The following information is provided in response to the Compliance Evaluation Inspection at
Moss Lake in Kings Mountain.
Per your request, the semi-annual effluent flow estimates are detailed below.
For the reporting period beginning September 1, 2016 and ending December 31, 2016 the
greatest amount estimated effluent flow was 20 cubic yards.
This was arrived at by calculating the following:
The great amount removed during one day during the reporting period occurred on
September 29, 2016. This information was reported to the City by Clark Ledbetter, who holds
the dredging contract. The totals for that measured 100 cubic yards (8 loads). The formula you
provided is applied below.
100 cubic yards * 0.20 = 20 cubic yards

at the subject facility on December 13, 2016, by Qri Tuvia. Your cooperation during the site visit
was much appreciated. Please advise the staff involved with this NPDES Permit by forwarding a
copy of the enclosed repot.
As discussed on site, semiannual effluent flow estimates are needed. Additionally, when
you retire, please complete and mail (as instructed on the form), the change of permitee form
(see attached).

1250 cubic yards have been dredged in 2016. No estimated flow has been recorded the

The Division hereby renews Certificate of Coverage (CoC) NCG520110 to discharge under General
Permit NCG520000. This CoC is issued pursuant to the requirements of North Carolina General Statue
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection agency dated October 15, 2007 [or as subsequently amended].
If any parts, measurement frequencies or sampling requirements contained in this General Permit
are unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the
Division. The Division may require modification or revocation and reissuance of the certificate of coverage.
Contact the Mooresville Regional Office prior to any sale or transfer of the permitted facility.
Regional Office staff will assist you in documenting the transfer of this CoC.
This permit does not affect the legal requirements to obtain any other Federal, State, or Local
governmental permit that may be required.

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and
regulations promulgated and adopted by the North Carolina Environmental Management Commission, and
the Federal Water Pollution Control Act, as amended,

to receiving waters designated as.Buffalo Creek, a class WS-III stream in subbasin 03-08-05 of the
Broad River Basin. All discharges shall be in accordance with the effluent limitations, monitoring
requirements, and other conditions set forth in Parts I, II, III and IV hereof.
This certificate of coverage shall become effective June 22, 2016.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

This is in response to your submission dated August 28, 2015, and received on September 1,
2015, of plans and specifications for installation of instrumentation within the subject dam in
compliance with the Dam Safety Law of 1967. The plans and specifications submitted were
prepared under the supervision of Mr. Christopher E. Wood, PE.
This letter constitutes approval of the proposal to install instrumentation within the subject dam
according to the plans and specifications received by this Division on August 28, 2015, with the
following stipulations:
1. Project construction shall be supervised by Mr. Christopher E. Wood, PE, Mr. Christopher
E. Wood, PE, shall be responsible for field observation of construction as necessary to
ensure compliance with approved plans [GS 143-215.29].
2. During installation, the Division of Energy, Mineral, and Land Resources may require such
progress reports as are deemed necessary.
3. In accordance with GS 143-215.29 and NCAC 15A-2K .0203, .0212, .0215, and .0216,
within 30 days of completion of the project, Mr. Christopher E. Wood, PE shall inspect the
completed work and upon finding that the work has been done as specified and the dam is
safe, shall file with the Division of Energy, Mineral, and Land Resources two sets of record
drawings and a certificate stating that the work has been completed in accordance with
approved plans, specifications and other requirements.

4. A procedure and schedule for reading the monitoring wells, recording the data, and storing
the data shall be provided with the record drawings. Until the ongoing investigation and
repair work is complete, monitoring of the piezometers shall be performed on at least a
daily basis while the low level conduit remains unpressurized and hourly monitoring shall
be performed at times when the low level conduit is pressurized. Piezometer readings shall
be recorded and made immediately available upon request of this Division. A summary of
piezometer readings shall be made in the weekly status reports required by Stipulation 5 of
our letter to you dated July 20, 2015.
5. This approval does not convey the right to access the private property of others. Any
required access to perform the approved work must be secured prior to initiation of
construction activities.
6. You must notify Mr. Zahid Khan, Regional Supervisor, Land Quality Section, 610 East
Center Avenue, Suite 301, Mooresville, North Carolina 28115, telephone number (704)
663-1699 prior to the start of construction.
The Army Corps of Engineers and the Division of Water Resources of this Department should be
contacted to determine if additional permits are required. Also, the erosion and sediment control
program having jurisdiction should be contacted to determine permit requirements. In any case,
sediment must be prevented from entering the waters of the state or flowing onto neighboring
property.
Installation of instrumentation must begin within one year of the date of this letter or this
approval is void. For assistance you may contact the Mooresville Regional Office at (704) 663-
1699 or a staff member of the Dam Safety Program in the Raleigh Central Office at telephone
number (919) 707-9220.

Site Usage
This project involves the removal of accumulated. sand and sediment from the upper reaches of
Moss Lake, which is the City's water supply reservoir. Moss Lake has seen heavy concentration
of sands being deposited into upper end of the reservoir. This intent of this operation is to limit
the amount of material that will be added to the current sediment deposits. The material will be
removed on an as needed basis, based on the level of sands that are accumulated in front of the
access area.
The material will be removed from the reservoir using a trackhoe. The material will be allowed
to dewater and drain into a skimmer basin to treat the ancillary water associated with the sand
dredging operations and the stormwater from the stockpile areas. Once the material is dry, it will
be removed from the site. The material is mostly a sandy material with some silt and trash. All
material will be removed from the site.
Alternate Analysis
There are not any structures that have process water on site. The skimmer basin collects the
stormwater and ancillary water on the site. The location, size, and terrain of the site do not
allow any alternate forms of treatment available for the stormwater and ancillary water on the
site. The configuration of the tract and the site's proximity to the stream prevent the use of
subsurface and spray irrigation systems. There is not a public sewer system in the area, but since
the skimmer collects stormwater, most Municipal or Regional Sewer Collection System would
not permit the flows from the skimmer basin to be added to their system.

clearly indicated. This includes tracing the pathway of a storm sewer to its discharge point.
c) If this application is being submitted by a consulting engineer (or engineering firm), include
documentation from the applicant showing that the engineer (Or firm) submitting the application
has been designated an authorized Representative of the applicant.
d) Final plans for the treatment system (if applicable). The plans must be signed and sealed by a
North Carolina registered Professional Engineer and stamped "Final Design -Not released for

The discharge point is immediately below a rock spillway that was once used as a
water supply source for a nearby mill. The receiving stream at this point is z 20
feet wide and 6 - 12 inches deep. Stream dimensions are likely to change once the
dredging operation begins.

PART IV - EVALUATION AND RECOMMENDATIONS
The applicant, City of Kings Mountain (the City), requests approval to construction a
settling basin and associated discharge from a sand dredging operation proposed near the
headwaters of Moss Lake. The City owns the lake and for years has dealt with accumulations of
sand and silt that continues to be deposited in the upper reaches of the lake. Past attempts to
remove sand deposition in the main body of the lake have met with varying degrees of success,
so the City is looking at trying to capture as much of the sand and silt as possible before it enters
the lake.
The City plans to use along -reach trackhoe to gain access to the material as it is carried
down the creek. The material will be pulled from the creek and allowed to drain into the settling
basin where the ancillary water will be treated and discharged. Once the material has dried,.it
will be removed from the site.
The proposed site was once used as a sand dredging operation in the past; however, the
previous operation did not have a point source discharge and no discharge permit was required.
The current site has limited area, which may become problematic for the City should the amount
of deposition recovered exceed the amount of storage area available. It will also be important to
maintain the existing basin from accumulating excess material which would reduce settling
efficiency, especially since it is not baffled and is limited to a single basin. This Office
recommends issuance gtthe pen -nit as requested.

Gentlemen;
Please find enclosed an application for coverage of the project listed above under General
Permit NCG52000. This site will be used to remove sand deposits from the upper end of
Moss Lake, which is our water supply reservoir. Moss Lake has seen heavy
concentration of sand and sediment being deposited into upper end of the reservoir. This
intent of this operation is to limit the amount of material that will be added to the current
sediment deposits. The material will be removed on an as needed basis, based on the
level of sand and sediments that are accumulated in front of the access area.
The skimmer basin design is under reviewed by NCDENR- Land Quality
The following items are enclosed for your review and approval.
• Copy of the check for $100 made payable to NCDENR
• 3 copies of county map with location of facility clearly marked on map
• 3 copies of a portion of the Waco 7.5 minute series USGS topographic
map showing the discharge location.
• 3 copies of the completed application
• 3 sets of mine map and specifications prepared for the mining permit.

only viable means of discharge.

specific. Water draining from the sand piles and stormwater runoff is collected in the sediment basin.
Any fines in the water are settled out in the storage basin and then discharged from the basin using a
Faircloth Skimmer.
e) Is there any treatment being applied to the wastewater before discharge (check the type of
treatment in use).

design volume, retention time, surface area, etc.) with submittal package. Existing treatment
facilities should be described in detail. Design criteria and/ operational data (including
calculations) should be provided to ensure that the facility can comply with the requirements of the
General Permit:
The treatment shall be sufficient to meet with the limits set by the general permits. The trapping
efficiency should be greater than 75%. The surface area should be as large as possible to insure
sedimentation occurs. To secure optimum efficiency the flow length of the basin to the basin
width should have a ratio of 2:1
Note: - Construction of any wastewater treatment facilities requires submission of three (3) sets
of plans and specifications along with the application. Design of treatment facilities must
comply with requirements of 15A NCAC 2H .0138. If construction applies to this
discharge, include the three sets of plans and specifications with this application.

9) Alternatives to Direct Discharge:
Address the feasibility of implementing each of the following non -discharge alternatives
a) Connection to a Municipal or Regional Sewer Collection System
b) Subsurface disposal (including nitrification field, infiltration gallery, injection wells, etc.)
c) Spray irrigation
The alternatives to discharge analysis should include boring logs and/or other information indicating
that a subsurface system is neither feasible nor practical as well as written confirmation indicating that
connection to a POTW is not an option. It should also include a present value of costs analysis as
outlined in the Division's "Guidance For the Evaluation of Wastewater Disposal Alternatives".
10) Additional Application Requirements:
For new or proposed discharges, the following information must be included in triplicate with this
application or it will be returned as incomplete.
a) 7.5 minute series USGS topographic map (or a photocopied portion thereof) with discharge
location clearly indicated.
b)-.-Site-map; if the discharge is not directly to, a stream, the pathway to the receiving stream must be
clearly indicated. This includes tracing the pathway of a storm sewer to its discharge point.
c) If this application is being submitted by a consulting engineer (or engineering firm), include
documentation from the applicant showing that the engineer (Or firm) submitting the application
has been designated an authorized Representative of the applicant.
d) Final plans for the treatment system (if applicable). The plans must be signed and sealed by a
North Carolina registered Professional Engineer and stamped -"Final Design -Not released for
construction".
e) Final specifications for all major treatment components (if applicable). The specifications must be
signed and sealed by a North Carolina registered Professional Engineer and shall include a
narrative description of the treatment system to be constructed.
