Sullins Dee Freeman Governor Director Secretary Mr. Jon Meschel Alamance Crossing, LLC PO Box 30013 Raleigh, NC 27622-0013 May 21, 2010 DWQ# 07-1576 Alamance County APPROVAL of Modification to Mitigation Plan for Individual Certification No. 3751, Alamance West Crossing Dear Mr. Meschel: Per a request submitted on your behalf by Soil and Environmental Consultants, PA dated May 14, 2010, you have our approval, to modify your Mitigation Plan as follows: 1. Mitigation must be provided for the proposed impacts as specified in the table below. We understand that you intend to purchase a portion of the necessary credits from the Cripple Creek Mitigation Bank in Alamance County as described in your request to meet this mitigation requirement. This contribution has been determined by the Division to be a suitable method to meet the mitigation requirement. Until the Cripple Creek Mitigation Bank receives and clears your check, and proof of payment has been provided to this Office, no impacts specified in this Authorization Certificate shall occur. For accounting purposes, this Authorization Certificate authorizes payment into the Cripple Creek Mitigation Bank to meet the following compensatory mitigation requirement: Compensatory Mitigation Required River and Sub-basin Number Amount to be credited Stream 1,092 feet Cape Fear/0303002 233.7 feet Wetlands 1.75 acres Cape Fear/0303002 0.75 acres 2. Mitigation must be provided for the proposed impacts as. specified in the table below. We understand that you wish to make a payment to the Wetlands and Stream Restoration Funds administered by the NC Ecosystem Enhancement Program (EEP) to meet a portion of this mitigation requirement. This has been determined by the Division to be a suitable method to meet the mitigation requirement. Until the EEP receives and clears your check (made payable to: DENR - Ecosystem Enhancement Program Office), no impacts specified in this Authorization Certificate shall occur. The EEP should be contacted at (919) 733-5205 if you have any questions concerning payment into a restoration fund. You have 60 days from the date of this approval to make this payment. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
