It was anticipated that this project could be performed with authorization under NWP 3 with no written authorization required. You received a courtesy notification and confirmed the applicability of NWP 3 for this project via e-mail on June 3, 2019. However, due to the recent listing of wood stork in Sampson County by the U.S. Fish and Wildlife Service (USFWS), the MANLAA concurrence by the USFWS (attached) now requires the Department to obtain written approval. As noted in the original courtesy notification letter, a preliminary jurisdictional determination (PJD) was acquired on this project on June 28, 2017 and the project was assigned Action Id No. SAW- 2017-01255. Impacts associated with the bridge include 0.005 acres of (beneficial) wetland excavation to tie the approach fill removal to the adjacent natural wetland floodplain elevation. The only utility relocation associated with this project is a Centurylink fiber optic line, however there are no impacts associate with this utility relocation. The attached permit drawings and utility plans provide more details on the proposed impacts and are the same permit drawings and impacts that were in the original courtesy notification. Traffic will use an offsite detour during the construction of this project. Required Regulatory approvals: Section 404 (USACE) permit: NCDOT request written approval for NWP 3 as required for the described activities above. Section 401 (DWR) permit: Written approval for these activities is not required from N.C. Division of Water Resources. The conditions of WQC 4132 will be included in the permit packet for the contract and adhered to during construction. We would appreciate your timely assistance with this request. The following response is provided in accordance with Section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). Currently, there are no records of wood storks occurring in the vicinity of the projects. It is understood that the projects will let in February 2021, thus they will be well underway prior to the wood stork nesting season of April 15 – July 15. Wood storks are very uncommon in Sampson and Duplin Counties and even less so prior to breeding season. Given the low probability of the species occurring at the locations and the limited scope of the action, the Service concurs with your conclusion that the proposed actions may affect, but are not likely to adversely the wood stork. We remind you that obligations under Section 7 consultation must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered in this review; (2) this action is subsequently modified in a manner that was not considered in this review; or (3) a new species is listed or critical habitat determined that may be affected by this identified action. The existing bridge consists of 1 @ 18' - 8", 1 @ 17' - 5", and 1 @ 17' - 4" Reinforced Concrete Deck on Timber Joists and Timber Piles and is to be replaced with a 1 @ 35' - 0" 21" Cored Slab, 1 @ 55'-0" 24" Cored Slab, Bridge (90' total length, 33' total width) at the same location. The proposed bridge does not contain deck drains. Storm water from the bridge and approaches will be collected by a storm drain inlets on the left and right side of the road and discharge into Class "I" Rip-Rap pads located in the northwest quadrant at -L- 17+94 LT and the northeast quadrant at -L- 18+17 RT. The existing roadside ditch in the southeast quadrant will be impacted by the proposed slope stakes. The proposed ditch will continue to flow from south to north and outlet into wetlands, matching existing drainage patterns. The proposed ditch in the southeast quadrant will be a Special Lateral base ditch with a 4' base and 3:1 front and back slopes.
