is not aligned properly and deck widths span from 7 feet wide
to 9 feet wide in some places. There are many creosote pilings in use along with broken
pilings that have been paired with one or more pilings in an attempt to add strength to the
failing components.
Proposed Dock
The proposed dock will utilize concrete slabs for the decking along with 2.5 CCA treated
pilings. The dock will remain in the same footprint on landward side, however the
decking will increase from the current variable widths to a uniform 9 ft. wide. Because
of the strength of the concrete, decking will be laid on 10' centers versus the normal 8'
centers with a wooden dock. Pilings, most of which are creosote pilings installed in the
mid 1960's and are considered environmentally detrimental, will be removed and
replaced with new environmentally responsible 2.5 CCA treated pilings.

Demolition
Current wooden dock, finger piers and pilings will be removed with the aid of barges and
excavators. Inside pilings, those closest to the shoreline and outside mooring piles will
remain in place to act as "property lines" or markers for crew members. New pilings will
be installed in the same hole from which the original piling was pulled, with the
exception of less pilings needed for the concrete dock construction. This will allow
workers to install new pilings in the same footprint on the landward side as the previous
pilings. As stated before the only exceptions will be that of the increase in decking width

and the adjustment of mooring piles due to the increase. The finger piers and other r.
mooring pilings will be replaced within the same dimensions. Extensive surveying of
each dock component (dock, pilings, finger piers) has been completed and a surveyor.will
be on site to correct any misalignments. Slips will be re constructed with the same
dimensions as they are currently.
Debris will be loaded in dump trucks and will be removed from the project site. Some
2.5 CCA treated pilings will be salvaged and recycled in the rebuild.
Re-Construction
Pilings will be set by using the vibratory method, vibrating them into the submerged earth
with an excavator outfitted with a vibrating head. New Finger piers will be constructed
using pressure treated yellow pine lumber. Concrete Slabs will be used for the decking.
