The Division hereby renews Certificate of Coverage (CoC) NCG520107 to discharge under General
Permit NCG520000. This CoC is issued pursuant to the requirements of North Carolina General Statue
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection agency dated October 15, 2007 [or as subsequently amended].
If any parts, measurement frequencies or sampling requirements contained in this General Permit
are unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the
Division. The Division may require modification or revocation and reissuance of the certificate of coverage.
Contact the Mooresville Regional Office prior to any sale or transfer of the permitted facility.
Regional Office staff will assist you in documenting the transfer of this CoC.
This permit does.not affect the legal requirements to obtain any other Federal, State, or Local
governmental permit that may be required.

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and
regulations promulgated and adopted by the North Carolina Environmental Management Commission, and
the Federal Water Pollution Control Act, as amended,

to receiving waters designated as Buffalo Creek, a class C stream in subbasin 03-08-05 of the
Broad River Basin. All discharges shall be in accordance with the effluent limitations, monitoring
requirements, and other conditions set forth in Parts I,, II, III and IV hereof.
This certificate of coverage shall become effective June 22, 2016.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

As was discussed on site with Mr. McRorie the subject permit may be rescinded as long
the following conditions are met:
1) No water and/or wastewater of any amount discharges as a result of the dredging
activity. Any discharge that will be observed without the permit will result in the
potential assessment of civil penalty.
2) Location of the dredging operation remains the same.

PART IV - EVALUATION AND RECOMMENDATIONS
Rea Contracting is applying for a general permit for the
discharge of wastewater generated from the sand dipping operation
at sand pit # 126 in Cleveland County. Sand Dipping will occur
approximately twice per year according to applicant with about 8000
tons of sand excavated and stockpiled for removal. Approximately
600 linear feet of stream is excavated with a dragline. According
to the applicant the excavation is conducted for half of the river
adjacent to the stockpile area, and the excavation depth is no more
than six feet.
It is recommended the subject permit be issued as requested.

Rea Contracting currently owns and operates Sand Pit 4126 (Mine Permit No. 23-12),
which conducts sand removal from the Buffalo Creek in Cleveland County, North
Carolina. The site is accessed via farm road off SR-2228 (Mallard Dr.) about 1 mile
southwest of SR-226 (Cleveland Ave.). Approximately 8,000 tons of sand is removed
once a year from the Buffalo Creek. Approximately 600 lineal feet of stream is excavated
with a dragline. Excavation is only conducted for half of the river adjacent to the
stockpile area, and the excavation depth is no more than six feet. The excavated sand is
then stored in a stockpile area until needed.
Due to recent changes in permitting regulations made by the State of North Carolina
Department of Environmental and Natural Resources, Division of Water Quality
(NCDENR-DWQ), the excavation activities requires a new type of general permit.
Currently, the site is covered under General Permit NCG020000, which covers discharge
from- conventional mining operations. Because the excavation occurs in -stream, General
Permit NCG520000 is now required.
Attached is the Local Government Review Form as required by the NCDENR-DWQ.
This form must be sent to any city and county government having -Jurisdiction over any
part of the lands on which the proposed facility and its appurtenances are located. This
form must be completed and returned to Engineering & Environmental Science Company
within 15 days of receiving and signing for the certified mail. If no issues are raised, or if
the form is not returned within 15 days of receipt of the certified mail, the application for
General Permit NCG520000 will be submitted to NCDENR-DWQ.

d) Final plans for the treatment system (if applicable). The plans must be signed and sealed by a

e) Final specifications for all major treatment components (if applicable). The specifications must be
signed and sealed by a North Carolina registered Professional Engineer and shall include a
narrative description of the treatment system to be constructed.

General Statute Overview
North Carolina General Statute 143-215.1 (c)(6) allows input from local governments in the issuance of NPDES Permits for non -
municipal domestic wastewater treatment facilities. Specifically, the Environmental Management Commission (EMC) may not act
on an application for a new non -municipal domestic wastewater discharge facility until it has received a written statement from
each city and county government having jurisdiction over any part of the lands on which the proposed facility and its
appurtenances are to be located. The written statement shall document whether the city or county has a zoning or subdivision
ordinance in effect and (if such an ordinance is in effect) whether the proposed facility is consistent with the ordinance. The
E1IC shall not approve a permit application for any facility which a city or county has determined to be inconsistent with zoning
or subdivision ordinances unless the approval of such application is determined to have statewide significance and is in the best
interest of the State.
Instructions to the Applicant
Prior to submitting an application for a NPDES Permit for a proposed facility, the applicant shall request that both the
nearby city and county government complete this form.
The applicant must:
Submit a copy of the permit application (with a written request for this form to be completed) to the clerk of the
city and the county by certified mail, return receipt requested.
If either (or both) local government(s) fail(s) to mail the completed form, as evidenced by the postmark on the

Dear Ms. Willis,
Rea Contracting currently owns and operates Sand Pit #126 (Mine Permit No. 23-12),
which conducts sand removal from the Buffalo Creek in Cleveland County, North
Carolina. The site is accessed via farm road off SR-2228 (Mallard Dr.) about 1 mile
southwest of SR-226 (Cleveland Ave.). Approximately 8,000 tons of sand is removed
once a year from the Buffalo Creek. Approximately 600 lineal feet of stream is excavated
with a dragline. Excavation is only conducted for half of the river adjacent to the
stockpile area, and the excavation depth is no more than six feet. The excavated sand is
then stored in a stockpile area until needed.
Due to recent changes in permitting regulations made by the State of North Carolina
Department of Environmental and Natural Resources, Division of Water Quality
(NCDENR-DWQ), the excavation activities requires a new type of general permit.
Currently, the site is covered under General Permit NCG020000, which covers discharge
from conventional mining operations. Because the excavation occurs in -stream, General
Permit NCG520000 is now required.
Attached is the Local Government Review Form as required by the NCDENR-DWQ.
This form must be sent to any city and county government having jurisdiction over any
part of the lands on which the proposed facility and its appurtenances are located. This
form must be completed and returned to Engineering & Environmental Science Company
within 15 days of receiving and signing for the certified mail. If no issues are raised, or if
the form is not returned within 15 days of receipt of the certified mail, the application for
General Permit NCG520000 will be submitted to NCDENR-DWQ.

Dear Mr. Robinson:
Engineering & Environmental Science Company (E2S) has completed the Treatment
System Design for the above referenced site. Following is a discussion of the project
information and our evaluation.

The Sand Pit # 126 is located in Cleveland County, North Carolina. The site is accessed
via farm road off SR-2228 (Mallard Dr.), about 1 mile southwest of SR-226 (Cleveland
Ave.) (See Attachment A, Figure 1).
Approximately 8,000 tons of sand is removed twice a year from the Buffalo Creek.
Approximately 600 lineal feet of stream is excavated with a dragline. About 400 lineal
feet of the stream is in buffers. Excavation is only conducted for .half of the river
adjacent to the stockpile area, and the excavation depth is no more than six feet. The
excavated sand is then stored in a stockpile area until needed.
Erosion control is provided using perimeter berms with stone outlet sections. No
dewatering will be conducted for this operation. Because very little water is released by
the sand after excavation, no discharge will occur due to the excavation process. The
small amount of water that is released by the sand will infiltrate the ground. The
containment system temporarily holds at least the 25-year rain event runoff with
discharge occurring through the stone filter sections. The receiving body of water is the
Buffalo Creek, which has a Stream Classification of "C" (See Attachment A, Figure 2).

Upon completion of mining activities, the stockpile will be depleted and the site will be
graded for positive drainage and then re -vegetated. The ground will be sloped away from
the riverbank as per pre-existing conditions. The on -site farm road existed prior to the
mine activities and is used for farm equipment access. This farm road is flush with the
surrounding ground, and will remain in -place. There is one existing culvert on the road
which will remain in -place.
EROSION CONTROL EVALUATION
The NRCS Runoff Curve Number method was used to evaluate the erosion control
structures. The USDA Soil Survey indicated that the majority of soils in the mining area
are Toccoa loam, Hydrologic Group B (See Attachment B). Buffers of 100 ft. and 300 ft.
are provided along the river bank with access and stockpile areas of 200 ft. and 400 ft.
long. The stone outlet sections are 2.75 ft. high while the surrounding berms are 3 ft.
high. The erosion control structures are designed to store the runoff for a 25-year rain
event (See Attachment Q.
ALTERNATIVE ANALYSIS
Because no discharge occurs due to excavation, no alternative analysis is necessary.
