SPECIAL ORDER BY CONSENT

Pursuant to provisions of North Carolina General Statutes 143-215.2
and 143-215.67, this Special Order by Consent is made and entered
into by the City of Statesville, hereafter referred to as the City,
and the North Carolina Environmental Management Commission, an agency
of the State of North Carolina created by NCGS 143B-282, and
hereafter referred to as the Commission:
1. The City and the Commission hereby stipulate the following:
(a) That the City holds North Carolina NPDES Permit No.
NCO031836 for operation of an existing wastewater treatment
works and making an outlet therefrom for treated wastewater to
Fourth Creek, Class C waters of this State, in the Yadkin River
Basin, but is unable to comply with the final effluent
limitations for Chronic Toxicity as set forth in the Permit.
Based on predictions derived from effluent concentrations, the
water quality stream standards for cyanide, nickel, and cadmium
and the stream action levels for copper and possibly silver are
occasionally compromised. Compliance will require the
removal/reduction of toxic effluent constituents and effective
control of industrial discharges to the treatment works through
the City's approved and implemented industrial pretreatment
program and through the local sewer use ordinance. Compliance
may also require the planning and construction of additional
treatment works.
(b) That noncompliance with final effluent limitations
constitutes causing and contributing to pollution of the waters
of this State named above, and the City is within the
jurisdiction of the Commission as set forth in NCGS Chapter 143,
Article 21.
(c) That the City desires to cause or allow the discharge of
up to 300,000 gpd of additional domestic strength wastewater to
the treatment works, and that the discharge of such additional
wastewater from the treatment works to the waters of this State
will not result in any significant degradation in their quality
or in the quality of any water ultimately receiving such
discharge.

(d) That the subject noncompliance will be addressed through
currently funded local programs, but should compliance require
planning and construction of additional treatment works, funding
will be secured for such; and that all corrective activities
will result in adequate treatment of wastewater presently being
discharged and the additional wastewater desired to be
discharged, to the extent that the City will be able to comply
with the final Permit effluent limitations.
(e) That the City hereby waives its right to an administrative
hearing authorized by NCGS 143-215.2 on the terms of this
Special Order by Consent, and also hereby waives its right to
seek judicial review of this Special Order by Consent as
provided in NCGS 143-215.5.
2. The City, desiring to comply with conditions of the permit
identified in paragraph l(a) above, does hereby agree to do and
perform all of the following:
(a) Provide the Mooresville Regional Office, located at 919
North Main Street, Post Office Box 950, Mooresville, North
Carolina 28115, with a monthly report of all flow added under
this Order by no later than the fifteenth (15) day of the
following month.
(b) Continue current program to identify probable constituents
causative in effluent toxicity, and effectively control such
constituents, through either industrial user permits or local
sewer use ordinance or by additional treatment, to the extent
required to insure that stream standards and action levels will
not be compromised and compliance with the final effluent limit
for Chronic Toxicity will be consistent. Provide the
Mooresville Regional Office with a monthly progress report
relative to these activities by no later than the fifteenth (15)
day of each month.
(c) Complete quarterly full -range chronic toxicity tests to
allow for a judgement of progress in decreasing effluent
toxicity to an acceptable level. The full -range tests will
begin in January, 1991 and continue in the months of April,
July, October and January, or until such time as test passes at
an effluent concentration of 36% (or other relevant effluent
concentration expressed as percentage, should either the
permitted discharge flow or statistical stream flow change) are
consistent, as defined in paragraph 2(f)(5), and test passes at
46% can be predicted to be consistent. See Attachments A, B,
and E.

(d) Submit the results of any additional whole effluent
toxicity tests to the Division as per Part III, Condition I of
the current NPDES Permit, or Attachment C or E of this Order, by
no later than the thirtieth (30) day following the month in
which the tests are conducted.
(e) Meet and comply with all terms and conditions of the
permit except those effluent limitations identified in paragraph
1(a) above. See Attachments A and B for monitoring requirements
and effluent limitations. The permittee may also be required to
monitor for other parameters as deemed necessary by the Director
in future permits or Administrative letters.
(f) Upon execution of this Order, undertake the following
activities in accordance with the indicated time schedule:
1) By no later than October 31, 1990 implement and submit
to the Division's Mooresville Regional Office and Aquatic
Toxicology Unit (Post Office Box 27687, Raleigh, North
Carolina 27611-7687) a Toxicity Reduction Evaluation Plan
which is consistent with the established procedures and
protocols contained in Toxicity Reduction Evaluation
Protocol for Municipal Wastewater Treatment Plants
(EPA/600/2-88/062).
2. Conduct a comprehensive waste survey of all industrial
users. After verifying accuracy and completeness, submit
to the Pretreatment Unit (Post Office Box 27687, Raleigh,
North Carolina 27611-7687), with a copy to the Mooresville
Regional Office, for review by no later than November 30,
1990.
3. Conduct necessary sampling to preclude, or reduce to a
minimum, use of default data, and complete a new headworks
analysis. Submit analysis to the Pretreatment Unit (Post
Office Box 27687, Raleigh, North Carolina 27611-7687), with
a copy forwarded to the Mooresville Regional Office, by no
later than November 30, 1990.
4. If planning and construction are required, by no later
than July 1, 1991 submit to the Mooresville Regional Office
either:
a. A copy of the compliance/construction schedule and
authorization to construct issued to relevant industrial
dischargers by the City, which will result in the City's
compliance with final effluent limits by the date
identified in paragraph 2(f)(5); or

b. A comprehensive construction schedule relative to
activities at the subject facility, with activity
completion dates, which will result in the City's
compliance with final effluent limits by the date
identified in paragraph 2(f)(5). Accompanying the
submittal will be a request to modify this Order to include
the construction schedule.
Concurrent with the above submittals will be the complete
and adequate submittal to the Permits and Engineering Unit
(Post Office Box 27687, Raleigh, North Carolina 27611-7687)
of all applications, requests, and processing fees
necessary to facilitate the approval of the construction
activities.
5. Achieve compliance with the final effluent limits by no
later than June 30. 1992.
Compliance with Chronic Toxicity limit is defined as having
completed two (2) consecutive quarters of monthly toxicity
tests, with at least four (4) passes and no two (2)
consecutive failures in the second quarter.
(g) During the time in which this Special Order by Consent
is effective, comply with the interim effluent limitations
contained in Attachments A and B. The following reflects
only the limitations that have been modified from NPDES
requirements by this Order.

(i) No later than 14 calendar days after any date or time
identified for accomplishment of any activity listed in 2(f)
above, submit to the Regional Office written notice of
compliance or noncompliance therewith. In the case of
noncompliance, the notice shall include a statement of the
reason(s) for noncompliance, remedial action(s) taken, and a
statement identifying the extent to which subsequent dates or
times for accomplishment of listed activities may be affected.
(j) Enforce the water conservation provisions of the State
Building Code as it applies to new residential construction
(Volume 11, Chapter IV 401.2, 401.3).
(k) Develop and adopt sewer use ordinance limits for
non -conventional pollutants. Implement the pretreatment program
as approved by the Director, including the enforcement of both
categorical pretreatment standards and local limits.
(1) Identify excessive Infiltration and Inflow problems
associated with the facility and establish a program to correct
these problems.
(m) Use forty percent (30%) of the revenue received from
the one-half percent (1/2%) sales tax option for water and
sewage capital outlay purposes or to retire indebtedness
incurred by the municipality for these purposes.
3. The City shall pay the Commission the following stipulated
penalties:
(a) For either failure to submit or late submittal of the
reports identified in paragraph 2(a), 2(b), or 2(d), $50 per day
for the first 7 days; $250 per day thereafter.
(b) For failure to meet the dates identified in paragraph
2(f)(1), 2(f)(2), 2(f)(3) and 2(f)(4), $100 per day for the
first 7 days; $500 per day thereafter.
(c) For failure to achieve compliance with all final effluent
limits by June 30, 1992, $5000.
(d) For each violation of the interim discharge limitations
identified in Attachment A or B, $1000.
(e) For violation of the interim monitoring frequencies
identified in Attachment A or B, $100 per omitted value per
parameter.
Payment shall be made by certified check, payable to the Department
of Environment, Health and Natural Resources, and forwarded to the
Director of the Division of Environmental Management by no later than
fifteen (15) days following demand. Stipulated penalties are not due
if the City satisfies the Division that the schedule delays were
beyond its control.

4. In accordance with the provisions of NCGS 143-215.67(b) the
Commission allows the City to accept the additional waste specified
below to its waste -disposal system.
0.3000 MGD of domestic strength waste, currently unspecified as to
source, to allow for normal growth. In no case may additions result
in exceedance of total flow limit identified in Attachments A and B.
No additional wastewater may be added without due process.
5. The Commission agrees to consider, upon request, a modification
of this Order, including, but not limited to, construction schedule
additions, additions of activities which may influence Order
expiration date, and an extension of this Order.
6. The Commission and City agree to make minor schedule
modifications, such as extensions to activity completion dates or
final compliance date, without going back to public notice, provided
that the final compliance date is not extended by more than four (4)
months.
7. This Special Order by Consent and any terms, conditions and
interim effluent limitations contained herein, hereby supersede any
and all previous Special Orders and Enforcement Compliance Schedule
Letters, and terms, conditions, and limitations contained therein
issued in connection with NPDES Permit No. NC0031836.
8. Any violation of terms of this Special Order by Consent,
including paragraph 2(f) above and Attachments A and B shall
terminate Section 4 of this Order and any portion of the authorized
additional waste not previously connected to the system shall not
thereafter be connected until the necessary sewerage system
improvements have been completed and placed in operation. Such
violations shall also subject the City to enforcement action,
including injunctive relief pursuant to NCGS 143-215.6.
9. This Special Order by Consent shall expire on September 30,
1992.

ATTACHMENT C
Chronic Toxicity Testing Requirement
The Permittee shall conduct chronic toxicity tests using test
procedures outlined in:
1. The North Carolina Ceriodaphnia chronic effluent bioassay
procedure (North Carolina Chronic Bioassay Procedure -
Revised *September, 1989) or subsequent versions.
The effluent concentration defined as treatment two in the North
Carolina procedure document is 360. The permit holder shall perform
monthly monitoring using this procedure to establish compliance with
Special Order by Consent condition. The first test will be performed
within thirty days from issuance of this Special Order by Consent.
Effluent sampling for this testing shall be performed at the NPDES
permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this Special Order
by Consent will be entered on the Effluent Discharge Monitoring Form
(MR-1) for the month in which it was performed, using the appropriate
parameter code, TGP3B. Additionally, DEM Form AT-1 (original) is to
be sent to the following address:

Test data shall be complete and accurate and include all supporting
chemical/physical measurements performed in association with the
toxicity tests, as well as all dose/response data. Total residual
chlorine must be measured and reported if employed for disinfection
of the waste stream.
Should any test data from this monitoring requirement or tests
performed by the North Carolina Division of Environmental Management
indicate potential impacts to the receiving stream, this Order may be
reopened and modified to include alternate monitoring requirements.
Note: Failure to achieve test conditions as specified in the cited
document, such as minimum control organism survival and appropriate
environmental controls, shall constitute an invalid test and will
require immediate retesting. Failure to submit suitable test results
will constitute a violation of Order conditions.
ATTACHMENT D
Part III
Permit No. NC 0031836
K. The permittee shall conduct a test for priority pollutants
annually at the effluent from the treatment plant. The
discharge shall be evaluated for all volatile fractions, acid
fractions, base/neutral fractions, and pesticide fractions
listed in Table II of Appendix D. of 40 CFR Part 122 and all
metals, cyanide, and phenols listed in Table III of Appendix D.
of 40 CFR Part 122. The permittee shall test the effluent for
any pollutants listed in Tables IV and V of Appendix D. of 40
CFR Part 122, if a specific pollutant is believed to be present
in the discharge. In addition to the above testing
requirements, other significant levels of synthetic organic
chemicals must be identified. For the purpose of implementing
this requirement, the largest 10 percent of GC/MS peaks other
than the priority pollutants shall be identified. All tests
shall be performed in accordance with the EPA Reference Methods
listed in 40 CFR 136.
ATTACHMENT E
ChV TOXICITY MONITORING REQUIREMENT (QUARTERLY)
The permittee shall conduct chronic toxicity tests using test
procedures outlined in:
1. The North Carolina Ceriodaphnia chronic effluent bioassay
procedure (North Carolina Chronic Bioassay Procedure - Revised
*September 1989) or subsequent versions, using full range option
outlined in Appendix A.
The test concentrations for this test series will be 600, 460, 360,
25% and 15%. The permit holder shall perform quarterly monitoring
using this procedure to establish compliance with the Special Order
by Consent condition. Effluent sampling for this testing shall be
performed at the NPDES permitted final effluent discharge below all
treatment processes. The first test will be performed in January,
1991 and continue in the months of April, July, October, and January,
except as exempted in paragraph 2(c).
All toxicity testing results required as part of this Special Order
by Consent condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using
the parameter code THP3B. Additionally, all testing results will be
sent to the following address:

Test data shall be completed and accurate and include all supporting
chemical/physical measurements performed in association with the
toxicity tests, as well as all dose/response data. Total residual
chlorine of the effluent toxicity sample must be measured and
reported if chlorine is employed for disinfection of the waste
stream.
Should any test data from this monitoring requirement or tests
performed by the North Carolina Division of Environmental Management
indicate potential impacts to the receiving stream, this Special
Order by Consent may be re -opened and modified to include alternate
monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited
document, such as minimum control organism survival and appropriate
environmental controls, shall constitute an invalid test and will
require immediate retesting (within 30 days of initial monitoring
event). Failure to submit suitable test results will constitute
noncompliance with monitoring requirements.

Dear Mr. Hudson:
Enclosed please find a copy of a Special Order by Consent
developed in response to a request from the City of Statesville.
Through the Order conditional compliance can be achieved while
the City actively pursues the.capability to comply with the final
effluent limitations contained in the NPDES Permit issued to the
City for the Operation of its wastewater treatment facility.
Thoughtful consideration was exercised in the development of
the scheduled activities, interim limitations and other terms
included in the Order. Please be aware, however, that any of the
required activities are only suggestive of needed additional
activities and can function only as a basic framework. It is the
responsibility of the City to fully characterize the basic
activities and bring them to fruition.
A major goal in effluent limits development is the
protection of the water quality of the receiving stream. Limits
are based in part on the assimilative ability of the receiving
stream, stream standards specific to all similarly classed
streams, and background concentrations relative to specific
pollutants. Other pollutants may be of concern, but will not be
limited, having instead monitoring only requirements. While a
special order may provide for conditional compliance, it may, for
the short term, be at the expense of the goal of stream
protection. As a counterpoint to the relaxation of your NPDES
Permit limits, the enclosed Order includes stipulated penalties

Pursuant to provisions of North Carolina General Statutes 143-215.2
and 143-215.67, this Special Order by Consent is made and entered
into by the City of Statesville, hereafter referred to as the City,
and the North Carolina Environmental Management Commission, an agency
of the State of North Carolina created by NCGS 143B-282, and
hereafter referred to as the Commission:
1. The City and the Commission hereby stipulate the following:
(a) That the City holds North Carolina NPDES Permit No.
NC0031836 for operation of an existing wastewater treatment
works and making an outlet therefrom for treated wastewater to
Fourth Creek, Class C waters of this State, in the Yadkin River
Basin, but is unable to comply with the final effluent
limitations for Chronic Toxicity as set forth in the Permit.
Based on predictions derived from effluent concentrations, the
water quality stream standards for cyanide, nickel, and cadmium
and the stream action levels for copper and possibly silver are
occasionally compromised. Compliance will require the
removal/reduction of toxic effluent constituents and effective
control of industrial discharges to the treatment works through
the City's approved and implemented industrial pretreatment
program and through the local sewer use ordinance. Compliance
may also require the planning and construction of additional
treatment works.
(b) That noncompliance with final effluent limitations
constitutes causing and contributing to pollution of the waters
of this State named above, and the City is within the
jurisdiction of the Commission as set forth in NCGS Chapter 143,
Article 21.
(c) That the City desires to cause or allow the discharge of
up to 300,000 gpd of additional domestic strength wastewater to
the treatment works, and that the discharge of such additional
wastewater from the treatment works to the waters of this State
will not result in any significant degradation in their quality
or in the quality of any water ultimately receiving such
discharge.

(d) That the subject noncompliance will be addressed through
currently funded local= programs, but should compliance require
planning and construction of additional treatment works, funding
will be secured for such; and that all corrective activities
will result in adequate treatment of wastewater presently being
discharged and the additional wastewater desired to be
discharged, to the extent that the City will be able to comply
with the final Permit effluent limitations.
(e) That the City hereby waives its right to an administrative
hearing authorized by NCGS 143-215.2 on the terms of this
Special Order by Consent, and also hereby waives its right to
seek judicial review of this Special Order by Consent as
provided in NCGS 143-215.5.
2. The City, desiring to comply with conditions of the permit
identified in paragraph 1(a) above, does hereby agree to do and
perform all of the following:
(a) Provide the Mooresville Regional Office, located at 919
North Main Street, Post Office Box 950, Mooresville, North
Carolina 28115, with a monthly report of all flow added under
this Order by no later than the fifteenth (15) day of the
following month.
(b) Continue current program to identify probable constituents
causative in effluent toxicity, and effectively control such
constituents, through either industrial user permits or local
sewer use ordinance or by•additional treatment, to the extent
required to insure that stream standards and action levels will
not be compromised and compliance with the final effluent limit
for Chronic Toxicity will be consistent. Provide the
Mooresville Regional Office with a monthly progress report
relative to these activities by no later than the fifteenth (15)
day of each month.
(c) Complete quarterly full -range chronic toxicity tests to
allow for a judgement of progress in decreasing effluent
toxicity to an acceptable level. The full -range tests will
begin in January, 1991 and continue in the months of April,
July, October and January, or until such time as test passes at
an effluent concentration of 36% (or other relevant effluent
concentration expressed as percentage, should either the
permitted discharge flow or statistical stream flow change) are
consistent, as defined in paragraph 2(f)(5), and test passes at
46% can be predicted to be consistent. See Attachments A, B,
and E.

(d) Submit the results of any additional whole effluent
toxicity tests to the =Division as per Part III, Condition I of
the current NPDES Permit, or Attachment C or E of this Order, by
no later than the thirtieth (30) day following the month in
which the tests are conducted.
(e) Meet and comply with all terms and conditions of the
permit except those effluent limitations identified in paragraph
1(a) above. See Attachments A and B for monitoring requirements
and effluent limitations. The permittee may also be required to
monitor for other parameters as deemed necessary by the Director
in future permits or Administrative letters.
(f) Upon execution of this Order, undertake the following
activities in accordance with the indicated time schedule:
1) By no later than October 31, 1990 implement and submit
to the Division's Mooresville Regional Office and Aquatic
Toxicology Unit (Post Office Box 27687, Raleigh, North
Carolina 27611-7687) a Toxicity Reduction Evaluation Plan
which is consistent with the established procedures and
protocols contained in Toxicity Reduction Evaluation
Protocol for Municipal Wastewater Treatment Plants
(EPA/600/2-88/062). J,�N rr,"T
2. Conduct a comprehensive waste survey of all industrial
users. After verifying accuracy and completeness, submit
to the Pretreatment Unit (Post Office Box 27687, Raleigh,
North Carolina 27611-7687), with a copy to the Mooresville
Regional Office, for review by no later than November 30,
1990.
3. Conduct necessary sampling to preclude, or reduce to a
minimum, use of default data, and complete a new headworks
analysis. Submit analysis to the Pretreatment Unit (Post
office Box 27687, Raleigh, North Carolina 27611-7687), with
a copy forwarded to the Mooresville Regional Office, by no
later than November 30,
4. If plng construction are required, by no later
than h 1991 submit to the Mooresville Regional
Office either:
a. A copy of the compliance/construction schedule and
authorization to construct issued to relevant industrial
dischargers by the City, which will result in the City's
compliance with final effluent limits by the date
identified in paragraph 2(f)(5); or

b. A comprehensive construction schedule relative to
activities at the subject facility, with activity
completion dates, which will result in the City's
compliance with final effluent limits by the date
identified in paragraph 2(f)(5). Accompanying the
submittal will be a request to modify this Order to include
the construction schedule.
Concurrent with the above submittals will be the complete
and adequate submittal to the Permits and Engineering Unit
(Post Office Box 27687, Raleigh, North Carolina 27611-7687)
of all applications, requests, and processing fees
necessary to facilitate the approval of the construction
activities.
5. Achieve compliance with the final effluent limits by no
later than
Compliance with Chronic Toxicity limit is defined as having
completed two (2) consecutive quarters of monthly toxicity
tests, with at least four (4) passes and no two (2)
consecutive failures in the second quarter.
(g) During the time in which this Special Order by Consent
is effective, comply with the interim effluent limitations
contained in Attachments A and B. The following reflects
only the limitations that have been modified from NPDES
requirements by this Order.

non -conventional pollutants. Implement the pretreatment program
as approved by the Director, including the enforcement of both
categorical pretreatment standards and local limits.
(1) Identify excessive Infiltration and Inflow problems
associated with the facility and establish a program to correct
these problems.

(m) Use forty percent (?" of the revenue received from
the one-half percent (1/2%) sales tax option for water and
sewage capital outlay purposes or to retire indebtedness
incurred by the municipality for these purposes.
3. The City shall pay the Commission the following stipulated
penalties:
(a) For either failure to submit or late submittal of the
reports identified in paragraph 2(a), 2(b), or 2(d), $50 per day
for the first 7 days; $250 per day thereafter.
(b) For failure to meet the dates identified in paragraph
2(f)(1), 2(f)(2), 2(f)(3) and 2(f)(4), $100 per day for the
first 7 days; $500 per day thereafter.
(c) For failure to achieve compliance with all final effluent
limits by , $5000.

(d) For each violation of the interim discharge limitations
identified in Attachment A or B, $1000.
(e) For violation of the interim monitoring frequencies
identified in Attachment A or B, $100 per omitted value per
parameter.
Payment shall be made by certified check, payable to the Department
of Environment, Health and Natural Resources, and forwarded to the
Director of the Division of Environmental Management by no later than
fifteen (15) days following demand. Stipulated penalties are not due
if the City satisfies the Division that the schedule delays were
beyond its control.

4. In accordance with the provisions of NCGS 143-215.67(b) the
Commission allows the City .to accept the additional waste specified
below to its waste -disposal system.
0.3000 MGD of domestic strength waste, currently unspecified as to
source, to allow for normal growth. In no case may additions result
in exceedance of total flow limit identified in Attachments A and B.
No additional wastewater may be added without due process.
5. The Commission agrees to consider, upon request, a modification
of this Order, including, but not limited to, construction schedule
additions, additions of activities which may influence Order
expiration date, and an extension of this Order.
6. The Commission and City agree to make minor schedule
modifications, such as extensions to activity completion dates or
final compliance date, without going back to public notice, provided
that the final compliance date is not extended by more than four (4)
months.
7. This Special Order by Consent and any terms, conditions and
interim effluent limitations contained herein, hereby supersede any
and all previous Special Orders and Enforcement Compliance Schedule
Letters, and terms, conditions, and limitations contained therein
issued in connection with NPDES Permit No. NC0031836.
8. Any violation of terms of this Special Order by Consent,
including paragraph 2(f) above and Attachments A and B shall
terminate Section 4 of this Order and any portion of the authorized
additional waste not previously connected to the system shall not
thereafter be connected until the necessary sewerage system
improvements have been completed and placed in operation. Such
violations shall also subject the City to enforcement action,
including injunctive relief pursuant to NCGS 143-215.6.
9. This Special Order by Consent shall expire on Jtni9 301 1992.

Chronic Toxicity Testing Requirement
The Permittee shall conduct chronic toxicity tests using test
procedures outlined in:
1. The North Carolina Ceriodaphnia chronic effluent bioassay
procedure (North Carolina Chronic Bioassay Procedure -
Revised *September, 1989) or subsequent versions.
The effluent concentration defined as treatment two in the North
Carolina procedure document is 36%. The permit holder shall perform
monthly monitoring using this procedure to establish compliance with
Special Order by Consent condition. The first test will be performed
within thirty days from issuance of this Special Order by Consent.
Effluent sampling for this testing shall be performed at the NPDES
permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this Special Order
by Consent will be entered on the Effluent Discharge Monitoring Form
(MR-1) for the month in which it was performed, using the appropriate
parameter code, TGP3B. Additionally, DEM Form AT-1 (original) is to
be sent to the following address:

Test data shall be complete and accurate and include all supporting
chemical/physical measurements performed in association with the
toxicity tests, as well as all dose/response data. Total residual
chlorine must be measured and reported if employed for disinfection
of the waste stream.
Should any test data from this monitoring requirement or tests
performed by the North Carolina Division of Environmental Management
indicate potential impacts to the receiving stream, this Order may be
reopened and modified to include alternate monitoring requirements.
Note: Failure to achieve test conditions as specified in the cited
document, such as minimum control organism survival and appropriate
environmental controls, shall constitute an invalid test and will
require immediate retesting. Failure to submit suitable test results
will constitute a violation of Order conditions.
ATTACHMENT D
Part III
Permit No. NC 0031836
K. The permittee shall conduct a test for priority pollutants
annually at the effluent from the treatment plant. The
discharge shall be evaluated for all volatile fractions, acid
fractions, base/neutral fractions, and pesticide fractions
listed in Table II of Appendix D. of 40 CFR Part 122 and all
metals, cyanide, and phenols listed in Table III of Appendix D.
of 40 CFR Part 122. The permittee shall test the effluent for
any pollutants listed in Tables IV and V of Appendix D. of 40
CFR Part 122, if a specific pollutant is believed to be present
in the discharge. In addition to the above testing
requirements, other significant levels of synthetic organic
chemicals must be identified. For the purpose of implementing
this requirement, the largest 10 percent of GC/MS peaks other
than the priority pollutants shall be identified. All tests
shall be performed in accordance with the EPA Reference Methods
listed in 40 CFR 136.
ATTACHMENT E
ChV TOXICITY MONITORING REQUIREMENT (QUARTERLY)
The permittee shall conduct chronic toxicity tests using test
procedures outlined in:
1. The North Carolina Ceriodaphnia chronic effluent bioassay
procedure (North Carolina Chronic Bioassay Procedure - Revised
*September 1989) or subsequent versions, using full range option
outlined in Appendix A.
The test concentrations for this test series will be 60%, 46%, 36%,
25% and 15%. The permit holder shall perform quarterly monitoring
using this procedure to establish compliance with the Special Order
by Consent condition. Effluent sampling for this testing shall be
performed at the NPDES permitted final effluent discharge below all
treatment processes. The first test will be performed in January,
1991 and continue in the months of April, July, October, and January,
except as exempted in paragraph 2(c).
All toxicity testing results required as part of this Special Order
by Consent condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using
the parameter code THP3B. Additionally, all testing results will be
sent to the following address:

The toxicity test types applied, monthly chronic pass/fail and quarterly chronic multiple concentration, appear appropriate to meet the
objectives of the order. However, there are two administrative questions concerning the SOC:
1) Is it appropriate to require a toxicity test without listing it on the Effluent Limitations pages(Attachments A and B)? Section 2.(c)
requires a quarterly multiple concentration chronic Ceriodaphnia toxicity test be conducted beginning in September, 1990.
However, although Attachment E contains the language for this requirement, there is no reference to it on Attachments A and
B(Effluent Limitations pages).
2) Given that there are two separate toxicity testing requirements(one monthly and one quarterly), is the facility required to perform
both tests during the months of March, June, September, and December? The multiple concentration test would certainly serve the
purposes of both test requirements during the months it is performed.

RE: Stipulated Penalties/Standard Language in SOC's
The Water Quality Section in the past has operated with no standard guidance
concerning stipulated penalties/standard language in SOC's. Effective immediately,
the following should generally be used as guidance in each SOC:
Failure to meet a schedule date
Failure to maintain compliance
with any limit contained in the SOC
Failure to achieve compliance with
final effluent limits at expiration of SOC
Monitoring frequency violations
Failure to submit progress reports
$100/day for the first 7 days;
$500/day thereafter.
$1000/violation
$1000 + $1.00/1000 gallons
$100 per omitted value per
parameter
$50/day for the first 7 days;
$250/day thereafter.
Language that should be included in each SOC is as follows:
All SOC's should expire 90 days after compliance with final limits is to be
attained.
Stipulated penalties are not due if the permittee satisfies the Division that the
schedule delays were beyond their control.
The above penalties seem to be the most common requirements currently utilized in
SOC schedules. If you see the need to include other requirements, please let me know
so we can formulate penalties uniformly.

Dear Mr. Hudson:
Enclosed please find a copy of a Special Order by Consent
developed in response to a request from the City of Statesville.
Through the Order conditional compliance can be achieved while
the City actively pursues the capability to comply with the final
effluent limitations contained in the NPDES Permit issued to the
City for the operation of its wastewater treatment facility.
Thoughtful consideration was exercised in the development of
the scheduled activities, interim limitations and other terms
included in the Order. Please be aware, however, that any of the
required activities are only suggestive of needed additional
activities and can function only as a basic framework. It is the
responsibility of the City to fully characterize the basic
activities and bring them to fruition.
A major goal in effluent limits development is the
protection of the water quality of the receiving stream. Limits
are based in part on the assimilative ability of the receiving
stream, stream standards specific to all similarly classed
streams, and background concentrations relative to specific
pollutants. Other pollutants may be of concern, but will not be
limited, having instead monitoring only requirements. While a
special order may provide for conditional compliance, it may, for
the short term, be at the expense of the goal of stream
protection. As a counterpoint to the relaxation of your NPDES
Permit limits, the enclosed Order includes stipulated penalties

for any failures to comply with the terms and conditions of the
Order.
Thoroughly review the Order. As the document title
suggests, it will be entered into only after the City's consent.
If the City is satisfied with the content of the Order, please
sign as indicated on the last page; upon the Order's return to
this Office, it will be forwarded to the Director of this
Division for final approval.
Accompanying the Order must be a processing fee of one
hundred dollars ($100.00) in the form of a check or money order
made payable to this Department. Also accompanying the Order
must be a resolution which addresses funding, delegates authority
to a responsible City official to negotiate on the City's behalf,
and authorized document signatory responsibility. The Division's
definition of responsible official would include the City Council
as a whole, the Mayor, or the City Manager.

Pursuant to provisions of North Carolina General Statutes 143-215.2
and 143-215.67, this Special Order by Consent is made and entered
into by the City of Statesville, hereafter referred to as the City,
and the North Carolina Environmental Management Commission, an agency
of the State of North Carolina created by NCGS 143B-282, and
hereafter referred to as the Commission:
1. The City and the Commission hereby stipulate the following:
(a) That the City holds North Carolina NPDES Permit No.
NC0031836 for operation of an existing wastewater treatment
works and making an outlet therefrom for treated wastewater to
Fourth Creek, Class C waters of this State, in the Yadkin River
Basin, but is unable to comply with the final effluent
limitations for Chronic Toxicity as set forth in the Permit.
Based on predictions derived from effluent concentrations, the
water quality stream standards for cyanide,nickel, and cadmium
and the stream action levels for copper and possibly silver are
occasionally compromised. Compliance will require the
removal/reduction of toxic effluent constituents and effective
control of industrial discharges to the treatment works through
the City's approved and implemented industrial pretreatment
program and through the local sewer use ordinance. Compliance
may also require the planning and construction of additional
treatment works.
(b) That noncompliance with final effluent limitations
constitutes causing and contributing to pollution of the waters
of this State named above, and the City is within the
jurisdiction of the Commission as set forth in NCGS Chapter 143,
Article 21.
(c) That the City desires to cause or allow the discharge of
up to 300,000 gpd of additional domestic strength wastewater to
the treatment works, and that the discharge of such additional
wastewater from the treatment works to the waters of this State
will not result in any significant degradation in their quality
or in the quality of any water ultimately receiving such
discharge.

(d) That the subject noncompliance will be addressed through
currently funded local programs, but should compliance require
planning and construction of additional treatment works, funding
will be secured for such; and that all corrective activities
will result in adequate treatment of wastewater presently being
discharged and the additional wastewater desired to be
discharged, to the extent that the City will be able to comply
with the final Permit effluent limitations.
(e) That the City hereby waives its right to an administrative
hearing authorized by NCGS 143-215.2 on the terms of this
Special Order by Consent, and also hereby waives its right to
seek judicial review of this Special Order by Consent as
provided in NCGS 143-215.5.
2. The City, desiring to comply with conditions of the permit
identified in paragraph l(a) above, does hereby agree to do and
perform all of the following:
(a) Provide the Mooresville Regional Office, located at 919
North Main Street, Post Office Box 950, Mooresville, North
Carolina 28115, with a monthly report of all flow added under
this Order by no later than the fifteenth (15) day of the
following month.
(b) Continue current program to identify probable constituents
causative in effluent toxicity, and effectively control such
constituents, through either industrial user permits or local
sewer use ordinance or by additional treatment, to the extent
required to insure that stream standards and action levels will
not be compromised and compliance with the final effluent limit
for Chronic Toxicity will be consistent. Provide the
Mooresville Regional Office with a monthly progress report
relative to these activities by no later than the fifteenth (15)
day of the following month.
(c) In addition to completing the interim Chronic Toxicity
testing requirement identified in paragraph 2(g) and in
Attachments A, B and C, complete quarterly full -range chronic
toxicity tests to allow for a judgement of progress in
decreasing effluent toxicity to an acceptable level. The
full -range tests will begin in September, 1990 and continue in
the months of December, March, June and September, or until such
time as test passes at an effluent concentration of 36% (or
other relevant instream waste concentration expressed as
percentage, should either the permitted discharge flow or
statistical stream flow change) are consistent, as defined in
paragraph 2(f)(4), and test passes at 46% can be predicted to be
consistent. See Attachment E.

(d) Submit the results of any additional whole effluent
toxicity tests to the Division as per Part III, Condition I of
the current NPDES Permit, or Attachment C and E of this Order,
by no later than the thirtieth ( 30 ) day following the month in
which the test is conducted.
(e) Meet and comply with all terms and conditions of the
permit except those effluent limitations identified in paragraph
1(a) above. See Attachments A and B for monitoring requirements
and effluent limitations. The permittee may also be required to
monitor for other parameters as deemed necessary by the Director
in future permits or Administrative letters.
(f) Upon execution of this Order, undertake the following
activities in accordance with the indicated time schedule:
1) Submit a revised comprehensive plan of action,
including activity completion dates, which will result in
goals set forth in paragraph 2(b) being met by the final
compliance date identified in paragraph 2(f)(4). Plan must
be submitted to the Mooresville Regional Office by no later
than August 31, 1990. Initiate plan concurrently with its
submittal. A judgement of feasibility and formal approval
of plan will not be issued.
2. Conduct a comprehensive waste survey of all industrial
users. After verifying accuracy and completeness, submit
to the Pretreatment Unit in Raleigh, with a copy to the
Mooresville Regional Office, for review by no later than
September 30, 1990.
3. Conduct necessary sampling to preclude, or reduce to a
minimum, use of default data, and complete a new headworks
analysis. Submit analysis to the Pretreatment Unit in
Raleigh for review, with a copy forwarded to the
Mooresville Regional Office, by no later than October 31,
1990.
4. Achieve compliance with the final effluent limits by no
later than October 31, 1991.
(g) During the time in which this Special Order by Consent
is effective, comply with the interim effluent limitations
contained in Attachments A and B. The following reflects
only the limitations that have been modified from NPDES
requirements by this Order.

(i) No later than 14 calendar days after any date or time
identified for accomplishment of any activity listed in 2(f)
above, submit to the Division Director and the Regional Office
written notice of compliance or noncompliance therewith. In the
case of noncompliance, the notice shall include a statement of
the reason(s) for noncompliance, remedial action(s) taken, and a
statement identifying the extent to which subsequent dates or
times for accomplishment of listed activities may be affected.
(j) Enforce the water conservation provisions of the State
Building Code as it applies to new residential construction
(Volume 11, Chapter IV 401.2, 401.3).
(k) Develop and adopt sewer use ordinance limits for
non -conventional pollutants. Implement the pretreatment program
as approved by the Director, including the enforcement of both
categorical pretreatment standards and local limits.
(1) Identify excessive Infiltration and Inflow problems
associated with the facility and establish a program to correct
these problems.
(m) Use forty percent (40%) of the revenue received from
the one-half percent (1/20) sales tax option for water and
sewage capital outlay purposes or to retire indebtedness
incurred by the municipality for these purposes.
3. The City shall pay the Commission the following stipulated
penalties:
(a) For either failure to submit or late submittal of the
reports identified in paragraph 2(a), 2(b), and 2(d), $300 for
the first offense, and each subsequent offense double the
previous penalty.
(b) For failure to meet the dates identified in 2(f)(1),
2(f)(2), and 2(f)(3), $100 per day for the first 7 days, and
$500 per day thereafter.

(c) For failure to achieve compliance with all final effluent
limits by October 31, 1991, $1000 plus $1 per 1000 gallons
(based on design flow).
(d) For each month in which the interim discharge limitations
identified in Attachments A and B are violated, $1000.
(e) For each month in which the interim monitoring frequencies
identified in Attachments A and B are violated, $1000.
Payment shall be made by certified check, payable to the Department
of Environment, Health and Natural Resources, and forwarded to the
Director of the Division of Environmental Management by no later than
fifteen (15) days following demand.
4. In accordance with the provisions of NCGS 143-215.67(b) the
Commission allows the City to accept the additional waste specified
below to its waste -disposal system.
0.3000 MGD of domestic strength waste, currently unspecified as to
source, to allow for normal growth. In no case may additions result
in exceedance of total flow limit identified in Attachments A and B.
No additional wastewater may be added without due process.
5. The Commission agrees to consider, upon request, a modification
of this Order, including, but not limited to, construction schedule
additions, additions of activities which may influence Order
expiration date, and an extension of this Order. Any Order
modifications are subject to due process, including public notice and
hearing procedures.
6. This Special Order by Consent and any terms, conditions and
interim effluent limitations contained herein, hereby supersede any
and all previous Special Order and Enforcement Compliance Schedule
Letters, and terms, conditions, and limitations contained therein
issued in connection with NPDES Permit No. NC0031836.
7. Any violation of terms of this Special Order by Consent,
including paragraph 2(g) above and Attachments A and B shall
terminate Section 4 of this Order and any portion of the authorized
additional waste not previously connected to the system shall not
thereafter be connected until the necessary sewerage system
improvements have been completed and placed in operation. Such
violations shall also subject the to enforcement action, including
injunctive relief pursuant to NCGS 143-215.6.

Chronic Toxicity Testing Requirement
The Permittee shall conduct chronic toxicity tests using test
procedures outlined in:
1. The North Carolina Ceriodaphnia chronic effluent bioassay
procedure (North Carolina Chronic Bioassay Procedure -
Revised *September, 1989) or subsequent versions.
The effluent concentration defined as treatment two in the North
Carolina procedure document is 36%. The permit holder shall perform
monthly monitoring using this procedure to establish compliance with
Special Order by Consent condition. The first test will be performed
within thirty days from issuance of this Special Order by Consent.
Effluent sampling for this testing shall be performed at the NPDES
permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this Special Order
by Consent will be entered on the Effluent Discharge Monitoring Form
(MR-1) for the month in which it was performed, using the appropriate
parameter code, TGP3B. Additionally, DEM Form AT-1 (original) is to
be sent to the following address:

environmental controls, shall constitute an invalid test and will
require immediate retesting. Failure to submit suitable test results
will constitute a violation of Order conditions.

Part III
Permit No. NC 0031836
K. The permittee shall conduct a test for priority pollutants
annually at the effluent from the treatment plant. The
discharge shall be evaluated for all volatile fractions, acid
fractions, base/neutral fractions, and pesticide fractions
listed in Table II of Appendix D. of 40 CFR Part 122 and all
metals, cyanide, and phenols listed in Table III of Appendix D.
of 40 CFR Part 122. The permittee shall test the effluent for
any pollutants listed in Tables IV and V of Appendix D. of 40
CFR Part 122, if a specific pollutant is believed to be present
in the discharge. In addition to the above testing
requirements, other significant levels of synthetic organic
chemicals must be identified. For the purpose of implementing
this requirement, the largest 10 percent of GC/MS peaks other
than the priority pollutants shall be identified. All tests
shall be performed in accordance with the EPA Reference Methods
listed in 40 CFR 136.
ATTACHMENT E
ChV TOXICITY MONITORING REQUIREMENT
The permittee shall conduct chronic toxicity tests using test
procedures outlined in:
1. The North Carolina Ceriodaphia chronic effluent bioassay
procedure (North Carolina Chronic Bioassay Procedure - Revised
*September 1989) or subsequent versions, using full range option
outlined in Appendix A.
The test concentrations for this test series will be 60%, 46%, 36%,
25% and 15%. The permit holder shall perform quarterly monitoring
using this procedure to establish compliance with the Special Order
by Consent condition. Effluent sampling for this testing shall be
performed at the NPDES permitted final effluent discharge below all
treatment processes.
All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Monitoring Form
(MR-1) for the month in which it was performed, using the parameter
code THP3B. Additionally, all testing results will be sent to the
following address:

Technical Support has received the request for an instream assessment for the City of Statesville
and has completed the review of the Fourth Creek Wastewater Treatment Plant (WWTP).
Statesville -Fourth Creek wishes to increase their flow by 300,000 gallons per day, not to exceed
their current design flow of 4 MGD. The City also requests that their toxicity limit be modified to
monitoring only, since the facility is currently out of compliance with regard to this parameter.
EMC criteria state that no industrial sources should be added under an Order. DEM has interpreted
this as "no toxics in toxic amounts". Therefore, it is recommended that this SOC be limited to
domestic type waste additions only. Technical Support suggests that milestones be incorporated in
the Order so that the facility will be in compliance with their whole effluent toxicity limit upon
expiration of the Special Order of Consent. Monthly whole effluent toxicity monitoring is
recommended during the life of the Order. The region may wish to consider periodic "full range"
toxicity monitoring to establish progress made toward final compliance if failures at the "pass/fail"
level continue. In addition, the City should update their headworks analysis as stated in the
attachment.
Background Information
The City of Statesville discharges into Fourth Creek, which is a class "C" stream in the Yadkin
River Basin. The drainage area at the point of discharge is 46.5 square miles. The 1984 USGS
flows used in the most recent wasteload allocation are as follows: 7Q10 = 11.0 cfs (summer),
average stream flow = 46.0 cfs.
Statesville, Fourth Creek, WWTP is required to conduct a chronic quarterly pass/fail test at an
instream waste concentration (IWC) of 36% at the design flow of 4 MGD. The City has been
performing monthly toxicity testing and conducting various bench scale operations in order to find
the cause of their whole effluent toxicity. Statesville has reported failures every month for the past
year with the exception of February and April of this year and with no test being reported for
December 1989. Toxicity tests for March (fail) and April (pass) 1990 were conducted at an
instream waste concentration of 46%, which is the facility's IWC upon expansion above 4 MGD.
The City has recently updated their headworks. However, the facility should update their
headworks analysis using new pretreatment monitoring information (see attached schedule).
Cadmium and Lead should be scrutinized since these parameters will be limited upon expansion
above 4 MGD.
Analysis and Discussion
A mass balance analysis was conducted for both lead and cadmium at the design flow of 4 MGD.
The total allowable effluent level for cadmium, if it were a limited parameter, was found to be
5.5 µg/l based on a State chronic criteria of 2 µg/l. Compliance data show values of 5.0 µg/l and
4.6 µg/l cadmium for the months of February and March, respectively. The average flows for
these months were 3.6 and 3.3 MGD. Since cadmium will be a limited parameter when flow
exceeds 4 MGD, Statesville should make efforts to reduce its discharge in the effluent.
The total allowable level for lead, at 4 MGD using a State chronic criteria of 25 µg/1, was found to
be 69 µg/l. Statesville's discharge monitoring report forms indicated that lead levels were below a
detection level of 50 µg/l. Future adherence to a lead limit should not be a problem for the facility,
although Statesville may wish to use a method which will detect lead at levels below 50 µg/l to
relieve any concerns of possible violation when the plant expands its flow.

Summary and Recommendations
Technical Support has received the request for an instream assessment for the City of Statesville
and has completed the review of the Fourth Creek Wastewater Treatment Plant (WWTP).
Statesville -Fourth Creek wishes to increase their flow by 300,000 gallons per day, not to exceed
their current design flow of 4 MGD. The City also requests that their toxicity limit be modified to
monitoring only, since the facility is currently out of compliance with regard to this parameter.
EMC criteria state that no industrial sources should be added under an Order. DEM has interpreted
this as "no toxics in toxic amounts". Therefore, it is recommended that this SOC be limited to
domestic type waste additions only. Technical Support suggests that milestones be incorporated in
the Order so that the facility will be in compliance with their whole effluent toxicity limit upon
expiration of the Special Order of Consent. Monthly whole effluent toxicity monitoring is
recommended during the life of the Order. The region may wish to consider periodic "full range"
toxicity monitoring to establish progress made toward final compliance if failures at the "pass/fail"
level continue. In addition, the City should update their headworks analysis as stated in the
attachment.

The City of Statesville discharges into Fourth Creek, which is a class "C" stream in the Yadkin
River Basin. The drainage area at the point of discharge is 46.5 square miles. The 1984 USGS
flows used in the most recent wasteload allocation are as follows: 7Q10 = 11.0 cfs (summer),
average stream flow = 46.0 cfs.
Statesville, Fourth Creek, WWTP is required to conduct a chronic quarterly pass/fail test at an
instream waste concentration (IWC) of 36% at the design flow of 4 MGD. The City has been
performing monthly toxicity testing and conducting various bench scale operations in order to find
the cause of their whole effluent toxicity. Statesville has reported failures every month for the past
year with the exception of February and April of this year and with no test being reported for
December 1989. Toxicity tests for March (fail) and April (pass) 1990 were conducted at an
instream waste concentration of 46%, which is the facility's IWC upon expansion above 4 MGD.
The City has recently updated their headworks. However, the facility should update their
headworks analysis using new pretreatment monitoring information (see attached schedule).
Cadmium and Lead should be scrutinized since these parameters will be limited upon expansion
above 4 MGD.
Anaiysts ana viscussion
A mass balance analysis was conducted for both lead and cadmium at the design flow of 4 MGD.
The total allowable effluent level for cadmium, if it were a limited parameter, was found to be
5.5 µg/1 based on a State chronic criteria of 2 µg/l. Compliance data show values of 5.0 µg/1 and
4.6 µg/1 cadmium for the months of February and March, respectively. The average flows for
these months were 3.6 and 3.3 MGD. Since cadmium will be a limited parameter when flow
exceeds 4 MGD, Statesville should make efforts to reduce its discharge in the effluent.
The total allowable level for lead, at 4 MGD using a State chronic criteria of 25 µg/l, was found to
be 69 µg/l. Statesville's discharge monitoring report forms indicated that lead levels were below a
detection level of 50 µg/l. Future adherence to a lead limit should not be a problem for the facility,
although Statesville may wish to use a method which will detect lead at levels below 50 µg/1 to
relieve any concerns of possible violation when the plant expands its flow.
1. Conduct and submit industrial waste survey for the purpose
of identifying the sources of toxic pollutants being discharged
to the wastewater treatment facility. (Cao PA15)
2. Submit a plan for a monitoring program to collect site
specific data needed to complete a headworks analysis (HWA).
This program shall cover the data needed to immediately update
the City's HWA as well as the long term monitoring needed for
future HWA updates. (30 VAdS)
3. Revise the monitoring program (based on DEM comments
received within 45 days of monitoring program submission).(3D-Pay5)
4. Implement the monitoring program as revised based on DEM
comments.
5. After implementation of the "Immediate Update" portion of
the long term monitoring program, conduct and submit a Headworks
analysis (HWA) for DEM approval. (45 nA-ls�
6. Review the results of the HWA and modify the City's sewer
use ordinance (SUO) limits and pretreatment permit limits as
necessary.
7. Develop and submit to DEM for approval an enforcement
management strategy (EMS).
8. Revise the EMS (based on DEM comments received within 45
days of EMS submission).
9. Implement the EMS as revised based on DEM comments.
10. Modify the City's SUO as necessary to allow for
implementation of the EMS.

In November, 1987, thr Fourth Creek V1wTP received a new permit
containing limits and molli_toring requirements based on el 11GD flora
and 6 HGD flow. The permit was issued this way because the City was
in the midst of expanding from a 4 HGD to a 6 HGD facility.
In February, 1.990, the expansion project was completed. however,
the plant flow has not 3ignif:ic ,111tl.y changed ( 2. 9 1IGD to 3. 3 HGD )
and is still under 4.0 1•IGD.
The permit reads "During the period beginning upoll expansion
above 4.0 11GD and lasting until expiration, the permi.ttee is
authorized to dischargefrom out -fall. serial number-001. SLIC11
discharges shall be limited and nloni.tored by the permitter as
specified...."
As the plants flow (and treatment) has not significantly
changed and flol"s have not excec;dr_d 4.0 11GD, I feel we should still
be under those limits set forth in the 4.0 11GD section.
As an example, if the City expanded from a 4.0 HGD plant to F1
20 1•IGD plant yet: the f lOW r, mained under 4.0 1iGD it seems reasonable
to operate under a 4.0 11GD pernlit limit and not a 20 11GD permit.

The City of Statesville finds itself unable to pass present
toxicity and Cadmium limits. From the very beginning, we have
pursued aggressive procedures to correct this problem.
Correspondence containing request for assistance from the State as
well as a continual updating of our situation has been forthcoming
from the city to the State. We have made some progress, but
unfortunately need more time to correct the problem.
Therefore, this letter is an official request for an SOC for
the Fourth Creek Wastewater Treatment aci ity.
The city intends to take whatever action is necessary to
correct this problem from operational modification to construction
if needed.
As we understand (from the Mooresville Office) an SOC can
contain flow limits. Therefore, we would like to request a limit
of 4.5 MGD for a period of eighteen (18) months. However, we
understand the State will set these limits and whatever the final
limits are we will attempt to comply.
The city's sincere desire to comply with all permitted limits
can be documented over the past year with records and
correspondence. In addition to this, we will have begun within the
next 30 days to implement a Toxicity Reduction Evaluation program
-_ha _nvolves sampling from the plant's influent on up through the
collection system and hopefully pinpointing the source(s) of
toxicity.
The city has just completed a 4.5 million dollar expansion
project and had hoped one of the results of the expansion would be
toxicity compliance. By using the new system we hope to reduce
present solids maintaining Tox and Cadmium compliance.
We look forward to discussing this with you at your
convenience and thank you for your attention to this request for
